BICYCLE SAFETY ENFORCEMENT 2005

I. ISSUE IDENTIFICATION
A 'bicycle crash' is defined for this contract, as one in which one or more of the operators was a bicyclist.
The following incapacitating or fatal bicyclist crashes will be recorded by category:
1) Reportable crashes must involve a motor vehicle, however, that includes a crash with no contact but
clear relationship to a motor vehicle in operation or illegally parked.
2) Crashes on transportation facilities (roadway, bike trails & sidewalks) between two or more bicyclists.
3) Between a bicyclist and a pedestrian or in-line skater should be reported separately for this contract.
4) Bicyclist falls, striking objects or non-human living creature may be recorded if there is serious injury to
the bicyclist or if these crash types are contributing to a significant transportation safety concern.
Statewide reported bicycle crashes and injuries have increased in 2004 with the bicyclist receiving some injury
in nearly every crash. Size and speed differences contribute to more injury to bicyclists than to other vehicle's
occupants. Reportable bicycle crashes account for only 10-20% of all bicycle crashes. However, these account
for 90% of the most serious injuries to bicyclists.

PROJECT DESCRIPTION
Grantee will contribute to decrease in the number of bicycle crashes, deaths and injuries by deploying traffic
officers to locations with a history of numerous bicycle safety-related violations and lor crashes during the
contract period and by sustaining bicycle safety enforcement by local means after this funding is no longer
available.
Funded enforcement activities include coordinated overtime and/or increased regular time hours for part time
officers in deployments during days, times, locations and seasons when local data indicates enforcement
needs. Total Bicycle Safety Enforcement Project activity includes both funded and unfunded ("Match") traffic
enforcement patrols over and above the normal level of activity. No officers time will be reimbursed for non-
traffic enforcement, however, such additional time spent in bicycle safety education and related activities may
be included as match.

LOCAL PROJECT OBJECTIVES

1. To decrease bicycle crashes from the 2001-2003 3-year average of 33 to 25 by the end of CY2005.
2. To decrease bicycle deaths and incapacitating injuries from the 2001-2003 3-year average of n/a to nla by
the end of CY2005. '
3. To adopt a zero tolerance policy for motorist and bicyclist errors and violations. This will be demonstrated
with increased numbers of documented stops to educate, verbally warn, and give a written warning or
citation in each instance of such error or violation.
4. During past bicycle safety deployments, most Grantees have initiated a recorded traffic stop about every 45
minutes. Grantees should maintain or exceed historical activity levels during grant-funded activity. This
may include verbal reinforcement for correct operation and safety equipment use or verbal warnings for non-
use or incorrect use of appropriate safety equipment and incorrect operation.
5. To work with local media and other groups to increase public awareness of (1) enhanced bicycle safety
enforcement with both bicyclists and motorists (2) common errors and violations that lead to bicycle motor
vehicle crashes, including differences in child and adult errors and crash types.

Self-Sufficiency: Explain how this project's goal may be continued in your agency when BOTS funding is no
longer available. The Oshkosh Police Department is dedicated to the enforcement and education of bike safety.
Preventinq crashes that result in death or injury is given a high priority in this department and even when we
are not beinq enhanced with qrants funds to concentrate on this effort. this department will continue to make the
safety of it's citizens whether in cars, on foot or on bikes a priority. The OPD conducts several bike rodeo's per
year and partners with area community orqanizations on several others. We also teach bike safety at several
schools at the end of the school year. Also, this summer will be our second year to implement Safety City- a day
camp that teaches bike. car, and pedestrian safety for four week lonq sessions.
Eligible Costs: Only project activities and expenses detailed in the approved grant budget and incurred during
the grant period are eligible for reimbursement. Expenses incurred that are not in the approved grant budget
will not be reimbursed.

