MURDOCK AVENUE, EAST OF 1800 JACKSON STREET (FAIR ACRES CENTER) HERITAGE REALTY MGMT, INC., PETITIONER INITIATED BY: PLAN COMMISSION RECOMMENDATION: Approved with conditions BE IT RESOLVED by the Common Council of the City of Oshkosh that a conditional use permit for a planned commercial development for construction of a retail shopping center with a drive-thru coffee shop, per the attached revised site plan, is hereby approved with the following conditions: 1 ) An access easement be established between the two properties and recorded at the Register of Deeds subject to approval by the Department of Community Development of said agreement and/or changes to the agreement. The sidewalk be extended along the east side of the access drive from Murdock Avenue to the Fair Acres Shopping Center parking lot. The northern property line be moved 9'6" to the north to encompass the proposed improvements and required 5 ft. rear yard setback. Base standard modification for a reduction in east side yard setback from 10ft. to 5 ft. is approved. East elevation of the building is modified to add some vertical elements with final approval by the Department of Community Development. Base standard modification for a reduction in required parking from 38 spaces to 36 spaces is approved. Decorative style lights no higher than 24 ft. tall be used with final approval by the Department of Community Development. A drainage and grading plan be submitted to, and approved by, the Department of Public Works.
