PURPOSE:
APPROVE AMENDMENT NO. 5/ AGREEMENT FOR ENGINEERING
SERVICES / WATER FILTRATION PLANT
INITIATED BY:
PUBLIC WORKS DEPARTMENT
BE IT RESOLVED by the Common Council of the City of Oshkosh that the attached
Amendment No.5 to Agreement for Engineering Consulting Services for Design and
Construction Engineering Services for Intake, Transmission Main and Plant Modification
Improvements for the Water Filtration Plan with MWH Americas, Inc. is hereby approved
and the proper City officials are hereby authorized to execute and deliver the agreement
in substantially the same form as attached hereto, any changes in the execution copy
being deemed approved by their respective signatures, and said City officials are
authorized and directed to take those steps necessary to implement the terms and
conditions of the Agreement.
BE IT FURTHER RESOLVED that money for this purpose is hereby appropriated
from:

INTAKE, TRANSMISSION MAIN AND PLANT MODIFICATION ll~PROVEMENTS
1.
PURPOSE
The purpose of this Amendment No.5 is to:

extend the overall tennination date for the Agreement, as previously amended, in order to
provide engineering services during construction beyond the original construction
completion date for City Contract 02-01.
.
provide compensation above the currently authorized not-to-exceed limit for project
close-out services.
2.
TIME SCHEDULE
Under Article 4, TIME SCHEDULE of the Agreement, change "61" to "73".
3.
TERM OF AGREEMENT
Under Article 5, TERM OF AGREEMENT, change "July 1,2005" to "July 1, 2006".
4.
SCOPE OF SERVICES
The scope for engineering services during construction related to City Contract 02-01, Raw Water
Intake and Transmission Main shall remain unchanged.
5.
SCHEDULE
Activities under this Amendment are authorized through July 1, 2006.
6.
DELIVERABLES
The de1iverables to be furnished by MWH shall be as required by the existing Agreement and
subsequent amendments.
7.
COMPENSATION
Payment to MWH for services authorized under this Amendment shall be on a cost plus fee basis,
with an estimated not-to-exceed ceiling of $7,000.
