Patek, P.E., Director of Public Works Re: Agreement for Planning Services North Branch Campbell Creek Stormwater Management Plan This is an Agreement for planning services (Services) related to a Storm water Management Plan for the City of Oshkosh, hereinafter referred to as the PLAN, between the City of Oshkosh, hereinafter referred to as OWNER, and Strand Associates, Inc., hereinafter referred to as ENGINEER. This Agreement shall be in accordance with the following Scope of Services, Compensation, Payment, Schedule, and other General Conditions contained herein. Background Information This PLAN is being completed to assess alternatives to reduce flooding in the North Branch Campbell Creek watershed. Of particular concern is the flooding that occurred on June 11, 2004, at the Landmark Plaza shopping center. This PLAN will be prepared with the following goals in mind: 1. Evaluate alternatives to reduce flooding in the North Branch Campbell Creek Watershed. 2. Evaluate specific alternatives to reduce flooding at the Landmark Pla:z;a shopping center. 3. Perform field survey of stormwater conveyance facilities surrounding the Landmark Plaza shopping center as well as at other critical locations. 4. Set up a hydraulic model of the storm water conveyance system that will allow for assessment of existing and potential diversions to Sawyer Creek, inclusion of the Armory and Wal-Mart detention basins (based on existing information), inclusion of the proposed Campbell Creek Detention Basins Phase I and II at the Menard's/Armory site, and inclusion of the Westhaven Golf Club detention (based on existing information). 5a. Topographic Survey ENGINEER will perform field investigation to obtain select storm drainage system elevation data, pipe sizes/types, and ditch sizes/elevations at the locations shown on Figure 1. All other storm sewer pipe elevation/size/pipe type information on the storm sewer to be modeled will be obtained from the OWNER's GIS system. 1. Along ditches to be modeled, cross sections will be taken every 200 feet in an approximate 50-foot width centered on the ditch in areas with adjacent floodplain and to the top of the bank in areas without adjacent floodplain (i.e. along USH 41/Washburn Avenue). Invert elevations of the storm sewers/culverts to be modeled that connect to these ditches will also be surveyed. 2. Along storm sewer to be modeled in the area immediately upstream and downstream of the Landmark Plaza site as shown in Figure I and at the USH 41 storm sewer/culvert crossing, survey will include rim and invert elevations of the storm sewer system as well as pipe sizes. B. Storm Sewer System Map ENGINEER will develop mapping of existing storm water management features/facilities within the Campbell Creek watershed for areas draining to the storm sewers to be modeled. This mapping will be based on existing county and OWNER data supplemented by information obtained in the field survey. ENGINEER will use available OWNER Phase II WPDES Storm water Permit mapping to assist with this effort. The following information will be shown on the mapping: . Watershed divides Major waterways Mapped floodplains Wetlands (according to county data and existing mapping) Existing lakes, ponds, and detention basins Major drainage structures Drainage problem areas Land use Soils Storm sewer system existing mapping Recommended improvements . . . . . . . . . . C. Analysis of Existing Drainage System ENGINEER will develop computer models of the existing North Branch watershed as shown in Figure 2. Portions of the South Branch and Main Branch will be modeled as shown in Figure 2. ENGINEERS City of Oshkosh Page 3 May 26, 2005 the efficiency of the model. These models will estimate the peak discharge and volume of storm water runoff draining to downstream areas. This information will be used to evaluate the existing storm water drainage facilities to identify available capacities and identify possible measures to address existing flooding problems. D. Analysis of potential impacts of future development on existing drainage system ENGINEER will identify locations where improvements may be needed within the existing drainage system in the North Branch watershed to accommodate future development. The OWNER shall identify the type and location of future development. ENGINEER will develop alternatives, opinions of probable costs, and recommendations for addressing storm water flooding problems based on analysis guidelines developed at the kickoff meeting. Four alternatives will be considered based on discussions at the May 3, 2005, meeting between the OWNER and ENGINEER as follows. 1. Alternative 1 - Analysis of the effect of additional detention on the North Branch system. Preliminary discussions indicate that the detention to be considered includes detention in the vacant parcel south of the Landmark Plaza, additional detention at the golf course, detention in Wisconsin Department of Transportation (WisDOT) right-of-ways if deemed feasible by WisDOT through conversations with the OWNER, and provision for providing a 100-year overflow route east of the Landmark Plaza to a detention basin in the Tipler Junior High property. If these locations for detention are determined to be infeasible during initial discussions with the OWNER, an equivalent number (four) of comparable detention locations elsewhere as preliminarily discussed will be analyzed. 