Just a reminder that normal procedures call for a framing plan, regardless of when the permit is obtained. The plan allows us an opportunity to quickly determine if there are glaring concerns with the approach being taken in building the deck. We will waive this requirement in this case as a way to bring this chapter to a close. Please remember to provide these plans for future submittal. Subject: Re: Deck Pennit Allyn, I will accept the request to obtain an additional pennit for the deck as you will see in the letter I have submitted to Nicole. I hope you have received a copy. If you did not, I will be happy to provide one for you. I do agree that the initial pennit did not address a stair platfonn and reworking the side entrance. I had no intention of doing so as the existing side porch entry would have been acceptable to me. However, at the final inspection Nicole requested that I rebuild the steps and rails do to the fact that the first riser was not code compliant and that the hand and guard rails also needed to be replaced do to non compliance even though it was an existing condition. At that time I told her that I would rather enclose the side porch and add a platfonn and steps facing to the front of the house as well as to the back. She agreed and told me to call her when it was complete. She did not request that I obtain an additional pennit or submit a framing plan at that time. It made more sense to me from a cost stand point to enclose the side porch and build the platfonn and steps as reworking the steps as she requested would have been almost as costly as the work that I have completed. The existing steps are masonry and would have been very costly to rework. I did make a decision to increase the size of the platfonn / deck without consulting Nicole. It consists of a section that is approximately 8' x 12' larger than what we agreed upon. As I stated in my letter to Nicole; if the additional size of this platfonn / deck requires a pennit, issue it and call me after you have done so. As for the framing plan, the work has been completed and can be inspected at your convenience. However, if you need a framing plan for your records please advise. Subject: FW: Deck Permit FYI. Here is Tom's response to the e-mail! sent last week. In my response to Tom last week, I indicated a framing plan is required (per normal permit issuance procedures.) However, the deck is done and we could, by inspection, determine if the framing is acceptable. What are your thoughts? How have we handled these situations in the past? It is my assumption that this letter was in response to my phone conversation with you earlier on 7/20/05. I contacted you as a courtesy to ask you to please obtain the required building permit so that I did not have to go through the work of issuing you a formal Correction Notice for failure to obtain the required building permit. As a contractor that has been conducting business in this community for several years, you should be aware that when work proceeds beyond the scope of an issued permit, additional permits are required. The scope of work under the original permit obtained on 3/21/05 states, "Duplex! Remodel first floor. Gut as needed, install insulation as needed, new wan surfaces, replace window, new cabinets, counters, cupboards, flooring, and doors. No changes in floor plan or use of rooms." At the rough fi'aming inspection it was noted that work beyond the scope of the building permit had commenced such as walls were moved and the origiIÍal floor plan had changed without the submission of a floor plan. In addition the ITont porch was being enclosed and was not included under the original permit. In the spirit of cooperation the additional work was just noted and a revised permit was not required. The final inspection revealed that the required side exit did not meet the minimum code requirements. In our discussion you stated that you would like to just enclose the porch and install a landing and steps and that I should just include this under the original permit. Please note that this was also going to be done as a courtesy to you although this was never included under the scope of the original permit. While conducting an inspection in the neighborhood it was noted that a deck was being constructed off the side porch. This is why I ,contacted you to obtain a building permit. Your letter infers that you believe this deck should be considered a part of the original permit. Please be advised the intent of my agreement was to anow the code required minimum landing under the original permit, not a 12'x19' deck. The City of Oshkosh requires a building permit be obtained for any deck, porch and/or patio. I have enclosed a handout detailing the permitting requirements. A zouing review win be required to be conducted in addition to a plan review for the structure of the deck. It is clear fi'om reviewing the pictures submitted with your letter that this is not just a 3 'x3' landing off the porch that was required to '. meet minimum exiting requirements. I stated that if I was required to make these changes I would enclose the existing side porch and add the required stair platfol1ll, steps and appropriate rails. You agreed and stated that you would inspect this work after it was completed. At no time was it requested by Inspection Services to obtain an additional permit for this work. The platfol1ll and required steps would have been approximately 50 to 60% of the size as it exists now. The projection from the house would have been the same. This would have meet the minimum requirements as we agreed upon. I elected to increase the size of this platfol1ll approximately 8 feet to the east and towards the garage. The projection from the house is the same. If the added 8' x 12' platfol1ll size changes the need for an additional permit the enclosed infol1llation is for your review. I might add that I would have done nothing if it was not required to change the existing masonry stair and platfol1ll system. It seems odd to me that I will be forced to spend additional money for this permit when the reason for doing the work was at your request to start with. I feel this should be a continuation of the permit taken originally as we knew and I stated that this would be a work in progress that could and probably would change in scope do to code and unforeseen construction requirements.
