VALUE; AUTHORIZE PURCHASE; ACCEPT EASEMENT -
MCCLONE DRIVE ¡INSURANCE WAY ¡ S. WASHBURN STREET

PLAN COMMISSION RECOMMENDATION: Approved
WHEREAS, it is in the best interests of the citizens of the City of Oshkosh to
acquire land for construction of a sanitary sewer lift station west of S. Washburn Street at
the intersection of McClone Drive and Insurance Way; and
WHEREAS, the property to be acquired is at the northwest corner of Lot 2 of CSM
No. 5370, as recorded in the Register of Deeds Office, 13th Ward, City of Oshkosh,
Winnebago County, Wisconsin, as noted on the attached map; and
WHEREAS, the property and interest to be acquired includes land and buildings, if
any, exclusive of equipment and fixtures both movable and immovable.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the Common Council certifies that in order for said purpose to be
accomplished, it is necessary for the City to acquire property as noted on the attached
map. It is further determined by the Common Council that acquisition of said property is
hereby determined necessary pursuant to the provisions of Section 32.05, 32.06 and 32.07
of the Wisconsin Statutes.
BE IT FURTHER RESOLVED that the fair market value for said land is based on
the property owner granting an easement to the City from the current location of the
sanitary sewer lift station on S. Washburn Street and McClone Drive to the new parcel at
the intersection of McClone Drive and Insurance Way, the City paying for all future costs
related to the relocation of lines and construction of the future sanitary sewer lift station at
the northwest corner of Lot 2, CSM No. 5370, and the property owner making a
$23,000.00 payment to the City.
BE IT FURTHER RESOLVED that the proper City officials are authorized and
directed to acquire said property and execute all documents necessary to consummate
this transaction. Money for this purpose is hereby appropriated from Accl. 551-1910-1702-
00000 Wastewater - Land.
BE IT FURTHER RESOLVED that the City hereby accepts an easement along
McClone Drive, between S. Washburn Street and Insurance Way, and the proper City
officials are hereby authorized and directed to execute any and all documents necessary
for purposes of same.