2. Alternative 2 - Analysis of the effect of adding storm sewer/conveyance capacity to the North Branch system and downstream to the discharge at Campbell Creek including possible revisions to the internal drainage system within the Landmark Plaza site. 3. Alternative 3 - Analysis of the effect of the existing and potential diversions shown in Figure 2. 4. Alternative 4 - Analysis of the effect of a storm water pump station at the downstream end of the Campbell Creek storm sewer system. This will include an analysis ofthe pumping rate and storage volume required to pump the capacity of the existing storm sewer at the discharge point at the summer target Lake Winnebago level. 5. Alternate 5 - Analysis of the effect of a single mix of components assessed above in Alternatives 1 through 4. Prepare Storm water Management Plan ENGINEER will prepare a PLAN to be submitted to the OWNER in draft and final formats. Three copies of the draft PLAN and ten copies of the final PLAN will be submitted to the OWNER. This PLAN will include: 1. A Storm Sewer System Map. 2. A narrative discussion of study issues, criteria and goals, analytical methods, and findings. 3. Recommendations of measures to address existing and future stormwater runoff based on an alternatives analysis, opinions of probable cost, and an implementation PLAN. F. Meetings ENGINEER will attend three meetings with OWNER as follows: 1. 2. 3. Kickoff meeting with OWNER. Meeting with OWNER to discuss the draft PLAN. Meeting with OWNER to present the final PLAN to the City Councilor Public Works Committee. Data Provided by Others ENGINEER is not responsible for the quality or accuracy of data nor for the methods used in the acquisition or development of any such data where such data is provided by or through OWNER to ENGINEER and where ENGINEER's Services are to be based upon such data. Such data includes, but is not limited to, topographical information, soil borings, groundwater data, chemical analyses, geotechnical testing, reports, calculations, maps, plans, models, designs, drawings, specifications, record drawings, and OWNER's marked-up drawings. Obligations of OWNER 1. Assist the ENGINEER by placing at his disposal all available information pertinent to the Stormwater Plan including previous reports, construction drawings, stormwater facility mapping, storm water plans, land use maps/ plans, zoning maps, and any other data relative to the Stormwater Plan. 2. Make all provisions for the ENGINEER to enter upon public and private lands as required for the ENGINEER to perform the Services under this Agreement. 3. Review all reports, sketches, estimates, drawings, and other documents presented by the ENGINEER and render, in writing, decisions pertaining thereto within a reasonable time so as not to delay the performance oftheENGINEER. 4. ENGINEERS City of Oshkosh Page 5 May 26, 2005 5. Provide benchmark and coordinate information for the survey to be performed in the NAD 1983 State Plane Wisconsin South coordinate system. 6. Provide existing hydraulic and hydrologic models from prevIOUS studies, as available. 7. Provide water surface elevation data for Sawyer Creek and Landmark Plaza during the June 11,2004, flood event, as available. Compensation The Services performed under this Agreement shall be provided for a lump sum fee of $31,500 broken out as shown below. The lump sum fee assumes there will be no significant delays, extensions, amendments, or changes in the Scope of Services. The cost for any additional meetings in excess of what is defined above, or changes in the Scope of Services, will be negotiated with the OWNER. Topographical Survey Meetings Stormwater Modeling/Analysis Stormwater Management Plan $ 2,500 $ 4,000 $15,500 $ 9.500 $31,500 TOTAL Hourly billing rates are adjusted annually on July 1 and are currently as follows: Principal Engineer Senior Project Manager Project Managers Project Engineers and Scientists Engineering Technicians and Draftspersons Secretaries Hourly Billing Rates $194 to $250 $112 to $146 $ 76to$117 $ 49 to $111 $ 40 to $81 $ 52.17 Expenses incurred such as subconsultants, travel, meals, printing, postage, copies, computer, electronic communication, and long distance telephone calls shall be billed at actual cost plus 5 percent. Payment The OWNER shall make monthly payments to the ENGINEER for Services performed in the preceding month based upon monthly statements. Nonpayment 30 days after the date of receipt of ENGINEER's invoice may, at ENGINEER's option, result in assessment of a 1 percent per month carrying charge on the unpaid balance. Schedule ENGINEER will complete the Services within four months after the date of authorization to proceed from OWNER, which is estimated to be June 1, 2005. STRANO ASSOCIATES, INC," ENGINEERS City of Oshkosh Page 6 May 26, 2005 Termination This Agreement may be terminated with cause in whole or in part in writing by either party subject to a two-week notice and the right of the party being terminated to meet and discuss the termination before the termination takes place. The ENGINEER shall be paid for all completed or obligated services up to the date of termination. Dispute Resolution Except as may be otherwise provided in this Agreement, all claims, counterclaims, disputes, and other matters in question between the OWNER and the ENGINEER arising out of or relating to this Agreement or the breach thereof shall be decided by mediation.
