HomeMy WebLinkAbout06-108.docMARCH 14, 2005 06 -108 ORDINANCE FIRST READING (CARRIED LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE FEE INCREASES / INSPECTION DIVISION INITIATED BY: INSPECTION DIVISION A GENERAL ORDINANCE OF THE CITY OF OSHKOSH REPEALING AND RECREATING SECTIONS 7- 17(A), 7 -44, 11 -24, 11- 39(A), 11 -27, 11 -30, 11- 31(D), 20 -8(A), 16 -41 AND CREATING SECTIONS 7 -47, 11- 28(B), AND 16 -24(B) ALL PERTAINING TO FEE INCREASES FOR THE INSPECTIONS DIVISION The Common Council of the City of Oshkosh does ordain as follows: SECTION 1. That Section 7 -17(A) of the Oshkosh Municipal Code pertaining to Permit Fees for New Buildings, Additions, Alterations and Signs is hereby repealed and recreated to read as follows: SECTION 7 -17 OWNER TO PAY PERMIT FEES BEFORE RECEIVING BUILDING PERMIT Before receiving a Building Permit, the owner or agent, shall pay the following fees: (A) For new buildings, additions, alterations and signs. Fee Valuation $25.00 $0 to $1,000.00 $32.00 $1,000.01 to $2,000.00 $39.00 $2,000.01 to $3,000.00 $46.00 $3,000.01 to $4,000.00 $53.00 $4,000.01 to $5,000.00 $60.00 $5,000.01 to $6,000.00 $67.00 $6,000.01 to $7,000.00 $74.00 $7,000.01 to $8,000.00 $81.00 $8,000.01 to $9,000.00 $88.00 $9,000.01 to $10,000.00 MARCH 14, 2005 06 -108 ORDINANCE FIRST READING CONT'D Over $10,000.00 valuation, the fee shall be Eighty -eight Dollars ($88.00) plus $6.00 for each additional thousand dollar valuation or part thereof up to $20,000 plus $3.00 for each additional thousand dollar valuation or part thereof over $20.000. In addition to the above, a state mandated fee for the Uniform Dwelling Code Seal, plus $5.00 shall be collected when the Wisconsin Uniform Building Permit is required. SECTION 2. That Section 7 -44 of the Oshkosh Municipal Code pertaining to Permit Fees for HVAC is hereby repealed and recreated to read as follows: SECTION 7 -44 APPLICATION FOR PERMIT; FEES Application for such permit shall be made in writing by the owner or his authorized agent upon blanks furnished by the Heating Inspector. The fee for such permits shall be in accordance with the following schedule: Valuation Fees $0 to $1,000.00 $25.00 $1,000.01 to $10,000.00 $20.00 first $1000 plus $1.50 per $100 valuation or part thereof; $10 to $25 $155.00 per first $10,000 plus $1.00 per $100 valuation or part thereof; Over $25,000.00 $305.00 plus $.50 per $100 valuation or part thereof; In the event activity begins or the Heating Inspector finds such activity completed before a permit is issued and the appropriate fees are paid, the permit fees specified herein shall be One Hundred Dollars ($100.00) plus the permit fee amount or double the permit fee, whichever is greater and notification from the Inspector; however, the payment of such fees shall not relieve any person from fully complying with all of the regulations of this Chapter, nor from any other penalties prescribed in this Code. The re- inspection fee is One Hundred Dollars ($100.00) per re- inspection. SECTION 3. That Section 7 -47 of the Oshkosh Municipal Code pertaining to Lapse of HVAC Permit upon Failure to Commence Work is hereby created to read as follows: SECTION 7 -47 LAPSE OF HVAC PERMIT UPON FAILURE TO COMMENCE WORK Except as may otherwise be provided: MARCH 14, 2005 06 -108 ORDINANCE FIRST READING CONT'D A HVAC permit shall have lapsed and be void unless building operations are commenced within six (6) months from the date thereof. A HVAC permit for residential and non - residential structures shall lapse and be void from and after twelve (12) months from the date of issuance. SECTION 4. That Section 11 -24 of the Oshkosh Municipal Code pertaining to the Application for Certificates and Fees for Electrician's certificates is hereby repealed and recreated to read as follows: SECTION 11 -24 APPLICATION FOR CERTIFICATES AND FEES. All applications for Class 2 Maintenance Electrician's Certificates shall be made to the Electrical Inspector on forms furnished for such purpose and shall thereafter be referred to the Board. Each applicant shall pay a Twenty -Five Dollar ($25.00) Application Review Fee when submitting an application. Such applications shall be subject to review and approval or disapproval by the Board, and before any applicant is permitted to take the examination, the applicant shall pay a fee of Twenty -Five Dollars ($25.00) for each examination. Upon successful completion of the examination, the applicant shall pay One Hundred Dollars ($100.00) for the initial 3 -year certificate. SECTION 5. That Section 11 -39(A) of the Oshkosh Municipal Code pertaining to Permit Fees for Electrical Work is hereby repealed and recreated to read as follows: SECTION 11 -39 PERMIT FEES. (A) Payment of Fees Upon the issuance of a permit by the Electrical Inspector and before such permit shall be in effect, the applicant shall pay to the Electrical Inspector of the City a fee or fees as required in this Section. VALUATION FEE $0 to $500.00 .............................. ............................... $25.00 $500.01 to $1000.00 valuations . ............................ $25.00+ plus $7.00 for each additional hundred dollar valuation or part thereof. $1000.01 - $10,000.00 valuations . ........................ $60.00+ plus $17.00 for each additional thousand dollar valuation or part thereof. Over $10,000.00 valuations . .............................. $213.00+ plus $6.00 for each additional thousand dollar valuation or part thereof up to $20,000, plus $3.00 for each additional thousand dollar valuation over $20,000.00. Minimum fee for any permit ..... ............................... $25.00 MARCH 14, 2005 06 -108 ORDINANCE FIRST READING CONT'D SECTION 6. That Section 11 -27 of the Oshkosh Municipal Code pertaining to the Application for Type C Electrical Contractors' Licenses is hereby repealed and recreated to read as follows: SECTION 11 -27 APPLICATION FOR TYPE C AND LVC ELECTRICAL CONTRACTOR'S LICENSE. All applications for Type C Electrical Contractors' License shall be made to the Electrical Inspector on forms furnished for such purpose. (A) Applicants for a Type C (electrical contractor's) license and renewals thereof shall submit an affidavit to the effect that a person holding a Class 1 (master electricians') certificate or a State of Wisconsin certificate, will be a bona fide full time employee and that such certificate holder (master electrician or State of Wisconsin Master Certificate) will have complete and unquestionable authority and supervision over all matters regulated by this Chapter. Such applications shall be reviewed by the Division of Inspection Services for approval or disapproval. In cases of approvals the Division shall issue Type C (electrical contractors') licenses permitting such business concerns to install, alter, repair, remove, renew, replace, disturb, connect, disconnect, or maintain any electrical equipment in the City and accept payment therefor. In the cases of disapproval the Division shall forward correspondence indicating such. (B) Insurance. Each contractor must file a copy of insurance in force. Copy shall be provided when applying for or renewing a contractor license. Each contractor shall maintain public liability insurance, including products - completed operations, with bodily injury and property damage limits of at least $1,000,000 per occurrence and $1,000,000 aggregate. Each contractor shall also provide evidence of compliance with the worker's compensation requirements and unemployment compensation requirements. All insurers shall send a copy of any notification of termination to the Inspection Services Division. Such notice of cancellation or reduction of insurance shall automatically suspend the contractor's license and no further permits shall be issued until a new insurance certificate has been filed with the Division. (C) Fee. Before such license is granted to an applicant, the applicant shall pay a fee of One Hundred Dollars ($100.00) for an original license and thereafter a renewal fee of Seventy -Five Dollars ($75.00). SECTION 7. That Section 11 -28(B) of the Oshkosh Municipal Code pertaining to the Application for Type M Electrical Maintenance Licenses is hereby created to read as follows: MARCH 14, 2005 06 -108 ORDINANCE FIRST READING CONT'D SECTION 11 -28 APPLICATION FOR TYPE M ELECTRICAL MAINTENANCE LICENSE. (B) Fees Before any such license is granted to an applicant, the applicant shall pay One Hundred Dollars ($100.00) for an original license and thereafter a renewal fee of Seventy -Five Dollars ($75.00) per annum. SECTION 8. That Section 11 -30 of the Oshkosh Municipal Code pertaining to the Application for Type S Electrical Licenses is hereby repealed and recreated to read as follows: SECTION 11 -30 APPLICATION FOR TYPE S LICENSE. (A) When Required Type S license shall be mandatory for any person, firm or corporation desiring to engage, or who is at present engaged, in the business of manufacturing, fabricating, assembling, repairing, maintaining, remodeling, wiring, rewiring or installing electrically operated or illuminated signs, and decorative or utility gas tube lighting, commonly referred to as neon. (B) Insurance. Each contractor must file a copy of insurance in force. Copy shall be provided when applying for the contractor license. Each contractor shall maintain public liability insurance, including products - completed operations, with bodily injury and property damage limits of at least $1,000,000 per occurrence and $1,000,000 aggregate. Each contractor shall also provide evidence of compliance with the worker's compensation requirements and unemployment compensation requirements. MARCH 14, 2005 06 -108 ORDINANCE FIRST READING CONT'D (D) Restrictions On Class S License A Class S license holder shall be permitted to install outside and inside electric signs and outside or inside decorative or outline lighting but shall not be permitted to connect any sign, decorative, or