· Comm 61.30(3) / IMC 507.2 This plan review does not include heating, ventilation, or air
conditioning. RV AC plans are required to be submitted and approved prior to installation ofRV AC
equipment. Be aware that mc 1004.3.2.4 contains additional restriction for air movement in corridors
· Comm 61.31(4) Revisions to approved plans. All proposed revisions and modifications which involve
rules under this code and which are made to construction documents that have previously been granted
approval by the department or its authorized representative, shall be submitted to the office that granted the

In granting this approval the City of Oshkosh Inspection Services Department reserves the right to require changes or
additions should conditions arise making them necessary for code compliance. As per state stats 101.12(2), nothing in this
review shall relieve the designer of the responsibility for designing a safe building, structure, or component.

The submittal described above has been reviewed for equivalency to applicable Wisconsin Administrative Codes and
compliance with Wisconsin Statutes. The submittal has been CONDITIONALLY APPROVED. The owner, as
defined in section 101.01(10), Wisconsin Statutes, is responsible for compliance with all conditions of this petition
approval and other applicable code requirements. Plan submittal and approval to the department or its agent may be
necessary prior to construction undertaken per this petition.
Your Petition for Variance of the code section noted above has been reviewed.
The code section petitioned requires that the stair treads shall be a minimum of II-inches and the stair risers shall
be a maximum of7-inches
The variance requested is to use the existing stairway which has riser dimensions of7 3/8 inches and tread
dimensions of 10 3/8 inches.
The intent of the code section petitioned is to provide stair riser and tread dimensions that provide safe, uniform,
universal means of egress for building occupants in every day use and emergency situations. An acceptable stair
grade and riser and tread dimension are required to prevent tripping and/or falling on stairways. The petitioner
submitted the SB-9890 application form including five additional pages of supporting documents.
Reviewer's Comments:
The local fITe department and municipal building inspection department reconnnend denial.
This existing building was a single family home built in the 1960's that is currently being converted to a
connnercial business, 'B' occupancy.
The existing stair has 7 3/8" risers and 10 3/8" treads. The treads are constructed of 1 1/16" thick hard oak
provided with a 1" nosing with Yz" radius.
The risers will be painted a light color in contrast to the existing dark treads.
The owner proposes additional lighting for the stairway to meet the mc 2000 edition egress illumination
requirements as currently adopted by the Department.
Stair handrails including extensions and 2nd floor guards will be provided to meet the mc 2000 edition Chapter
10 requirements as currently adopted by the Department.
Owner proposes satin finish varnish or carpet to provide a non-slip walking surface on the stair.

8. Exit signs will be added to meet mc 2000 edition requirements as currently adopted by the Department.
9. The owner states in the petition documents that the occupancy of the 2nd floor is limited to 4 people.
10. Historically riser and tread dimensions in model codes and the WI Commercial Building code have varied from
7 to 7 %" and from 9 Yz" to 11" respectively.
11. The WI Commercial Building Code prior to 2002 permitted in s. 51.16(4)( a)2. that for a change of use in an
existing commercial building that existing stairs may remain in use if they were constructed in accordance with
the requirements of the commercial building code for the new use that were in effect at the time of original
construction. The WI COmmercial Building Code in 1967 permitted stair riser and tread dimensions of7 %"
and 9 Yz" respectively for an office bUilding.
12. The 2000 edition of the International Building Code states in s. 1003.3.3.3 exception 6. that per s. 3402.4 an
alteration or the replacement of an existing stairway in an existing structure shall not be required to comply with
the requirements of a new staUway wlte>-e tire e>dsting space and co",tructi"" will not allow a reduction ;" p;tch
or slope. It is noted that section 3402.4 was deleted from the WI Enrolled Commercial Building Code adopted
with an effective date of July 1,2002. A similar exception for existing stairways was provided in the previous
model building codes for example the 1999 BOCA National Building Code.
13. Given the difficulties or unfeasibility of reconstructing this existing stairway to meet current code requirements
and that there ;s no difference;" the relative safety pmvUled by the existing stair whetlre, this buildiog ,.., orig;naJ]y
constructed as a commercial building versus a single family dwelling recommendation is for conditional approval.

above shall also be carried out unless otherwise stated below. This variance is specific to the subject petition and
cannot be used for any additional modifications.
· The building and stairway shall meet all egress requirements of the current WI Enrolled Commercial Building
Code with the exception ofs. 1003.3.3.3 riser and tread dimensions.
· Carpeting shall not be provided continuous over the risers and treads of the stair from top to bottom as this
would negate the contrasting color of the treads and risers proposed above. If carpeting is provided on the stair
treads it shall also be provided at the top and bottom landings so as not to create non~uniform riser heights.
· The stair treads shall provide a non-slip walking surface.
· Stair riser and tread dimensions shall meet the dimensional uniformity requirements of s. 1003.3.3.3 .1. No
single riser dimension shall exceed 7 3/8" and no single tread dimension shall be less than 103/8".
· Egress illumination of the stair shall provide a minimum of2 foot candles at the floor level which is twice the
code required minimum in mc s. 1003.2.11.1.
· Legible signage shall be provided in a conspicuous location at the head and foot of the stair stating "CAUTION:
NON-STANDARD STAIR" or similar wording approved by the City of Oshkosh Building Inspection
Department.
This decision will become final unless the department within 30 days from the date of this letter receives a written
request for a hearing. A request for hearing should be sent to the address shown on this letterhead. A copy of this

