HomeMy WebLinkAbout06-106.doc MARCH 14, 2006 06-106 ORDINANCE FIRST READING (CARRIED_______ LOST_______ LAID OVER_______ WITHDRAWN_______) PURPOSE:AMEND BUILDING & HVAC CODE PROVISIONS INITIATED BY:INSPECTIONS DIVISION A GENERAL ORDINANCE OF THE CITY OF OSHKOSH CREATING SECTION 7- 31(D), 7-32(C) AND 7-46(C) AND REPEALING AND RECREATING SECTION 7- 34(B)(2)(d) OF THE CITY OF OSHKOSH MUNICIPAL CODE PERTAINING TO BUILDING AND HVAC CODE PROVISIONS The Common Council of the City of Oshkosh does ordain as follows: SECTION 1.That Section 7-31(D) of the Oshkosh Municipal Code pertaining to provision of access to the inspector is hereby created to read as follows: SECTION 7-31REQUIRED BUILDING INSPECTIONS (D) When the building or structure is ready for inspection, the contractor, owner or agent shall make such arrangements as necessary to enable the inspector to inspect all parts of the building or structure. SECTION 2.That Section 7-34(B)(2)(d) of the Oshkosh Municipal Code pertaining to door height exceptions for spaces with substandard ceiling height is hereby repealed and recreated to read as follows: SECTION 7-34 STATE BUILDING CODE ADOPTED (B)(2)(d) COMM 21.03(7) shall not apply to alterations/remodeling where the rough opening of non-conforming doors existing prior to June 1, 1980 are not being altered/affected by such alterations/remodeling or where existing ceiling heights do not permit the installation of minimum height doors. (Specifies minimum door sizes.) It is the intent of this section to require doors being reframed or relocated to comply with the present day code. SECTION 3.That Section 7-46(C) of the Oshkosh Municipal Code pertaining to provision of access to the inspector is hereby repealed and recreated to read as follows: MARCH 14, 2006 06-106 ORDINANCE FIRST READING CONT’D SECTION 7-46HEATING INSPECTION (C) When the HVAC system is ready for inspection, the contractor, owner or agent shall make such arrangements as necessary to enable the inspector to inspect all parts of the HVAC system. SECTION 4.That Section 7-32(C) of the Oshkosh Municipal Code pertaining to the approval and issuance of temporary certificates of occupancy is hereby created to read as follows: SECTION 7-32CERTIFICATE OF OCCUPANCY TO BE ISSUED (C) A Temporary Certificate of Occupancy may be approved and issued when the Division of Inspection Services has determined a structure is reasonably safe to occupy. A Temporary Certificate of Occupancy is subject to the following requirements: (1) The owner or agent shall file an application requesting Temporary Occupancy Approval, pay the required Temporary Occupancy Permit Fees and secure the necessary inspection approvals. (2) Temporary Certificate of Occupancy Fees shall be $50 per month or fraction thereof with a minimum fee of $100. (3) A Temporary Certificate of Occupancy shall not extend beyond the expiration date of the Approved Building Plans or the expiration date of the Building Permit in the absence of approved plans, without approval by the Director of Community Development. SECTION 5. This ordinance shall be in full force and effect from and after its passage and publication.
