In speaking with Reger and Kristine they moved intc. an apt. at 511 Central St. #A. on 11/02/96. There were many repairs that the l,andlot'd, who is Mich,ael Schultz, indicated th,at he would make to the apt. prior to their moving in. One of which was putting in a window in the bedroc.m. When Kristine and Roger Koontz mc.ved in on 11/02/96, the repairs had not been made. The window is still wide open and they have not been able to use the bedroom because it is so cold in there. Because 01 this they have not p,aid Dec. rent, which w,~uld be Dec. 1996. On, I believe it was, 12/30/96 they received a 5 day evict iCon notice, which was signed by Tony Alaniz, who is the Mgr. of this particular apt. He is employed by Michael Schultz. The order stated that the tenants, Kristine and Roger Koontz, needed to pay Dec. rent or they had 5 days to vacate the premise. RCoger stated that earlier today at approx. 1 pm he had a phone conversation with Tony Alaniz and at that point Tony asked Roger if he was gCoing to be paying the rent. Roger indicated that he would not pay the rent until the repairs were made. Roger then indicated that at approx. 2 pm, on the same day, 01/02/97, TCony Alaniz's truck was seen at the residence by the next door neighbCors and the heat was shut off in the bld~. at that time. The controls for the heat are in the downstairs apt. which Kristine and Roger indicate is vacant at this time. Roger and Kristine believe that Tony Alaniz went intCo the downstairs apt. and shut off the heat, which shuts off the heat for the upstairs apt. as well. . the Housing that Roger shCould claims to get a were not done. attempts got ah,~ld of him t,~ RCoger then contacted Bruce Luedke (sp?), whCo is Inspect'=.r fCor' the, City of Osh. Bruce in,dic,ated pay his rent and then take the ect to small port iCon of their rent back fCor repairs that Roger indicated that he would He made tCo call both Michael Schultz Alaniz answering machines. Therefore, could not get pay the rent. At that time Bruce Luedke informed them to make Cout a cComplaint with the OPD for having the heat shut off in the winter ,time. ,j1s
