I.L.H.R. 51.167 Exiting through areas of hazard. (1) General. Except as provided in
subs. (2) and (3). exit access shall be so arranged that it will not be necessary to
travel through any area of hazard in order to reach the exit.
2, The rule being petitioned cannot be entirely satisfied because:
Owner prefers to put in two-high stacked natural gas dryers for improved performance
and energy efficiency in the hallway leading to the second floor front exit.
3. The following alternative(s) and supporting information are proposed as a means o,f providing an equivalent degree
of health, safety or welfare as addressed by the rule:
There are two exits serving apartments 6,7 and 8, not including the second floor front
exi t. "hich do not reguire passing one stairway to get to the second stairway.
However.
it is necessary to pass by one stairway to get to the second stairway from apartment #5.
The second floo~ front exit would serve only apartment #5.
A heat alarm will be installed in the dryer area for additional protection and proper
ventilation will be provided for operation of the gas dryers.

and/or plans are not received \~ithin two months of the date of this letter,
the plans will be stamped "Not Approved" and returned. Approval is \~ithheld
because of the following code violations.
NOTE General Project History:
1-11-90 Plans approved. Unit 5 had only 1 direction of travel to a
stairway thus the ste"el fire escape rescue platform was a
required exit for this unit.
6-19-90 Plans approved for a revision of the fire escape to better
locate it to the outside of the building. This was approved
"as wood c~nstruction based 9n IL,fjR.57,.0,5(2)(b)1,. ~xit req~lired
and serving à!single unit. '
8-29-90 Call from Mr. Schuler informed me that gas dryers had been
added in the rescue platfonTI "hallway". I informed Mr. Schuler
revised plans \'lOuld be required sho'ding 1 hour isolation of
hazards and a second direction of travel from unit 5.
10-17-90 Plans were submitted for this review.
10-19-90 These plans are withheld pending action of the variance
submittal mentioned in r1r. Schuler's 10-15-90 letter. These
plans may not be approved because: ILHR 57.05(2)(b)1. requires
the wood rescue platform to serve a single unit. The location
of the washers and dryers indicated in your letter very
definitely makes this a public area thus the exit no longer
can be viewed as serving a single unit.

This letter is in regard to your petition for variance of IUm 51.15.',
petition number 1-90-00648, requesting permission to exit thru a laundry room.
I phoned 1'1r. Schuler, 20 Dec. 1990, and advised him that if I were to reca;¡end
conditional approval of the request, it VIould be based on isolating the
laundry area by 1 hour construction. This would not be an easy task.
I suggested that the peti ti on be I'li thdrawn, and if wi thdravm I woul d refund a
portion of the petition fees ($170.00). The refunded fees could then be
applied toward the replac~nent of the gas dryers with electric units.
If the dryers are electric, this petition is not necessary.
Mr. Schuler requested that I hold further processing of the petition until he
could discuss the matter ¡lith the owner. I-Ihat is the status of this petition?

The rule being petitioned requires the following:
ILHR 51.167 (1) Exit access shall be so arrànged thát it will not be
necessary to travel through any arèa of hazard in order to reach the exi t.
The variance requested is to permit an exit access path through a laundry room
equipped with gas dryers.
Considered were your statements as follows:

complying l-hour end osure. The heat detector proposed is not a

8. Exiting through the laundry for the occupants of apartment #5 should not
be a problem. We, for code purposes, consider that there is only one
fire in any building at anyone time. Therefore, if ther.e. is a fire in
the building affecting one of the stairways, apartment #5 occupants could
pass through the laundry room, where ther!, is no fire, to the rescue
platform. If there is a fire in the laundry room, then the residents of
apartment #5 could use eithêrof the stairways as they would not be
involved. This, of course,would hold true only if the laundry room were
l..hour protected.
9. Provided the laundry room is l-hour enclosed, and based on the rational