· 304.8 Clearances from grade. Equipment and appliances installed at grade level shall be supported on a
level concrete slab or other approved material extending above adjoining grade or shall be suspended a
minimum of 6 inches (152 mm) above adjoining grade.
· IMC 401.5 Opening Location Outside air exhaust and intake openings shall be located a minimum of 10
feet (3048 mm) from lot lines or buildings on the same lot. Where openings front on a street or public way,
the distance shall be measured to the centerline of the street or public way.
· IMC 401.5.1 Mechanical and gravity outside air intake openings shall be located a minimum of 10 feet
from any hazardous or noxious contaminant such as vents, chimneys, plumbing vents, streets, alleys,
parking lots and loading docks.
· 401.5.2 Exhaust openings. Outside exhaust openings shall be located so as not to create a nuisance.
Exhaust air shall not be directed onto walkways.
· 403.2.1 [Comm 64.0403 (3)] Recirculation of air. The air required by Section 403.3 shall not be
recirculated. Air in excess of that required by Section 403.3 shall not be prohibited from being recirculated
as a component of supply air to building spaces, except that:

shall be prohibited. All air supplied to such spaces shall be exhausted, including any air in excess

operate such systems whenever the spaces are occupied. Air conditioning systems that supply required
ventilation air shall be provided with controls designed to automatically maintain the required outdoor air

another month, to finish everything. It has been very difficult to get my workers back over here due

COMMERCIAL DEVELOPMENT AT 1856 OMRO RD. - Kurt Kielisch,
petitioner and owner
General Description/Back2:round
Kurt Kielisch, petitioner and owner, requests the Plan Commission to review and approve a
conditional use pennitldevelopment plan review for a commercial development at 1856 Omro
Road. The subject property is 0,84 of an acre in size and is zoned C-2 PD General Commercial
District with a Planned Development Overlay.
The current use of the property is residential. The existing residential structure is to remain in
place and be converted to the proposed commercial/office use. The existing driveway entrance
onto Omro Road will remain, as well.
The Planned Development Overlay for this area, approved by the Plan Commission in 2000,
was deemed appropriate per Section 30-33 (A)(l)(c)(iv)(vi) because the area was planned to be
a large commercial development with outlots and multiple smaller commercial developments.
It was anticipated the PD would provide for developments that would positively contribute to
the physical appearance and functional arrangement ofland uses and buildings in the area. The
Plan Commission has typically required the appearance of the structures in this area to be
"upgraded" due to Highway 21 being a gateway into the City of Oshkosh.
This area along Omro Road is a mixture of commercial and residential uses. To the north is the
city golf course, to the east are residential properties, to the west and to the south across Omro
Road are commercial uses including a Laundromat and a car service building with a car wash.
Analvsis
Development Plan
The petitioner is proposing to develop the existing building into an office/commercial use.
The building for which a CUP is being requested will have space for two tenants. Because the
subject property is adjacent to a residential property, the transitional side yard setback is
required along the east property line of the subject property.
One sign is proposed for the site. Actual dimensions of the signage have not been submitted
and any signage installed will be required to meet the Zoning Ordinance as no base standard
modifications have been requested. Additionally, to reduce the number of signs along Highway
21, a condition should be required limiting this site to one shared development sign.
Given the development of a new parking lot area with this conversion ttom residential to
commercial, a landscape plan is required. Per Article XI. Standards and Exceptions of the
Zoning Ordinance, Section H(3)( d) states the following:

Plant Material Required - Parking Lot Development
To achieve an appropriate level oflandscaping of a parking lot development, the
following minimum number of plant materials shall be provided and shall be
placed on the perimeter of parking areas:
(i)
One (1) overstory deciduous shade tree, coniferous or ornamental
tree for every fifty (50) feet of parking lot site perimeter.
(ii)
Five (5) understory shrubs for every fifty (50) feet of parking lot
site perimeter.
(iii)
Parking lots are part of a developed area and the standards as set
forth in Section 30-35(1)(3) shall apply. Where parking lot
improvements increase the developed area of a property,
additional landscaping treatments are to be provided within the
overall property, as set forth in Section 30-35(1)(1), (2) and (3).
In addition to the landscaping requirements, the property must also meet screening of the new
parking lot area because of the lot abutting a public street, a residential district and another off-
street parking area. A refuse disposal area and appropriate screening will also be required.
The proposed development meets all applicable standards of the underlying C-2 zoning district.
Base Standard Modification/Community Benefit
No base standard modifications appear to be needed and none have been requested. Concerns
about the physical appearance ofthe site will be addressed through conditions added to the
CUP, which will be a benefit to development in this area,
RECOMMEND A TI ON/CO NDITI ONS
Staff has determined that the proposed use is in compliance with the standards of Section 30-11,
and 30-33 of the Zoning Ordinance and recommends approval of the CUP/development plan for
the proposed development be granted with the following conditions:
