Washburn Street Dear Mr. Patek: The following is Contract Amendment No.1 for additional engineering services related to the design ofthe Washburn Street project. The contract made and entered into by and between the City of Oshkosh and Gremmer & Associates, Inc. dated July 13, 2005, is hereby amended as set forth on the following pages. ADDITIONAL SCOPE OF WORK Real Estate Appraisal, Acquisition, and Relocation Assistance Services. This work will be subconsulted out to GJ. Miesbauer & Associates, Inc. The detailed scope of services is attached to this amendment. COMPENSATION Gremmer & Associates, Inc. revised "not-to-exceed" fee for the proposed project, based on the Scope of Work and Assumptions is $120,208.50, including reimbursables. ASSOCIATES FOND DU LAC, WI Re: Proposal for Appraisal, Acquisition and Relocation Assistance Services Project 10: 050705 North Washburn Street City of Oshkosh Dear Mr. Lanser: Thank you for the, opportunity to submit a proposal to provide the real estate appraisal, acquisition and relocation assistance services in conjunction with the Washburn Street project. This proposal includes fees for the preparation of an Acquisition Stage / Relocation Plan, appraisal services, acquisition services and relocation assistance services. All services will be in conformance with Wisconsin Statutes of Eminent Domain, specifically 5s32.05, 32.09, 32.19 and 32.195 and all appropriate regulations and policies. All work will be performed in accordance with generally accepted standards of the profession and requirements contained in the current WisDOT Real Estate Program Manual, Real Estate Relocation Assistance Manual and Wisconsin Administrative Code (Comm 202). All acquisitions will meet appropriate State and Federal laws, policies and guidelines. I have visited the project site and reviewed the information provided by you and Dave Patek. The project consists of six acquisition parcels; three are vacant land, two are car dealerships that need relocation assistance services and one parcel is a commercially improved lot with a vacant building; The project also involves acquisition of five utility parcels. My firm has the capability and expertise necessary to deal with all activities nec~ssary for the satisfactory completion of this project in the scheduled time period. I propose to subcontract the appraisal work to John Rolling of Rolling & Co. of Madison. Dr. Rolling is a Certified General Appraiser and has extensive experience completing eminent domain based appraisals. He has the professional training and experience to provide in-depth and unbiased appraisal reports and is a WisDOT approved appraiser. The appraisals will be narrative format and meet standards of professional practice of The Appraisal Institute, Wisconsin Department of Regulation and Licensing and WisDOT appraisal guidelines. My firm will perform an objective review of each appraisal prior to submitting them to the City for subjective review and approval of the offering prices. My firm will conduct negotiations and provide relocation assistance services for all parcels. Peter Miesbauer has exceptional customer service skills and is able to establish excellent rapport with property owners. Peter has successfully prepared an Acquisition Stage Relocation Plan and provided relocation services for 14 parcels in the City of Neenah. He has also completed the Acquisition Stage Relocation Plan for USH 151 from IH 90 to Sun Prairie for WisDOT. He is amember of IRWA and has attended several Real Estate and Relocation Courses. Most recently, he completed the Relocation Plan Development workshop and Introduction to Relocation Assistance seminar as well as Advanced Relocation from FHWNNHI. I will assume the role of project manager as well as negotiator. I have over 40 years of right of way experience, initially with WisDOT as Director of Real Estate, as project manager in the private sector and most recently as owner of my own firm, I am skilled as an acquisition specialist and appraiser and have extensive experience in all aspects of acquisition services and project management. ' My firm will prepare necessary~ocuments needed for all aspects of the acquisition " process and relocation assistance process. These include, but are not timited to the Introductory Letter with the brochure, "Rights of a Landowners Under Wisconsin Eminent Domain Law", the Offering Price letter, Purchase Agreement, IRS W-9 form, Closing Statement, Warranty Deed, Disposition of Taxes, Administrative Settlement Report, Jurisdictional Offer, Notice of Lis Pendens and Award of Damages, if necessary. We will conduct closings for each parcel and submit conveyances to the City for recording with the Winnebago County Register of Deeds. Relocation assistance documents include the 90-day Assurance of Occupancy form, Relocation Eligibility letter, Determination of Supplemental Payment form for business and the Business Comparison Chart, Relocation Payment Summary form, Relocation Claim form and Decent Safe and Sanitary Inspection (DSS) form. In addition, property owners will be assisted with moving estimates and claims. Title updates will be provided by Highway Title Services of Green Bay. I understand you have already obtained original title reports and a recent update from the title company. Additional updates may be needed during the acquisition process. I recommended to Dave Patek that the City consider the option of obtaining title insurance on these parcels because of their high value. The minimum title insurance policy is for $10,000 at a fee of $200 per parcel. This base policy would be upgraded to the value of the land acquired at the time of purchase at an additional cost. The title company will provide us with a fee estimate for this service if the City wishes to consider this option. The negotiator and relocation specialist will keep detailed diaries for each parcel and displacee. A progress report for the previous month's activities will be prepared and submitted to the City monthly. This report will include a summary of activities for the '- , . month and a project log indicating the status of each parcel and any problems encountered. G.J. We will be available to begin work on this project as soon as the Notice to Proceed is received and have all properties acquired and all businesses relocated in a timely fashion.
