plans. This summary review would outline what (if any) building alterations must be implemented for
code compliance. I did point out to him there are some significant code issues as far as the type of
heating equipment and the location of such equipment that would need to be addressed. Additionally, I
pointed out he would want to focus on exiting requirements and present day handicap accessibility
standards vs. those that existed when the building was first constructed.
From a Zoning Code perspective, plans will need to be submitted showing where your tenant plans to
provide customer and employee parking, a dumpster enclosure as well as whether disabled/towed
vehicles will be stored on site. If towed vehicles are to be stored on site, there are fenced enclosure
requirements to be met. There also may be other issues to address. I would advise you to discuss
Zoning Ordinance related matters with Matt Tucker, City Planner (236-5059.)
It is my understanding your new tenant, Expert Transmission and Towing Service, has been occupying
this building since May 2003. Be advised, use of this building for automotive repair and towing without
the necessary approvals and Occupancy Pennit is a violation of City of Oshkosh Municipal Code. If you
have not already commenced activities to bring this building into compliance, you are encouraged to
start inunediately. Since no approvals can be given by this office without first having received written
approval from Chamco, you are advised to start with Chamco. If)-ou are not successful in obtaining
Chamco approval, you will need to cease use of this building for anything other than previously
approved office/warehousing use until approval of an alternate use is secured ftom both Chamco and the
City of Oshkosh.
I will review this file again toward the end of this month. If Chamco has denied an application to allow
.this use, 'you will be expected to discontinue this use inunediately. Any schedule proposed for.,
compliance to comply with the use issue will be reviewed jointly with Chamco. Enclosed with this
correspondence is a Correction Notice citing several code violations. Please note these violations do not
address specific building requirements, rather they address Occupancy and Use Approval code sections.

Dear Mr. Gabert;
I have reviewed the comment card you recently submitted. You indicated you did not understand why
an engineer had to submit information showing why your new tenant at this building would be
acceptable. I presume you are inquiring why a code review needs to be done on this building prior to
allowing a new business commence operations in this building. I will attempt to provide further
clarification on this topic.
Prior to investigating Building Code and Zoning Ordinance issues, you are advised to secure
written approval for this use and tenant from Chamco. This building is located in the Southwest
Industrial Park, which is subject to strict covenants. It is has been brought to my attention that . -
automotive repair and towing is a use that is not allowed per these covenants. Without written approval
from Doug Pearson, Chamco Executive Director, this office cannot issue a Building Permit or approve
occupancy for this new use. For this reason, you are encouraged to resolve this issue prior to addressing
Building and Zoning Code issues. If you are not able to secure Chamco approval, it would not appear to
be beneficial for you to spend time and money to determine what alterations/improvements may be
needed to secure Building and Zoning Code approvals for a use that is not allowed.
The building at 2750 Universal St., was initially reviewed and approved as an office/warehouse. This is
a non-hazardous type of use. I believe the initial tenant was an insulation contractor who used the
building for an office and storage of product. Subsequently, the next tenant was another contractor for
pre-engineered metal buildings. This tenant used the building in the same fashion as the previous tenant,
so there was no discemable change of use that would prompt a code review.
At present you have a tenant that wishes to use this building for automotive repair (transmission repair
being its specialty) and as a home base for a fleet of Tow Trucks. The change of use from an
office/warehouse to an office/automotive repair shop is a significant change of use from both a Building
Code and Zoning Code perspective. The State of Wisconsin Building Code states that when a change of
use as defined in the building code is proposed, plans must be submitted for review and approval to
show compliance with present day building code standards. Because your building is in excess of
50,000 cubic feet, these plans must be prepared and submitted by a Wisconsin Registered Engineer or
Architect. Upon review, any changes required to comply with the present day code must be noted on the
plans and must be applied to the building prior to allowing occupancy by the new tenant/use.
In this case, James Larson, Architect, called me about this issue and advised him that ifhis review did
not reveal a significant number or type of changes, he .could submit a review summary instead of formal

Expert Transmission & Towing LlC ofOmro, has provided both retail and wholesale
services to the greater Fox Va)ley since its establishment in 1983. In recent years, we
recognized the need to segregate our wholesale and retail operations. We were looking
for a larger building near a major highway. This building would house our
wholesale/commercial sales. Retail sales will continue to operate from our current 3000
square foot Omro facility. Several area buildings were researched over a period of two
years yielding few positive potentials~ In March of 2003, the 6000 square foot building
located at 2750 Universal Drive in Oshkosh's southwest industrial park was made
available for lease. After a showing af the property, we agreed that the building offered
the best merger of size, function, and cost of all the previously researched locations.

On the premises located at 2750 Universal Drive, we would hope ta operate our
wholesale/commercial division of Expert Transmission. Core transmissions would be
received via freight company or tocal pick-up, disassembled, high pressure blasted,
rebuilt to factory specifications, powder coated, and return shipped or delivered. This
facility would warehouse our large parts inventory as well as pre-built transmissions for
exchange. For some local companies, removal of the transmissions from fleet/sales
vehicles would not be possible at their location. We would offer vehicle pick-up,
transmission replacement, maintenance, and delivery for commercial clients. Our Omro
location would continue to provide wholesale/commercial fleet transport and recovery.
Also, we would like to perform fleet maintenance on our nine truck fleet. Our current
faci.lity in Omro is not large enough for a fleet maintenance area indoors. No more than
three trucks would be located at 2750 Universal Drive at any time. Trucks are on a two
week maintenance schedule. .
At the current location at 3489 Bradley Rd. in Omro, we will continue to provide
transmission maintenance and servicing to all our retail customers. Our dispatching and
storage facility for our Wisconsin DOT licensed towing, transport, and recovery service
will remain at the Omro loéation.
We are not a general automotive repair garage. We are not a salvage or automotive
recycling yard, nor do we possess a license for such a business. We are not an auto
sales lot, nor do we po5$ess a license for such a business. No junk or unregistered
vehicles would be allowed on the premises at 2750 Universal Drive. Absolutely nothing
would be kept outside of the building except for company, employee, or sublet vehicles.

Dear Chad:
This letter is to confirm, in writing, the determination of Chamco relative to your occupancy in a facility owned by
Richard Gabert at 2750 Universal Street in our Southwest Industrial Park.
As we explained to Mr. Gabert, any business/tenant in any of our industrial parks is subject to review by Chamco as to
permitted use per recorded covenants prior to their telocation. Compliance with City of Oshkosh and State of
Wisconsin Zoning and Building Code are separate issues and need to be addressed and adhered to as well, particularly
on behalf of the owner of the facility in question.
We realize communication broke down between the parties involved. It was certainly not our intent to subject you to
untimely delays and interference in running your business. Part ofCharnco's role as the exclusive marketing agent for
the City of Oshkosh's Industrial Parks is to oversee and enforce the legal covenants.
Thanks to the excellent and detailed description of the operation you plan to run out of this location, Chamco has
approved your business as a permitted use. We realize you altered and adjusted your operational plans in order to
comply with the accepted described usës. Please accept our thanks for your understanding and immediate compliance
and cooperation once the issue was brought to your attention and we began working together.
To further clarify, it is our understanding that you have no immediate plans for or needs for outdoor storage, however,
are aware of the "fully screened" requirement should things change. This includes dumpsters as welL
In hopes of avoiding additional delays, as you know, I immediately relayed verbally our approval of acceptance to you
and Allyn Dannhoff, Chief Building Inspector for the City of Oshkosh once this decision was made. I hope this action
was of some assistance.
I am sure your expansion to Oshkosh was intended to be an exciting business opportunity. We realize the additional
problems you encountered' were not expected nor planned for. Thank you for working with us in the best interest of alL

understand, there was an inspection made by yourself and you requested having an Architect's letter stating any
code conformance issues. The facility has changed occupants since the original submittal. The new
