BE IT RESOLVED by the Common Council of the City of Oshkosh that the attached
Proposal with Strand Associates, Inc. to perform a detailed analysis for the Sawyer Creek
drainage basin, including field investigation, surveying, detailed drainage basin mapping,
hydrologic modeling, hydraulic modeling, alternatives analysis, identification of funding
sources and development of a project implementation plan is hereby approved and the
proper City officials are hereby authorized to execute and deliver the agreement in
substantially the same form as attached hereto, any changes in the execution copy being
deemed approved by their respective signatures, and said City officials are authorized and
directed to take those steps necessary to implement the terms and conditions of the
Agreement.

Sawyer Creek Regional Detention Basin Plan
This is an Agreement for planning services (Services) related to a Stormwater Management Plan
for the City of Oshkosh, hereinafter referred to as the PLAN, between the City of Oshkosh,
hereinafter referred to as OWNER, and Strand Associates, Inc., hereinafter referred to as
ENGINEER. This Agreement shall be in accordance with the following Scope of Services,
Compensation, Payment, Schedule, and other General Conditions contained herein.
Background Information
This PLAN is being completed to assess alternatives to reduce flooding in the Sawyer Creek
watershed. Flooding has occurred on a number of occasions on Sawyer Creek and more recently
flooding occurred on June 11, 2004.
This PLAN will be prepared with the following goals in mind:
1.
Evaluate alternatives to reduce flooding in the Sawyer Creek Watershed including
regional detention to reduce existing flooding as well as regional detention to serve
future development defined by OWNER.
2.
Assess critical flood protection locations along Sawyer Creek.
3.
Set up a hydrologic and hydraulic model of the stormwater conveyance system that will
allow for assessment of peak flow reduction and critical water surface elevations along
Sawyer Creek.
Scope of Services
A.
Field Investigation/Survey
ENGINEER will perform field investigation/survey to obtain storm drainage system
elevation/size/type data in the project area.
B.
Storm Sewer System Map
ENGINEER will develop baseline mapping identifying major and minor drainage basin divides,
land usage, soil types, and major hydraulic controls. Mapping wiU be developed in a GIS format
to facilitate estimation of hydrologic parameters. This mapping will be based on existing county
and OWNER data supplemented by information obtained in the field investigation/survey.
ENGINEER will use available OWNER Phase II WPDES Stormwater Permit mapping to assist
with this effort.

Hydrologic Modeling
ENGINEER will develop hydrologic models estimating peak runoff discharges and volumes to
locations of concem within the project area. It is antièipated that the HEC-l computer program
(U.S. Army Corps of Engineers) will be used in conjunction with precipitation data ITom the
June 11, 2004, storm event. The models will be analyzed for the 2-year, lO-year, 50-year, and
100-year storm events based on statistical rainfall depths and distributions. Flows will be
generated for existing land use and future land use in the Sawyer Creek watershed. The
OWNER shall identify the type and location of future development and provide information
regarding existing detention basins in the watershed.
D.
Hydraulic Modeling
ENGINEER shall develop hydraulic models to estimate water surface elevations at locations of
concern within the project area. It is anticipated that the HEC-RAS computer program will be
used to estimate water surface elevations along Sawyer Creek from the Fox River to the
intersection of Clairville Road and W. 20th Avenue. ENGINEER will use existing REC-RAS
files to perfonn the modeling that will be updated with known bridge or channel improvements
that ENGINEER has in-house or that is provided by the OWNER.

Alternatives Analysis
ENGINEER will evaluate potential measures in the Clairville RoadIW. 20th Avenue area and
upstream to alleviate downstream flooding. The potential measures will be assessed for
effectiveness at several key locations along Sawyer Creek identified by the OWNER at the July
29, 2005 meeting. ENGINEER will estimate existing water surface elevations from the
modeling at each of the following locations. In addition. ENGINEER will estimate water surface
elevations and peak discharges for each alternative at each of these locations.

The OWNER has indicated that they are aware of a number of other critical elevation areas
along Sawyer Creek in addition to those indicated above. ENGINEER will estimate the same
elevation and peak discharge information at these locations (maximum of five additional
locations). ENGINEER will develop alternatives. opinions of probable costs, and
recommendations for ad~ssing stormwater flooding problems. Seven alternatives will be
considered based on discussions at the July 29, 2005, meeting between the OWNER and
ENGINEER as follows.

