Dear Mr. Maiman:
This letter is in response to your written Exemption Determination Request, asking whether a
proposed activity or the proposed location of the activity is exempt from the permit requirements
of Chapter 30, Wis. Stats.
The waterway is the Fox River, located in City of Oshkosh in Winnebago County. Your proposed
activity is the repair of pier structures.
Department staff have reviewed your request, and determined that the activity wiil not require a
permit pursuant to s.30.12(1)(b). The piers are located landward of an existing bulkhead line.
Please note that this determination does not include a determination as to whether your
dockiminium structure of sale/lease of the boat slips is legal. The Department has had previous
correspondence with Lakeside advising them of the question of the validity of dockiminiums due to
recent Wisconsin Supreme Court case law.
In addition, please contact me directly if you are planning on constructing any buildings on the site.
The use of the land between the original ordinary high water mark of the Fox River and the
approved bulkhead line remains under the jurisdiction of the state.
You are responsible for obtaining any permit or approval that may be required for your project by
local zoning ordinances or by the U.S. Army Corps of Engineers before starting your project.
