The submittal described above bas been reviewed for confonmance with applicable Wisconsin Administrative Codes and
Wisconsin Statutes. The submittal has been CONDITIONALLY APPROVED. The owner, as derIDed in Chapter
101.01(10), Wisconsin Statutes, is responsible for compliance with all code requirements

The owner is advised to consult with the Health Services Division to determine the extent of food service
that is allowed in the separately ventilated smoking room.
The owner is reminded that the separately ventilated smoking room must be separated from the adjoining
rooms with walls of solid construction. Any doors in these walls must be of solid construction, self closing,
and gasketed. A building permit shall be obtained prior to installing any walls or doors. The folding
doors shown on the HVACplans would not appear to comply with this requirement.
mc 711.3 Any penetrations of fire rated assemblies are required to be protected with a listed firestopping
system that matches the rating of the wall assembly being penetrated. Copies of the firestopping systems
are required to be provided at the time ofinspection.
IMC 302.1 The building or structure shall not be weakened by the installation of mechanical systems.
Verify that existing structure is capable of supporting the additional weight of the proposed rooftop
equipment.
IMC 304.9 Guards. Guards shall be provided where appliances, equipment, fans or other components that
require service are located within 10 feet (3048 mm) of a roof edge or open side of a walking surface and
such edge or open side is located more than 30 inches (762 mm) above the floor, roof or grade below. The
guard shall extend not less than 30 inches (762 mm) beyond each end of such appliance, equipment, fan or
component and the top of the guard shall be located not less than 42 inches (1067 mm) above the elevated
surface adjacent to the guard. The guard shall be constructed so as to prevent the passage of a 21-inch-
diameter (533 mm) sphere and shall comply with the loading requirements for guards specified in the
International Building Code.

IMC 306.5 Equipment and appliances on roofs or elevated structures. Where equipment and
appliances requiring access are installed on roofs or elevated structures at a height exceeding 16 feet (4877
mm), such access shall be provided by a permanent approved means of access, the extent of which shall be
ITom grade or floor level to the equipment and appliances' level service space. Such access shall not
require climbing over obstructions greater than 30 inches (762 mm) high or walking on roofs having a
slope greater than 4 units vertical in 12 units horizontal (33-percent slope).
IMC 401.5.1 Mechanical and gravity outside air intake openings shall be located a minimum of 10 feet
ITom any hazardous or noxIOus contaminant such as vents, chimneys, plumbing vents, streets, alleys,
parking lots and loading docks.
IECC 803.3.3.3 Off-hour controls. Each zone shall be provided with thermostatic setback controls being
allowed. that are controlled by either an automatic time clock or programmable control system.
Comm 61.31(4) Revisions to approved plans. All proposed revisions and modifications which involve
rules under this code and which are made to construction documents that have previously been granted
approval by the department or its authorized representative, shall be submitted to the office that granted the
approval. All revisions and modifications to plans shall be approved in writing by the department or its
authorized representative prior to the work involved in the revision or modification being carried out. A
revision or modification to a plan, drawing or specification shall be signed and sealed in accordance with
Comm 61.31(1).
MUN 30-35 (1)(5) All rooftop and ground level mechanical equipment and utilities shall be fully screened
ITom view of any street or residential zoning district. Contact David Buck - Associate planner (920) 236-
5062 for additional information on screening requirements. All screening shall be properly anchored in
place to resist wind loads. Additionally mc 1608.8 Roofprojections - Drift loads due to mechanical
equipment, penthouses, parapets and other projections above the roof shall be determined in accordance
with Section 7.8 of ASCE 7.
SUBMIT:
IECC 503.3.3.7 [Comm 63.0503(2)(t)) Balancing and documentation of the HV AC system shall conform
to the !MC. Balancing report required to be submitted prior to final occupancy being allowed. A
summary shall be provided with the balancing report demonstrating that the separately ventilated
smoking room has negative pressure in relation to the adjacent prep kitchen and adjoining bar
. Comm 61.50 (4) Supervision. Prior to the initial occupancy of an alteration the supervising professional
shall file a compliance statement form SBD-9720 with this office.
A copy of the approved plans, specifications, and this letter shall be on-site during construction. All permits are required to
be obtained prior to commencement of work.
In granting this approval the City of Oshkosh Inspection Services Department reserves the right to require changes or
additions should conditions arise making them necessary for code compiiance. As per state stats 101.12(2), nothing in this
review shall relieve the designer of the responsibility for designing a safe building, structure, or component.

detailing the new door and glass system identified as item # 14 on plans. Construction of this new
separation wall may require the relocation and/or addition of fire sprinkler heads.
IBC 711.3 Any penetrations of fire rated assemblies are required to be protected with a listed firestopping
system that matches the rating of the wall assembly being penetrated. Copies ofthefirestopping systems
are required to be provided at the time ofinspection.
