HomeMy WebLinkAbout06-126.doc R E V I S E D MARCH 14, 2006MARCH 28, 2006 06-109 06-126 ORDINANCE FIRST READING SECOND READING (CARRIED__7-0___ LOST_______ LAID OVER_______ WITHDRAWN_______) PURPOSE:AMEND PUBLIC NUISANCE CODE PROVISIONS / OUTDOOR FURNACES, STOVES & BOILERS / WEED CUTTING AND LAWN CARE INITIATED BY:INSPECTIONS DIVISION A GENERAL ORDINANCE OF THE CITY OF OSHKOSH CREATING SECTION 17- 33(L) PERTAINING TO OUTDOOR SOLID FUEL FURNACES, STOVES AND BOILERS AND REPEALING AND RECREATING SECTION 17-44 PERTAINING TO WEED CUTTING AND LAWN CARE The Common Council of the City of Oshkosh does ordain as follows: SECTION 1.That Section 17-33(L) of the Oshkosh Municipal Code pertaining to Outdoor Solid Fuel Furnaces, Stoves and Boilers is hereby created to read as follows: ? Section 17-33PUBLIC NUISANCES AFFECTING HEALTH The following acts, omissions , places, conditions and things are hereby specifically declared to be public health nuisances, but shall not be construed to exclude other health nuisances coming within the definition of Section 17-32: (L) Outdoor Solid Fuel Fired Furnaces, Stoves and Boilers (This prohibition shall be applied retroactively.) Outdoor Solid Fuel Fired Furnaces, Stoves and Boilers shall be defined as an accessory structure or appliance designed (1) for a location ordinarily outside the principal structure and (2) to transfer or provide heat via liquid or other means, by burning wood or other solid fuels, for heating any principal or accessory structure on the premises. SECTION 2.That Section 17-44 of the Oshkosh Municipal Code pertaining to Weed Cutting and Lawn Care is hereby repealed and recreated to read as follows: SECTION 17-44WEED CUTTING AND LAWN CARE MARCH 14, 2006MARCH 28, 2006 06-109 06-126 ORDINANCE FIRST READING SECOND READING CONT’D (A)Owner's Responsibility The owner of every parcel of land within the City shall cut or cause to be cut all grass in excess of eight (8) inches in length, dandelions, and weeds and other like vegetative growth in excess of eight (8) inches in length upon said land. Any owner failing to comply with this provision is subject to penalties provided in section 17-46. (B)Uncut Growth; Public Nuisance; Abatement by City All uncut growth as outlined above is hereby declared to be a public nuisance and fire hazard and may be cut by the City at its option if the owner fails to comply with this ordinance. In addition to any other penalty provided in this Code, the costs thereof, together with an administrative charge applied to the bill, imposed each time the growth is cut, shall be charged against the property as a special tax. SECTION 3. This ordinance shall be in full force and effect from and after its passage and publication. ? Indicates Revision
