The submittal described above has been reviewed for equivalency to applicable Wisconsin
Administrative Codes and compliance with Wisconsin Statutes. The submittal has bcen
CONDITIONALLY APPROVED. The owner, as defined in section 101.01(10), Wisconsin
Statutes. is responsible for compliance with all conditions of this petition approval and other
applicable code requirements. Plan submittal and approval to the department or its agent may be
necessary prior to construction undertaken per this petition.

The code section petitioned requires that bedrooms and basements in unsprinklered buildings
be provided with elI?-ergency escape openings to the exterior.
The variance requested is to omit the emergency escape opcnings.
The intent of the code section petitioned is to provide a secondary means of escaping in case of
a fire; especially where occupants may be sleeping and their egress may therefore be delayed.
The petitioner submitted the SB-9890 application form including 3 additional pages of
supporting documents and/or plans.
Reviewer's C~nunents:
1) The building is a 2 story plus basement structurc in downtown Oshkosh. The building is
approximately 19 feet wide by 162 feet long. The north and south (long) walls are -party walls
with no openings. The east and west (short) walls have window openings, and face alley at
the west and street at the east.

2) The main level is used for business purposes. The upper level, currently being used for
business purposes is being converted to group R-3 dwelling use. Two dwelling units a:t:e
planned.
3) The owner wishes to create "pod" type bedrooms, which have the bedrooms surrounded with
a passageway. TIlls passageway loops around the bedrooms, and connects to the living room
and kitchen area.
4) The upper level will have a fire rated conidor running from cast to west. The dwelling units
will have two exits to this corridor, one at the entry, and one serving the passageway at the
bedrooms.
5) Per the submitter, the bu,ilding is on the National Historic Registry and as part of that is in a
City of Oshkosh Historic District. It appears that if the submitter had chose to do so the
building could have been submitted for review under the Camm 70 Historic Building Code.
Further, if the building had been submitted and reviewed underComm 70 it appears the .
building could have been conditionally approved 'with a passing overall safety score without

6) The local firc department recommends approval based on the following conditions; rlat J$a' IA~IN!
a) A second exit door shall be provided at the rear of the apartment to gain access to the
hallway and second stairway.
b) A multi-station alarm system with smoke detection and alarms will be provided on all
floors and basemerit level to allow for timely evacuation of the occupants.
7) The local building inspection department recommends approval based on the following
conditions: .
a) The first Hoor shall be limited to "13" occupancy classification.

, All of the petitioner's statements of fact or intent included on the variance application form, any
other documents submitted to the Department, as well as any other conditions of approval listed
below, shall be carried out. Any recommended conditions of approval by the fire department
and/or municipal building inspection dcpartment listed above shall also be carried out unless
othernrise stated below. This variance is specific to the subject petition and cannot be used for
any additional modifications.
1) The apartments shall be served by a main entry door and a second exit door each. These
doors shall exit to a corridor designed and constructed in accordance with IBe 1004.3.2.
2) The building shall be equipped with a multi-station smoke detection and alarms in
accordance with mc 907.2.10.1.2 on all floors and basement.
3) A man.ual fire alarm system in accordance with NFPA. 72 shall be provided throughout the
Group R-3 occupancy level, and.shall be continuous to the point of exit discharge from this
level.

limited the use of the 1 st floor to a "B" occupancy classification. The proposed used is an "M" occup~cy
classification. The owner has made application to revise the original variance. This approval is subject to
the revised variance being approved, and any conditions of that variance being complied with prior to
occupancy of this space.
. Variance - Transaction ID No 1159788 The building shall be equipped with a multi-station smoke
detection and alarms in accordance with IDe 907.2.10.1.2 on all floors and basement. Verify compliance
with this in all areas being altered.
. ANSI 303.4 Changes in level greater than Yz inch shall be ramped in compliance with Section 405 or 406.
. IBC 1003.2.10 Exit signs are required to be installed per this section
. IBC 1003.2.11 Means of egress illumination is required to be installed per this section. All paths of egress
are required to have adequate emergency lighting to meet the performance requirements of IBC
1003.2.11.3. Existing means of egress emergency lighting is permitted to be maintained in compliance
with the code in effect at the time of construction. Any altered path of egress, or new path of egress,
and any new emergency lighting being installed is required to comply with current code requirements.

· COMM 62.1109 (12) Where counters are provided for sales or distribution of goods or services, at least
one of each type provided shall be accessible.
· 1604.4 Analysis. Any system or method of construction to be used shall be based on a rational analysis in
accordance with well-established principles of mechanics. Such analysis shall result in a system that
provides a complete load path capable of transferring loads from their point of origin to the load-resisting
elements. To date o,!ly partial calculations have been provided showing how the additional load
resulting from the new concrete floor being installed on the existing wood floor framing will be
transferred. Complete plans and calculations are required to be submitted and approved prior to
occupancy.
· IBC 2406.2 Glazing in an individual fixed or operable panel adjacent to a door where the nearest exposed
edge of the glazing is within a 24 inch arc of either vertical edge of the door in a closed position and where
the bottom exposed edge of the glazing is less than 60 inches above the walking surface is requires safety
glazing materials.
· IBC 2902..1 / Table 2902 Drinking water is required to be provided, since no drinking fountain is shown
on plans a bottled water cooler is required to be provided.
· IBC 3408.6 Alterations affecting an area containing a primary function. Where an alteration affects
the accessibility to, or contains an area of primary function, the route to the primary function area shall be
accessible. The accessible route to the primary function area shall include toilet facilities or drinking
fountains serving the area of primary function. - Disproportionality worksheets have been provided to
exempt the entrances from having to be made accessible.
Be Aware that, while the State of Wisconsin Building Code may allow for disproportionality to exclude
some alterations, you should be aware that the Federal requirements require building owners to identify
barriers to accessibility and consider the feasibility of removing the barriers. If it is considered not feasible
at the time to remove the barrier, non-discrimination regulations require an alternate provision of service,
but expect that efforts will be made over time to remove all barriers.
· Comm 61.30(3) This review does not include lighting. Comm 63.0001 Prior to installation, lighting
plans and calculations shall be prepared in compliance with the code. The plans shall be available upon
request.
· Comm 61.30(3) / IMC 507.2 This plan review does not include heating, ventilation, or air
conditioning. HV AC plans are required to be submitted and approved prior to installation ofHV AC
equipment.
· Comm 61.31(4) Revisions to approved plans. All proposed revisions and modifications which involve
rules under this code and which are made to construction documents that have previously been granted
approval by the department or its authorized representative, shall be submitted to the office that granted the
approval. All revisions and modifications to plans shall be approved in writing by the department or its
authorized representative prior to the work involved in the revision or modification being carried out. A
revision or modification to a plan, drawing or specification shall be signed and sealed in accordance with
Comm 61.31(1).
