Enclosed is the site plan approved by Darryn Burch. I show the location of the ramp and
handicap parking space.
Once we are able to obtain a building permit, the owner of the property will come in and
pick it up and pay for it. I will have supplied them with the code regarding the ramp,
exterior entrance, and the bathroom plan you previously approved. They will be
completing the work and calling in for inspections, I will have no further involvement.

4) The developer be responsible for all capital improvement costs incurred by this
development.
5) A covenant be placed on the final plat relative to Storm Drainage and Grading
Plan, to read: Pursuant to Section 30-69(H) of the City of Oshkosh Subdivision
Ordinance, upon final grading, the developer and/or owner shall comply with the
approved storm drainage and grading plan as submitted to the Dept. of Public
Works.
6) That the preliminary plat meet all requirements of Section 30-69 Design Standards
of the City of Oshkosh Subdivision Ordinance.
7) Prior to final plat approval, a 15 ft. easement between Lots 15 and 16 be granted
to the City for purposes of maintaining an existing storm sewer.
Seconded by Adams. Motion carried 9-0.
Mr. Sperl ing stated he lives in the middle of this area and he does not want his
property to depreciate in value either.

CONDITIONAL USE PERMIT - Tony Combs of Tony I s Auto Body

~ CONOITIONAL USE PERMIT - Robert H. Rothenbach
Mr. Blassingame explained the applicant is requesting the Plan Commission to review
and approve a conditional use permit for a junk yard for the property generally
located at 1800 Harrison Street with an M-3 Heavy Industrial zoning designation.
Mr. Blassingame indicated that Mr. Gehling had passed along some comments on
this item prior to the meeting that he had received two complaints from citizens in
regard to the condition of th is property.
Mr. Kinney stated action should be taken to bring this property into compl iance.
Attorney Ed Salszieder came forward to represent Robert Rothenbach and George Peterman
of Buy-George Auto Sales. He gave a brief history of the property relative to the
court case and stated even though the vehicles are "unregistered" they are all
"logged in" which is normal practice in the used car vehicle business. This business
is appropriate for M-3 zoning. His clients feel that fencing would be too expensive,
it would obscure the vision of traffic and there are no other fences in the immediate
area.
Mr. Peterman stated at a hearing in 1986 Judge Hawley ruled that this business is
not out of compliance with the Code.
Discussion ensued on limiting the use of possible future uses if the property was sold.
Motion by Fonstad to move approval of the conditional use permit for a junk yard
with the following conditions:
1) That a 5 ft. setback for all vehicles and equipment around the entire property
be utilized for fencing and landscaping. A 6 ft. fence shall be provided for
screening with said fence being similar to or comparable to that which exists at
the Mercury Marine plant site at the southeast corner of Marion Road and Wisconsin
Street and that fencing be installed within eight (8) months.

That a 10 ft. vision clearance triangle be kept clear of all vehicles, equipment,
fencing and planting and maintained at the intersection of Harrison Street and
Murdock Avenue.
3) That no stacking of automobiles be permitted.
4) "Junk yard" is limited to storage of automobiles in transit, associated equipment
and parts.

This item was withdrawn.
X.
OFFICIAL MAP CORRECTION
The City Admininstration requests that a portion of W. 20th Avenue as shown on the
official map be corrected.
Mr. Kinney explained the correction and stated this would be a change on paper only
- nothing is being changed on the road itself.
Motion by Hernke to move approval of the official map correction as shown on the
map. Seconded by Biendarra. Motion carried 9-0.
XI.
U.S.H. 41 FRONTAGE ROAO TRAFFIC STUOY
Mr. Kinney explained City Administration is requesting the Plan Commission to review
and approve the U.S .H. 41 Frontage Road Traffic Study, which sets forth recommendations
for the upgrading and improvements of the corridor roadway system along U.S.H. 41.
The study was prepared by the consulting firm of Howard, Needles, Tannen and Bergendoff
(HNTB) , as part of an overall planning process which involved a special task force
comprised of business representatives from the Highway 41 area, a State of Wisconsin
Dept. of Transportation official and City staff.
Mr. Jerry Konrad, Oirector of the Oept. of Public Works, explained that part of the
plan inclu.des the relocation of the 20th Avenue and frontage road intersection.
They are hoping to do this in 1989.
Discussion ensued on the projects included in the improvement plan.
The railroad right-of-way along the frontage road was also discussed. Mr. Konrad
explained the state wants to reI inquish the right-of-way but it is leased to Central
Railroad and the process is very difficult. .
Motion by Fonstad to move approval of the U .SH. 41 Frontage Road Traffic Study.
Seconded by Schwalenberg. Motion carried 9-0.
There being no further business, the meeting adjourned.

Brian,
Accompanying this fax is a drawing of the building as it currently is with one exception; an expanded
bathroom in attempt to meet ICC/ANSI AI17.1. Below is a few facts relating to the structure:
1. INTERIOR WALLS: As we discussed the interior walls were apparently built without a permit. I
talked with the owner and he is unaware that tlús was done, but believes a previous tenant probably
did it. I reviewed the file on the property and at one point the electrical service was condemned and
a new service was installed. I did not see a permit for the new service, but I believe there was some
notation in the file that it was done. My best guess is the walls, related other improvements, and
electrical service and other wiring was done at this time. It appears to me to be installed correctly,
but I am not an electrician.
The interior walls are 2x6 construction with Yz" sheetrock on both sides. It appears to be insulated
with R-19 insulation. Two (2) baseboard electrical heaters heat the office area. A tlúrd heater will
need to be added to the bathroom. The ceiling of the office is dry walled also with insulation. I
believe insulation will need to be added to bring the ceiling to R-38, The bathroom ceiling is a drop
ceiling with 2'x4' ceiling tile,
The Cold area has been insulated with R-I I, I believe. The walls are covered with y," drywall and
the ceiling is covered with a I' x I' ceiling tile that appears to be stapled to the ceiling with no attic
space. The area has a hanging electrical heater that is used when needed for short periods.
Electrical outlets were added to walls.
Dave Friday uses this area to store items and occasionally detail cars. His repairs needs are sent out
to others to repair. Other then a simple repair, such changing a light bulb, for example, he does not
repair cars in this space
2. BATHROOM: Hopefully I have added everything to area as needed to comply with ANSI AlI7.1.
I have used a T shaped space to comply with 304.3,2 and the clear floor space as indicated in 305.3
for the sink and the clear floor space for the toilet as required in section 604. This only requires a
few changes to the walls. I believe the rest of the space, labeled as OFFICE, is sufficient to meet
the Standard. The bathroom does have an exhaust fan.

Hopefully I have supplied you with the needed information. Dave Friday has and plans to continue to
improve the building and site. He has removed the ugly trees and cleaned up a lot of the junk around
the building. He plans to paint the exterior this year and make other improvements, such as asphalting
the lot and improve the access to the building as soon as he can.
Where to we gO from here regarding the interior walls with no permit and bathroom?
Please let me know if you need any other information.

The office and bathroom area, including all interior walls and doors, are pre-existing. It is my belief that
the area designated as the bathroom is of sufficient space to meet ADA guidelines. Also, I do not see a
need for a building permit as no new building will be taking place, just plumbing work, in which Pat
O'Niell has already taken out a permit.
