HomeMy WebLinkAbout06-149.doc APRIL 25, 2006 06-149RESOLUTION (CARRIED __7-0___ LOST _______ LAID OVER _______ WITHDRAWN _______) PURPOSE:DISALLOWANCE OF CLAIM FOR EXCESSIVE ASSESSMENT / HAVENWOOD HEIGHTS LLC INITIATED BY:LEGAL DEPARTMENT WHEREAS, on January 31, 2006, pursuant Sec. 74.37, Wis. Stats, Havenwood Heights LLC filed a claim for excessive assessment on real estate that it owns at 205 N. Westhaven Dr., 275 N. Westhaven Dr., and 351 N. Westhaven Dr., Oshkosh; and WHEREAS, upon further review of the documentation filed with the Claim, the Assessor believes that the original assessment, affirmed by the 2005 Board of Review, is correct and recommends that this claim be denied; NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper City officials are hereby authorized and directed to disallow the following claim for excessive assessment against the City of Oshkosh: HAVENWOOD HEIGHTS LLCDate of claim: 1/31/06 BE IT FURTHER RESOLVED that the City Clerk is hereby directed to inform the claimant by certified mail of the disallowance, which shall include this statement: The claimant may commence an action in Winnebago County Circuit Court to recover the amount of the claim not allowed. This action shall be commenced within 90 days after the claimant receives notice by registered or certified mail that the claim is disallowed, pursuant to Sec. 74.37(3)(d).