ENGINEER's evaluation shall include incorporating measures described above into hydrologic
and hydraulic models and comparing modeled water surface elevations at critical locations with
flood protection elevations, based on OWNER survey. ENGINEER will identify locations where
modeling results indicate that conceptual improvements will reduce water surface elevations to
below flood protection elevations for the design storm event analyzed. ENGINEER will identify
locations that cannot likely be provided an adequate level of protection through engineering
measures considered. These locations will be identified for consideration for property acquisition
or flood proofing in accordance with FEMA criteria.
F.
Permitting
ENGINEER will discuss permit requirements for proposed improvements with appropriate
regulatory agencies. Possible regulatory agencies involved include the Federal Emergency
Management Agency (FEMA), U.S. Army Corps of Engineers, and the Wisconsin Department
of Natural Resources (DNR).
G.
Funding
ENGINEER shall assist OWNER staff in identifying possible sources of funding for
recommended improvements. Possible sources include revenue bonds, general obligation bonds,
grants, and cost sharing with other agencies.
H.
Implementation Plan
ENGINEER shall assist OWNER staff in development of project implementation plan.
Implementation plan will be based on engineering requirements, amount of benefit, available
funding, land availability, and related issues. Implementation plan will include prioritization of
improvements, potential schedule of improvements, and budgeting plan.

ENGINEER wil1 prepare a PLAN to be submitted to the OWNER in draft and final formats.
Three copies of the draft PLAN and ten copies of the final PLAN will be submitted to the
OWNER. This PLAN will include:

Meetings
ENGINEER will attend three meetings with OWNER as follows:
1.
Kickoff meeting with OWNER. At this meeting, ENGINEER will identify
possible locations for the regional detention basins to be considered in
Alternatives No.1 and No.2 for discussion with OWNER.
Meeting with OWNER to discuss the draft PLAN.
Meeting with OWNER to present the final PLAN to the City Council or Public
Works Committee.

Data Provided by Others
ENGINEER is not responsible for the quality or accuracy of data nor for the methods used in the
acquisition or development of any such data where such data is provided by or through OWNER
or others to ENGINEER and where ENGINEER's Services are to be based upon such data. Such
data includes, but is not limited to, topographical information, soil borings, groundwater data,
chemical analyses, geotechnical testing, reports, calculations, maps, plans, elevations, models,
designs, drawings, specifications, record drawings, and OWNER's marked-up drawings.
Obligations of OWNER
1.
Assist the ENGINEER by placing at his disposal all available information pertinent to
the Stormwater PLAN including previous reports, construction drawings, stormwater
facility mapping, stormwater plans, land use maps/plans, zoning maps, and any other
relative data.
2.
Make all provisions for the ENGINEER to enter upon public and private lands as
required to perform the Services under this Agreement.
Review all reports, sketches, estimates, drawings, and other documents presented by the
ENGINEER and render, in writing, decisions pertaining thereto within a reasonable time
so as not to delay the performance of the ENGINEER.

Provide benchmark and coordinate information for the survey to be performed in the
NAD 1983 State Plane Wisconsin South coordinate system.
6.
Provide existing hydraulic and hydrologic models from previous studies, as available.
7.
Provide al1legal services as may be required for the development of the plan.
8.
Provide water surface elevation data for Sawyer Creek (in the project area) from the
June 11,2004, flood event.
9.
Provide identification, location, and elevation survey of critical flood protection
locations along Sawyer Creek from Clairville Road to the Fox River.
10.
Preliminary identification of possible regional detention basin locations to be considered
under Alternatives No.1 and No.2 for discussion at the Kickoff Meeting.
Compensation
The Services performed under this Agreement shall be provided for a lump sum fee of $81,000
broken out as shown below. The lump sum fee assumes there wil1 be no significant delays,
extensions, amendments, or changes in the Scope of Services. The cost for any additional
meetings in excess of what is defined above, or changes in the Scope of Services, will be
negotiated with the OWNER.

Payment
The OWNER shall make monthly payments to the ENGINEER for Services performed in the
preceding month based upon monthly statements. Nonpayment 30 days after the date of receipt
of ENGINEER's invoice may, at ENGINEER's option, result in assessment of a 1 percent per
month carrying charge on the unpaid balance.
Schedule
ENGINEER will complete the Services within seven months after the date of authorization to
proceed from OWNER, which is estimated to be September 1, 2005.
Termination
This Agreement may be terminated with cause in whole or in part in writing by either party
subject to a two-week notice and the right of the party being terminated to meet and discuss the
termination before the termination takes place. The ENGINEER shall be paid for an completed
or obligated services up to the date of termination.

Dispute Resolution
Except as may be otherwise provided in this Agreement, all claims, counterclaims, disputes, and
other matters in question between the OWNER and the ENGINEER arising out of or relating to
this Agreement or the breach thereof shall be decided by mediation.
