Main St incorporates a new entrance with a canopy at the east wall of the building. This east wall is a fire division wall that sits on the property line that separates this property ITom the City owned parking lot to the east State of Wisconsin Building Code prohibits openings in a Fire Division wall in this situation because it is on a property line, thus compromising the protective features a fire division wall is intended to provide. This same code also prohibits buildings ITom crossing property lines. Code research has determined that this proposed entrance and canopy can be allowed if an easement is granted authorizing such activity. This easement will need to address two issues: 1. The easement must first allow the owner of 318 N. Main St to construct the proposed entrance canopy on the City owned property. 2. The easement must then provide a permanent No Build Easement for an area surrounding the outside perimeter of the canopy. Per COMM Table 62.602, this easement must extend 30' ITom the south, east and north faces of the canopy. The distance ITom the north face ofthe canopy need only to extend to the City Right of Way ifthis distance is less than 30'. The reason that 30' is needed in all directions is because this is an open, non-fire resistive rated structure. Easements of this nature must then become a recorded document for both parcels ofland as it affects the conditions of development of both parcels.