IV.
BUDGET continued:
Officer Overtime or added straiaht time Waae and Frinae: At least 70% of grant funds will be allocated to
overtime or added time for part time officers wage and fringe for traffic enforcement during the Bicycle Safety
Enforcement Patrols. Assigned officers may be on foot, on bicycle, on motorcycle or in other marked or
unmarked police vehicle.
Grantee will assign, as needed sworn officers to grant-funded deployments. Part-time officers may be assigned
to the bicycle safety enforcement deployments, only if the grant-funded activity and their weekly total hours do
not exceed 39 hours.
EQuipment: Grantee may elect to apply no more than 30% of grant funds to the purchase of approved bicycle
enforcement equipment. If Grantee elects to purchase equipment, then at least 50% of the grant amount
applied to equipment purchased must be matched by straight-time enforcement wage and that match must be
shown in the budget and reported on the Enforcement Activity Report.
Grantee will apply $N/A to the purchase of N/A (Specify make, model and purchase price).
Proposed user and use of the equipment: N/A.
Only eligible equipment specifically approved by NHTSA and the Grantor may be purchased using grant
funding. Examples of acceptable equipment include:
In-vehicle or hand-held camera and voice recording device which will be used by officers on all bicycle
safety (and/or Pedestrian safety) traffic stops to document violations and safety errors and the officer-violator
interactions regarding the reason for the stop, or inconspicuous headset radios for communication with
chase vehicle officers in decoy or other appropriate bicycle (and/or pedestrian) safety enforcement patrols.
Equipment must be purchased as soon as possible after the grant award so it can be used during the project;
purchases made late in the project may be disallowed. A copy of the invoice(s) for equipment purchase must
accompany the reimbursement claim. Equipment purchased through this grant shall be used only for bicycle
safety activities throughout its useful life, and shall be available for officers deployed on bicycle andlor
pedestrian patrols. Grantor reserves the right to monitor use of the equipment throughout its useful life.
Proiect Match: Local match of at least 25% of grant total is required. The Match budget may consist of non-
auditable estimates of "hard" or actual expenditures and "soft" match or estimated straight time wage and
fringe, mileage, travel and training, administrative costs, media time, volunteer time and other items contributing
to project activity. Non-auditable estimates of hard and soft match must be included in the project budget.
Project Match should not include costs of preparing the application or processing grant paper work.
Hiahway Safety Reimbursement Claims: (provided by Grantor) are due no later than 15 days after a
completed quarter of activity. The final payment will be made only after all deliverables are received and
approved by Grantor. Final paper work must be received no later than October 15, 2005.

WORKPLAN
Budaet Period: Specifically the Bicycle Safety Enforcement Grant activities will begin on or after March 1,
2005 and end no later than September 30, 2005. Grantee agrees to implement the deployments and hours
listed below.

Grantee agrees to implement a total of § (number) deployments of 1 hours each for a grand total of 92
enforcement hours. Of these 76 hours will be reimbursed overtime hours and an estimated 16 hours will be
match, consisting of either straight time or overtime hours. Enforcement match is not required, but is highly
recommended, the success of this project depends upon the public's awareness of significantly enhanced
enforcement.
Trainina: Grantee will show all traffic officers assigned to this enforcement grant, the video "The Law's for All"
on myths officers face re: bicycle law enforcement. All officers assigned to this enforcement activity are
encouraged to attend the 2-day Enforcement for Bicycle Safety (EBS) course. This carries 12 hours in-service
credit and is reimbursable by DOJ. Contact Larry Corsi for approved instructors and scheduling of EBS
classes, at (608) 267-3154.
Public Information/Education (PI&E) and Media: As often as possible during the periods of subsequent
bicycle safety traffic enforcement, Grantee will approach local media and other information outlets, including
schools, hospitals, civic organizations and the like, to encourage local publicity and/or discussion of the
. increased enforcement and the reasons for it.
Publicity: Grantee will provide information and news releases about the project and the regularly report activity
results to the local media and BOTS.

VI.
DELIVERABLES
Deliverables will only be accepted on the approved forms created by BOTS.
1. Bikelln-Line Skatina Enforcement Activitv Report: Grantee will complete the Bike/In-Line Skating Enforcement
Activity Report on a monthly basis and submit no later than 15 days after activity has occurred. All reports are due not later
than October 15,2005. Late reports may be disallowed and reimbursement will not be made until reports are received.
2. Final Report: The Final Report shall include a summary of objectives that were met, what approach was used to meet
the objectives, and additional factors relating to the success or failure of meeting the objectives. Include suggestions that
may improve the program and/or make other communities aware of the benefits of the program. The Final Report is due no
later than October 15, 2005.
3. Proiect Match Report: The Project Match Report should include the estimated match and a brief description of each
type of match, due no later than October 15,2005.
4. Place of Delivery: All Project Deliverables shall be submitted directly to the State Pedestrian/Bicycle Safety Program
Manager Larry Corsi and cc: the appropriate Regional Program Manager.

