the following described property, to wit:
Lot Seven (7) of Block Ninety-five (95) in the plat of the ORIGINAL THIRD
WARD, in the Sixth Ward, City of Oshkosh, Winnebago County, Wisconsin, per
Leach's Map of 1894.
Which premises are owned by you and known as, 527 W. 4th Avenue, has become
damaged to such an extent as to be dangerous, unsafe and unsanitary;
otherwise unfit for human habitation, occupancy or use; is in danger of
structural collapse; and is in a condition making it unreasonable to repair
the same.
THEREFORE, you are hereby ordered to raze and remove this building within
thirty (30) days from the date of service of this order upon you.

YOU ARE FURTHER NOTIFIED that this order is served upon you pursuant to the
terms and provisions of Section 66.05 Subsections (1), (2), (3), (4), (5),
and (8) of the Wisconsin Statutes and in such case made and provided. If you
shall fail or refuse to comply within the time prescribed in this notice,
said building shall be razed and removed by the City of Oshkosh; and the cost
of such razing and removal shall be charged against the property, shall be a
lien thereon, and shall be assessed and collected as a special tax.
YOU ARE FURTHER ORDERED AND NOTIFIED that should you fail to comply with this
order to remove any personal property or fixtures in the above described
structure(s) in accordance with Sec. 66.05(5), Wis. Stats., within 30 days
from the date of service of this order upon you the City of Oshkosh may store
the same, or may sell it, or if it has no appreciable value may destroy the
same. In case the property is stored and the amount paid for storage shall
be a lien against such property and against the real estate and shall be
assessed and collected as a special tax against the real estate if the real
estate is owned by the owner of the personal property and fixtures. If the
property is stored and not claimed by the owner it may be sold at the
expiration of 6 months after it has been stored.

We sent an order to Mr. Blaire Joas last year to raze this house. He told us he would when
he moved out (because he was finishing building his house next door) but he then made some
form of sale to Mike Beach. (Mike Beach is not listed as the owner, but has told us he bought
it from Mr. Joas). We are now issuing the formal notice since Blaire Joas was not cooperative
last year.

Brief History Review: Orders issued in 1991 to have foundation of house
inspected. Owner began work on new house next door and requested to
remain living in this dwelling until his house was completed. He did the work
himself & this took a number of years. In February 1997 following a
neighbor complaint on maintenance of this property ;Mt Joa1;informed me he
was going to sell th~dwelling. I reminded him vêrbally øf the outstanding
orders on the dwelling and advised him not to sell until an inspection was
made to determine whether or not it was reason¡tqle tôteþairthe structure. I
followed this up with a written order dated Febiuâfy 20, 1997. No further
contact was made with Mr Joas. During a complaint on a n~ighbor which Mr
Joas reported, I noted the dwelling was still in disrepair and now owned and
occupied by Michael Beach & his wife. I explained to them the situation and
informed the of the previous orders. They stated that they had never been
informed by Mr Joas of the outstanding order. Mr Beach apparently has made
a number of repairs to the foundation without a Building Permit. Mrs Beach
was visibly upset. I issued another order requesting an inspection of the
foundation and made the inspection accompanied by Inspectors Noe & Krahn.
They agreed the structure was unreasonable to repair and a raze order should
be issued. See attached inspection report.

On August 20, 1998 an inspection of the dwelling accompanied by Building Inspectors
Noe & Krahn revealed the following items which as a whole make it unreasonable to
repair.
1. The structure is non-conforming in that it lies within 10 feet of the ITont
property line.
2. The foundation has deteriorated due to powderpost beetle infestation, dryrot and
moisture retention probably aided by the installation of plastic over the skirting.
3. The perimeter beams appear to on the ground and is decayed. Sheeting boards
extend to the ground and are decayed.
4. The East half of the dwelling sags downward to the NortÞ~ast a~ evident by
excessive sloping to this comer. J ,',VY , ¡
5. The subfloor has been replaced following attempts by new owner to shore up the
foundation. This floor is improperly installed and was done without permit.
6. The central portion of the dwelling over the ITont entry door has sagged down and is
quite apparent when viewed.
7. The wood lap siding is in various states of deterioration with chipped paint, loose
siding and general decay.
8. The roof structure is sagging and the roofing itself is in poor condition.
9. The chimney is deteriorated.
10. The attached structure to the rear has fallen away ITom the main structure due to no
proper foundation. , " " ,

11. In the mid 1970's I was under this dwelling doing weâlh~rization for ADVOCAP
INC. At that time I noted severe damage ITom insects and dryrot. The floor joists
would crumble when touched making it difficult to install insulation.

Mr. Richard Joas stopped in our office with regard to the above raze and repair order.
Mr. Joas informed us that he served the residents, Mike Beach, with a notice of
eviction on October 12, 1998 which specified that they needed to vacate the property
by October 31, 1998. I told Mr. Joas that I would forward that information to you
and that you would take that information into consideration in any followup on this
property. He was also concerned that the property has not been posted uninhabitable
by your office and was questioning whether that may be done in the near future.
Apparently he has already spoken with you in that regard.

terms and provisions of Section 66.05 Subsections (1), (2), (3), (4), (5),
and (8) of the Wisconsin Statutes and in such case made and provided. If you
shall fail or refuse to comply within the time prescribed in this notice,
said building shall be razed and removed by the City of Oshkosh; and the cost
of such razing and removal shall be charged against the property, shall be a
lien thereon, and shall be assessed and collected as a special tax.
YOU ARE FURTHER ORDERED AND NOTIFIED that should you fail to comply with this
order to remove any personal property or fixtures in the above described
structure(s) in accordance with Sec. 66.05(5), wis. Stats., within 30 days
from the date of service of this order upon you the City of Oshkosh may store
the same, or may sell it, or if it has no appreciable value may destroy the
same. In case the property is stored and the amount paid for storage shall
be a lien against such property and against the real estate and shall be

Dear Allyn:
I have spoken with Mr. and Mrs. Beech and they have retained
me concerning a suet against Blaire R. Joas regarding the sale of
the above mentioned home to the Beeches. Currently, the Beeches
are living there and do attend on abandoning the property but due
to the financial constrains of paying on the mortgage, paying their
bills and of course attempting paying me, thing are quite tight.
Apparently the house does not represent a life threatening
situation but because of structural problems, was slathered for
demolition. The Beeches have informed me they have spoken to the
Building Inspector Department who indicated that if we would drop
a letter to you indicating that the Beeches plan on pursuing this
in court and will abandon the home on the completion of this
litigation, that the city would allow them to use the dwelling
until that time of a completion of the litigation.
We anticipate of filing a Small Claims Case simply to get the
Beeches money back and to rescind the contract. I do not
anticipate that the processes will take more than 60 to 90 days.
In the event Mr. Joas would remove the case to Circuit Court, the
delay could be up to 6 to 10 months and I will keep you informed.
At the present time, however, I anticipate only a Small Claims
Action for recision and restitution and or damages for payments
made by the Beeches up to this point.
