PLAN COMMISSION RECOMMENDATION: All found to be consistent w/standards set forth in
Section 30-11 (0) & approved w/conditions as noted
BE IT RESOLVED by the Common Council of the City of Oshkosh that
conditional use permits are hereby granted for the following properties under Section
30-11 of the Oshkosh Zoning Ordinance, and that said permits are granted with
conditions, if any, as noted for each respective property.

Amend a previously approved conditional use permit for an auto body shop to allow for
the enclosure of a portion of the existing parking lot, per the attached "Exhibit B", for a
temporary drop-off area and short term storage area of vehicles with the following
conditions:

A fencing plan be submitted to, and approved by, the Department of Community
Development.
Outside storage of parts, tires, fluids, and other automobile service related items
shall be placed within the designated enclosure area only.
The access gate to the enclosure be closed at all times, other than when being
actively used to access the enclosed area.
Long-term storage of inoperable vehicles and vehicles not in an active state of
repair within the enclosure area is prohibited.

Dear Planning Commission,
This letter is in regards to some changes that have happened in the auto
body insurance industry as well as businesses in our ar~
Tony's Auto Collision Center was built and has been at its current location
for eight (8) years. We are one of the first businesses to build in the area. Since
then, a vacant farm field to our west has become six (6) commercial rental units.
West of this are three (3) additional acres purchased for development and Julie's
Touch of Silver and the Gymnastics Center. To the south of Tony's are seven (7)
business rentals and three hundred plus (300+ ) mini warehouse storage units.
To the north, the Southern Railroad Company has constructed a loading ramp
with a three hundred-foot metal walkway and guardrail to accommodate the
loading of large Oshkosh Truck Remits fôr shipping overseas to Iraq.
In recent years most major insurance companies have changed their
policies regarding the auto collision repair process. In the past customers had to
get two (2) or three (3) estimates on their vehicle. This policy was time
consuming and inconvenient for the customer. Insurance companies adopted a
new policy of having a direct repair facility. The change is that the customer
could have their vehicle repaired at their direct repair facility without having to
get another estimate.
Subsequently the repair process sped up dramatically. This change is a
huge success and the customer satisfaction surveys reflect this. TIlls change in
insurance company policy has brought up some concerns of ours.
Without having a fenced in area to put the vehicles; direct repair insurance
companies are having the vehicles dropped off after business hours.
Neighborhood kids are riding their bikes and skateboards through the parking lot
after business hours. TIris creates a safety hazard, by not having a fenced in area
for these vehicles. Another concern of ours is the appearance of a damaged
vehicle left in the parking lot. Over the past eight- (8) years at 1825 S.Washbum
Street, we have received thousands of compliments on the appearance of the
entire facility because it doesn't look like the traditional auto body shop.
Therefore to address these concerns we are proposing to fence in the back
area of the parking lot. This fence would follow the existing parking lot black top,
so all the set back requirements are met. This wouldn't interfere with any of the
current landscape. We are proposing additional landscaping around the fenced
in area. The fence would have an electric coded gate. This would allow vehicles
to be left in the fenced in area after business hours.

have a positive effect on the adjacent properties.
