PURPOSE:
VACATE PORTION OF EASEMENT; GRANT EASEMENT;
MODIFY EASEMENT AGREEMENT I RIVERSIDE PARK
INITIATED BY:
DEPARTMENT OF COMMUNITY DEVELOPMENT
PLAN COMMISSION RECOMMENDATION: Approved
WHEREAS, Wisconsin Public Service Corp. (WPS) retained an easement along
the south side of the Riverside Park improvement project area for future staging work
associated with sediment remediation and entered into an easement agreement with
the City for said purpose; and
WHEREAS, in order for the City to complete amphitheater improvements on the
south side of the Park in a timely manner, it is necessary to vacate a portion of said
easement and grant a new easement to WPS on the west side of Court Street, north of
the Fox River, for said purpose, per the attached.
NOW, THEREFORE, BE IT RESOLVED that the City of Oshkosh hereby vacates
a portion of the existing easement in Riverside Park, and grants a new easement to
Wisconsin Public Service Corp., per the attached map, and approves of modifying the
Easement Agreement relative to the sediment remediation area, and the proper City
officials are hereby authorized and directed to execute any and all documents
necessary for purposes of same.
