On July 6, 1981 we were advised by our Eden, Wisconsin Section Office
that construction had started on the above referenced development and that
spoil had been piled on our lines without notice.
Michigan Wisconsin Pipe Line Company presently holds a defined easement
for our 10" main line and 16" loop line across the tract. Attached is a
copy of a Drawing PL-350-09-119 indicating the location of this easement.
The easement grants our Company the right to "survey, construct, operate,
maintain, inspect, alter, replace, move and remove a pipeline - - - over,
through, upon, under and across the property together with the right of
entrance and exit at convenient points for such purposes."
Attached for your reference is a set of guidelines that sets forth our
Company requirements in the development of property across which we hold
pipeline easements. We require that no buildings, septic tanks or septic
fields be located within the easement limits of our pipeline, as this area
is required for maintenance and operation of our facilities and necessary
for aerial observation.

We request that contractors on this development be notified of our
pipeline location and we require that all pipeline crossing be made on
roadways or crossing areas designated and approved by our Company
representative.

GUIDELINES FOR PROPERTY DEVELOPMENT
(Single Dwelling Units)
1.
No buildings may be constructed on the pipeline right-of-v.e.y. In view
of the fact that this pipeline transports natural gas at pressures up
to975 pounds per square inch, we urge that, as a matter of policy, you
locate dwellings and other permanent structures as far fran the right-of-
way as practical. -
2.
The right-of-way above the pipeline must not be paved, except when necessary
for crossing of roads or walks, and grass or other vegetation should be
kept or restored as far as practicable. A permanent cover of vegetation is
desirable since it facilitates observation by our pipeline patrol planes.
3.
No substantial amount of cover may be removed fran above the line. In
general, we require that the line be covered by at least thirty-six (36)
inches over the top of the pipeline. There is no objecticn to adding
cover in limited amounts, but generally speaking, the lines should not
be covered by more than five (5) or six (6) feet of soil.
4.
Shrubbery and small plants may be planted on the right-of-way. We prefer
not to have large trees, since their roots may in sane instances damage
the pipelines and they make observation more difficult fran our patrol planes.
5.
Driveways crossing the right-of-way must be kept to a minimum, and should
be spaced at reasonable intervals. They should cross the pipelines at as
close to a right angle as possible.
6.
There is no objecticn to the crnstruction of roadways across our pipeline
easerrents provided crossing permissicn is applied for and detail road design
dI'awings are sul:rnitted for our review in determining effects on our
facilities. The cost of any protectirn required for our facilities (such
as casing or a concrete pad) to acconrncdate the proposed road loadings shall
be borne by the landowner.
7.
There is no objection to the installation of sewer or water lines across
Our pipeline easements provided crossing permission is applied for and plans
are sul:rnitted indicating the required clearance of a minimum of fourteen (14)
inches and preferably eighteen (18) inches between our facilities. Also,
there is no objection to the installation of overhead power or telephone lines
provided they do not interfere with or are not installed too close to our
pipelines. However, all buried gas or electric power lines crossing our
easerrent must be either encased in steel pipe or plastic pipe that will resist
prœe]Jeneb::"ation, or be se=ed within angle iron, or protected with 2" x 6"
treated planks, or protected with a layer of concrete, or be installed within
formed ccn=ete conductors. Casing or protector is to extend a minimum distance
of ten (10) feet measured at right angles fran our pipelines.
8.
Any construction on the right-of-way must be done in the presence of our
Carlpany representative so as to avoid possible damage to the lines.
Excavation within five (5) feet of our pipelines must be done with the use
of hå:ridtools only.
