The submittal described above has been reviewed for equivalency to applicable Wisconsin Administrative Codes and compliance with Wisconsin Statutes. The submittal has been CONDITIONALLY APPROVED. The owner, as defined in section 101.01(10), Wisconsin Statutes, is responsible for compliance with all conditions of this petition approval and other applicable code requirements. Your Petition for Variance of code section(s) noted above has been reviewed. The code section petitioned requires "all shower compartments, regardless of shape, shall have a minimum finished interior of 900 square inches and shall be capable of encompassing a circle with a diameter of30 inches. The minimum required area and dimension shall be measured in a horizontal plane 24 inches above the top of the threshold and may not extend beyond the centerline of the threshold. The minimum area and dimensions shall be maintained to a point 70 inches above the shower waste outlet with no protrusions other than the fixture valve or valves, showerheads, soap dishes, retractable seats and safety grab bars or rails". The variance requested is to allow the installation of a basement shower with an exterior dimension of36 x 32 inches and an interior dimension that is less than 30 inches when measured as specified in the aforementioned paragraph. The home has two other showers (combination tub/shower unit and 48" x 36" shower module) that exceed the code minimum area and dimensional requirements The intent ofthe code section petitioned is outlined in Connn 82.1 0 (1) (h) which states "All plumbing fixtures shall be installed so as to provide adequate spacing and accessibility for the intended use and cleaning". Approval is contingent upon the owners acceptance and knowledge of the situation as verified by the copy of the March 17, 2006 inspection report issued to owner and furnished with the documents of this petition. 2. This variance is specific to the subject petition and cannot be used for any additional modifications. . Based on the precedent established by the previous petitions, this petition for variance is being processed as permitted by Wisconsin Statute s. 1O1.02(6)(g), and Connn 3. This decision will become final unless the department within 30 days from the date ofthis letter receives a written request for a hearing. A request for hearing should be sent to the address shown on this letterhead. A copy of this letter must be included with the request for a hearing. The request for hearing should state the reasons for objecting to the department's decision, because a request for hearing may be denied if it does not present a significant question in fact, law or policy.
