Municipal Code, which shall be corrected by the compliance dates specified for each item.

SECTION 17-36
PUBLIC NUISANCE AFFECTING PROPERTY USAGE

On all residential and non-residential premises in the City. any junk. debris or condition. inciuding.
but not limited to: vlood, bricks. concrete rubble. cinder biock or other building materia is. scrap
metal. tree limbs or brush. tree stumps with a height greater than their diameter. diseased or dead
trees or other yard waste. household garbage or refuse not properiy contained or stored. inoperable
vehicles. motor or recreational. as defined in section 16-22 or parts thereof and inoperable
machinery or parts thereof (except when housecl inside out of public view). refrigerators. stoves.
washing machines, clryers. or other appliances, water heaters. dilapidated dog houses or animal
cages. animal waste. upholstered furniture. mattresses. bedsprings or other furniture not intended
for exterior use by the manufacturer and used or stored on open porches or in yards. rutted lawns
or driveways or any other unsightiy conditions as may tend to depreciate property values in the
area or create a nuisance, hazard or eyesore, shall not be allowed on any property by the owner.
occupant or person authorized to use same. Lots in residentially developed areas shall bé kept
free. by the owner. occupant, or person authorized to use same. or dirt piles. rubble and any other
material or conditions which might hinder maintenance of the property. except that dirt piles used
for landscaping purposes shall be leveled and said areas seeded with grass within thirty (30! days
of the date of delivery of the dirt. Dirt piles in commercially and industrially zoned areas shall be
removed within one (1 i year of the date of deposit on the property. except those used in conjunction
with properiy zoned landscaping businesses or contractor's yards.

SECTION 16-22
DEFINITIONS,
(19) INOPERABLE VEHICLE. "Inoperable vehicle" shall mean any unregistered vehicle. or any
vehicle lmable to move under its OVIn power or any vehicle not able to be used legally on
any public street in accordance v,ith the provisions of Chapters 347 and 348 of the
Wisconsin Statutes and/or Trans 305 of the Wisconsin Administrative Code.
"...inoperable vehicle shall mean any unregistered vehicle, or any vehicle
unable to move under its own power or any vehicle not able to be used legally
on any public street... "
Vehicle in question is registered and able to move under its own power
and can be legally used on public streets.

NUISANCE. "Nuisance". for the purposes of the Minimum Housing Code. shall be defined
as foilows:
(a)
Any attractive mlisance which may prove detrimental to children whether in a
building or upon a lot. This includes any abandoned '..veils. shafts. basements. and
excavations: or any abandoned refrigerators and inoperable motor vehicles: or any
strLlcturally unsound structures: or any lumber. trash. debris or vegetation which
may prove a hazard for inquisitive minors.

nor do I have any abandoned refrigerators or unoperable motor vehicles; etc ..."
SECTION 30-36
(A)
OFF-STREET PARKING AND LOADING FACILITIES
Generai Provisions
Off.street parking spaces shail be provided at the time any structure is erected. structLirallyaltered
or change of use. except for non-residential Uses in the C-3 Central Commercial District, unless
othervJise noted in this Chapter.
There shail be no parking in designated setback areas or outside of designated parking
spaces. except in the driveways of single family and two family dwellings.
"Off-street parking spaces shall be provided at the time any structure is erected.... "
My house was built in 1889 and this was the original driveway. There is crushed gravel
under the weed/grass growth. There are remnants of cement leading to the roadway. The
grade in this area is set for drainage for a driveway. When Elmwood Ave was repaved a
curb did not get installed to close off this driveway. When Public Service was installing new
poles and such for the remodeling of the Paine Storage Center they inquired as to whether
they could put a pole in the terrace ofthe driveway on Elmwood Ave. I asked them not to as
I do use that driveway from time to time.

In conclusion, I have moved the vehicle in question before I received your letter, August 25, 2005. I
will continue to utilize this driveway when the occasion occurs. I do not see where I am in violation of
any codes or ordinances according to the above information found on the City of Oshkosh Website. I am
not the only comer lot to have and use two driveways.
If you would take a look at the picture of my house that is online in the City of Oshkosh Assessors
Web site, you will see that there is a driveway present. The curb is painted orange which is standard
practice to warn parkers of a driveway.