GENERAL CONTRACT TERMS
Correspondence: All correspondence to the Grantor regarding this project shall include the Project 10 Number. Any change
in Project Coordinator, Financial Officer, Authorizing Official, addresses, or telephone numbers requires written notification
to Grantor.
Proiect Amendment: Only project activities and expenses detailed in the approved budget and incurred during the grant
period are eligible for reimbursement. If, during the project, Grantee determines that an amendment to the budget is
necessary to meet project objectives, Grantee will request and send such amendment to their Regional Program Manager
(RPM) who will forward to Grantor main office in Madison for approval. Grantor shall complete and sign the Highway Safety
Project Amendment form upon approval.
Reimbursement Basis: All Highway Safety projects are based on the cost reimbursement concept; i.e., state or local funds
shall be expended before reimbursement is provided. All costs claimed shall be actual and supported by source
documentation. Documentation for costs shall be maintained for three years following final reimbursement.
Supplantinq: The replacement of routine and/or existing state or local expenditures with the use of federal grant funds for
costs of activities that constitute general expenses required to carry out the overall responsibilities of a state or local agency
is considered to be supplanting and is not allowable. The Grantee shall not use grant funds to supplant state or local funds,
or other resources that would otherwise have been made available for this program.
Termination: This grant may be terminated upon Grantor's determination that Grantee has materially failed to comply with
terms of this Agreement.
Grantee terminated in one federal fiscal year will not be eligible to receive highway safety funding for the next federal fiscal
year, and subsequent funding will be predicated upon receipt of written assurances that the identified deficiencies have been
corrected.

CERTIFICATION REGARDING DEBARMENT AND SUSPENSION
Instructions for Certification
1. By signing and submitting this proposal, the prospective low tier participant is providing the certification set out below.
2. The certification in this clause is a material representation of fact upon which reliance was placed when this transaction was
entered into. If it is later determined that the prospective lower tier participant knowingly rendered an erroneous certification,
in addition to other remedies available to the Federal government, the department or agency with which the transaction
originated may pursue available remedies, including suspension and/or debarment.
3. The prospective lower tier participant shall provide immediate written notice to the person to which this proposal is submitted
if at any time the prospective lower tier participant learns that its certification was erroneous when submitted or has become
erroneous by reason of changed circumstances.
4. The terms covered transaction, "debarred," "suspended," "ineligible," "lower tier covered transaction," "participant," "person,"
"primary covered transaction," "principal," "proposal," and "voluntarily excluded," as used in this clause, have the meanings set
out in the Definition and Coverage sections of 49 CFR Part 29. You may contact the person to whom this proposal is
submitted for assistance in obtaining a copy of those regulations.
5. The prospective lower tier participant agrees by submitting this proposal that, should the proposed covered transaction be
entered into, it shall not knowingly enter into any lower tier covered transaction with a person who is debarred, suspended,
declared ineligible, or voluntarily excluded from participation in this covered transaction, unless authorized by the department
or agency with which this transaction originated.
6. The prospective lower tier participant further agrees by submitting this proposal that it will include this clause titled
"Certification Regarding Debarment, Suspension, Ineligibility and Voluntary Exclusion -Lower Tier Covered Transaction,"
without modification, in all lower tier covered transactions and in all solicitations for lower tier covered transaction. (See
below)
7. A participant in a covered transaction may rely upon a certification of a prospective participant in a lower tier covered
transaction that it is not debarred, suspended, ineligible, or voluntarily excluded from the covered transaction, unless it knows
that the certification is erroneous. A participant may decide the method and frequency by which it determines the eligibility of
its principals. Each participant may, but is not required to, check the Non-procurement list.
8. Nothing contained in the foregoing shall be construed to require establishment of a system of records in order to render in
good faith the certification required by this clause. The knowledge and information of a participant is not required to exceed
that which is normally possessed by a prudent person in the ordinary course of business dealings.
9. Except for transactions authorized under paragraph 5 of these instructions, if a participant in a covered transaction knowingly
enters into a lower tier covered transaction with a person who is suspended, debarred, ineligible, or voluntarily excluded from
participation in this on, in addition to other remedies available to the Federal government, the department of agency with
which this transaction originated may pursue available remedies, including suspension and/or debarment.
CERTIFICATION REGARDING DEBARMENT, SUSPENSION, INELIGIBILITY AND VOLUNTARY EXCLUSION-
LOWER TIER COVERED TRANSACTIONS:
1. The prospective lower tier participant certifies, by submission of this proposal, that neither it nor its principals is presently
debarred, suspended, proposed for debarment, declared ineligible, or voluntarily excluded from participation in this
transaction by any Federal department or agency.
2. Where the prospective lower tier participant is unable to certify to any of the statement in this certification, such prospective
participants shall attach an explanation to this proposal.