outline lighting to the supply wires. SECTION 9. That Section 11 -31(D) of the Oshkosh Municipal Code pertaining to Provisions applicable to all Electrical Licenses is hereby repealed and recreated to read as follows SECTION 11 -31 PROVISIONS APPLICABLE TO ALL ELECTRICAL CERTIFICATES. (D) Certificates Valid for Three (3) Years All City of Oshkosh Class 2 certificates, and those City of Oshkosh Class 1 and Class 3 Certificates which were in effect on the effective date of this ordinance (insert date] shall be issued for a period of three (3) years and shall thereafter automatically expire. Such certificates shall be renewed every three (3) years on or before the date of expiration upon written request of the certificate holder, unless due to extenuating circumstances the time limit is extended by the Board. There will be a charge of Seventy -Five Dollars ($75.00) per renewal. (1) All renewals of City of Oshkosh Class 1, 2 and 3 Certificates shall be contingent upon the completion of at least 18 hours of acceptable continuing education within each 3 year certification period. Acceptable continuing education shall be those classes recognized by the State of Wisconsin or the City of Oshkosh Electrical License and Examining Board. Continuing education classes shall only qualify for credit towards the required 18 hours if the class was not a duplication of a previously attended class within the previous 12 months. It shall be the Certificate Holder's responsibility to provide proof of attendance when renewing the Certificate. (2) A person who holds a City of Oshkosh Class 1, 2 or 3 Certificate may apply to the Electrical Licensing and Examining Board for a waiver of the continuing education requirements on the grounds of prolonged illness or disability or similar circumstances. Each application for waiver shall be considered individually on its own merits. (3) Any person whose request to renew their City of Oshkosh Class 1 or 3 Certificate is denied because of a failure to fulfill the continuing education requirements shall be required to secure the Master or Journeyman Certification through the processes provided by the State of Wisconsin or may file an appeal to the Electrical License and Examining Board. MARCH 14, 2005 06 -108 ORDINANCE FIRST READING CONT'D (4) Any person whose request to renew their City of Oshkosh Class 2 Certificate is denied because of a failure to fulfill the continuing education requirements shall be required to take and pass the City of Oshkosh Class 2 examination in order to reacquire the Class 2 Certificate or may file an appeal to the Electrical License and Examining Board. (5) A person may renew his or her City of Oshkosh Certificate no later than one term after the expiration of the certification upon filing the renewal application, submittal of a Twenty -Five Dollar ($25.00) processing fee (in addition to the Certificate renewal fee) and submittal of the necessary documentation showing compliance with the continuing education requirements described in 11- 31(D)(1). Said continuing education shall be obtained within the 3 year period preceding the renewal application. SECTION 10. That Section 20 -8(A) of the Oshkosh Municipal Code pertaining to Plumbing Permits, Plan Examinations and Approval is hereby repealed and recreated to read as follows: SECTION 20 -8 PLUMBING PERMITS, PLAN EXAMINATIONS AND APPROVAL (A) Permits No person shall perform or permit the performance of any plumbing work, as defined by state statute or regulation adopted by reference as a part of this Code, unless a permit therefor shall first have been obtained as hereinafter provided. Minor repairs as defined in Sec. 145.06(4)(d), Wis. Stats., as may be amended from time to time, shall be exempt from the permit requirement. (1) Application The applicant for a plumbing permit shall make application to the plumbing inspector on forms furnished by the City. (2) Issuance of Permit No permit will be issued until plan examination and approval requirements have been met. Upon examination and approval of such application by the plumbing inspector and upon payment to the city treasurer of the required permit fees listed in Subsection (3) of this Section, the inspector shall issue a permit therefore. Such permit may be issued only to persons duly licensed to do plumbing work under the laws of Wisconsin and under the provisions of this chapter, and such other persons who are entitled to a permit under the laws of the State of Wisconsin. MARCH 14, 2005 FIRST READING ORDINANCE CONT'D No plumbing permit shall be issued authorizing a connection with the city water and sewer systems if the land to be benefited by such connection had not been specifically assessed for the water or sewer main extension in the street abutting said property unless the owner thereof pays a connection fee to the city in an amount equal to the amount which the property would have been assessed at the time of said water or sewer main construction, based on the formula used at the time for the computation of the special assessment for said water or sewer main installation. (3) Schedule of Fees The schedule of fees to be paid shall be as follows: $50.00 for sanitary or storm sewer connections at main in street or curb. $50.00 for sanitary or storm sewers re -laid from main or curb to building or main to curb. $50.00 for water service connections at main in street or curb. $50.00 for water service re -laid from main or curb or building or main to curb. $50.00 for water service and sewer repair. $25.00 minimum fee for inspection of any plumbing or drainage work requiring a permit. $7.00 for each fixture whether a new installation or a replacement and all plugged openings for future fixture connections. Such schedule shall apply to the following list of fixtures: all trapped fixtures, all styles and descriptions of sinks, water closets, bathtubs, shower baths, wash basins, bubblers, drinking fountains, garbage disposals, laundromats, laundry tubs, dishwashers, floor drains, water softeners, water treatment devices, urinals, water heaters, water storage tanks (potable), catch basins, interceptors or pretreatment tanks for sanitary waste, sump pumps, ejectors, roof leaders, local waste pipes for bar and soda fountains, and fire protection services when no plumbing fixtures are installed, or any items not specifically listed that are directly connected to the storm or sanitary drain, waste and vent system or potable water distribution system and covered under Chapters COMM 82 through 84 inclusive, Wisconsin Administrative Code. (4) Double Fees In the event activity begins or the Plumbing Inspector finds such activity completed before a permit is issued and the appropriate fees are paid, the MARCH 14, 2005 06 -108 ORDINANCE FIRST READING CONT'D permit fees specified herein shall be a fee of One Hundred Dollars ($100.00) plus the permit fee amount or double the permit fee, whichever is greater and shall be paid by the owner or agent immediately upon notification from the inspector; however, the payment of such fees shall not relieve any person from fully complying with all of the regulations of this Chapter, nor from any other penalties prescribed in this Code. (5) Re- inspection Fees. When additional inspections are made due to code violations or other valid reasons, an additional fee of One Hundred Dollars ($100.00) shall be charged for each unnecessary inspection. Such fees shall be paid in accordance with section 20 -9. (6) LAPSE OF PLUMBING PERMIT UPON FAILURE TO COMMENCE WORK Except as may otherwise be provided: A plumbing permit shall have lapsed and be void unless building operations are commenced within six (6) months from the date thereof. A plumbing permit for residential and non - residential structures shall lapse and be void from and after twelve (12) months from the date of issuance. SECTION 11. That Section 16 -41 of the Oshkosh Municipal Code pertaining to Rooming House Operating Licenses is hereby repealed and recreated to read as follows: SECTION 16 -41 ROOMING HOUSE OPERATING LICENSE - TERM; FEE; FORMS; INSPECTIONS. (A) Every operating license shall be issued for a period of one (1) year from the date of issuance unless sooner revoked, including any renewals thereof. (1) No operating license shall be issued or renewed unless the applicant owner has first made application therefor on an application form provided by the Housing Inspector, accompanied by payment of a license fee of One Hundred Dollars ($100.00) plus Fifteen Dollars ($15.00) per bedroom per license. The Housing Inspector shall develop such forms and make them available to the public. MARCH 14, 2005 06 -108 ORDINANCE FIRST READING CONT'D (2) No operating license shall be issued or renewed unless the applicant owner agrees in his application to such inspection as the Housing Inspector may require to determine whether the rooming house in connection with which such license is sought is in compliance with the provisions of this Article. (3) Any property failing to secure or renew the required Rooming House License prior to operating such or prior to expiration of said license shall pay double the license fee. (4) Upon re- inspection of a violation, if the inspector finds that the violations have not been corrected, the owner, contractor or agent responsible for the violations shall pay a re- inspection fee. SECTION 12. That Section 16 -24(B) of the Oshkosh Municipal Code pertaining to Re- inspection fees for Failure to Correct Noted Violations is hereby created to read as follows: SECTION 16 -24 NOTICES - CONTENTS; SERVICE; TIME FOR REMEDIAL ACTION BY OWNER. (C) Upon re- inspection of a violation, if the inspector finds that the violations have not been corrected, the owner, contractor or agent responsible for the violations shall pay a re- inspection fee. SECTION 13. This ordinance shall be in full force and effect from and after its passage and publication.
