Seconded by Schorse. Motion carried 4-0. As to the Findings of Fact, Mr. Roehlig stated that by approving this request, the Board is complying with existing conditions and there are no adverse effects on the neighborhood or adjoining properties. He further state<\ that it was possible that the hardship was created by the City of Oshkosh by combining tax bills as was a common practice by the City. IT:t'M""VJ::O..slj(¡ WEST 41'I'I AYENUE - The owner/applicant is requesting a variance to allow a gymnastics school in an existing structure with a total of 31 parking spaces; whereas Section 30-32(F) Off Street Parking of the City of Oshkosh Zoning Ordinance requires a minimum of 130:t parking spaces for a recreational establishment, assembly or exhibition hall without fixed seats. Mr. Dowling reiterated his variance request and stated there is not enough area on the property to supply 120 parking spaces. Mr. Roehlig inquired if the patrons of the proposed facility would comprise mostly of non- driving individuals and Mr. Dowling indicated that primarily students under the driving age (from Kindergarten to 7-8th grades) would be frequenting the facility. He further stated that only approximately 30 students would be frequenting the facility at one time since the trampoline and other equipment would take up much of the floor space and there is only room sufficient enough for approximately 30 students at one time. Chairman pro tem Krueger inquired as to how much of the building was being proposed for the gymnasium school use and what was the balance of the. building being proposed for. Mr. Dowling stated that the gymnasium school would consist of 50% of the building and the other 50% of the building was contemplated to be used as cold storage which would not require parking. Concern was expressed as to the parking in the back of the lot. Mr. Dowling stated that the majority of the students would be dropped off and picked up by their parents at the front of the facility. He further stated that the back parking lot will be paved and noted that it is well lit and there is adequate room to allow for plowing and maintenance of the parking lot. He noted that anyone who did park in the back parking lot would be required to walk to the front of the facility for access. There is adequate roadway within which the public would be required to utilize for access to the front of the building if they parked in the rear of the lot. Motion by Roehlig to approve the variance as requested contingent upon the parking facility being paved and stripped no later than June 1, 1993, and that the facility be used for gymnastic purposes only and if the use changes, then any changes in use must be reviewed and approved by the Department of Community Development. With the church parking lot next door and the addition of these parking spaces, it will help to eliminate off-street parking in the area and it doesn't have a negative effect on the immediate surroundings of the neighborhood. ITEM III: applicant 180-196 SULLIVAN STREET - Russell Frees, owner; Reinhard Roehlig, The applicant is requesting a variance to allow a 0 ft. side yard setback from an existing parking/drive area: whereas Section 30-32(B)(5) Off Street Parking and Loading Facilities of the City of Oshkosh Zoning Ordinance requires a 10 ft. minimum side yard setback. THIS ITEM WAS WITHDRAWN BY THE APPLICANT AND REQUESTED TO BE POSTPONED UNTIL THE NOVEMBER 18, 1992, BOARD OF ZONING APPEALS MEETING. ITEM V: 748 WEST 9TH AVENUE - George Schatz, applicant/owner The applicant is requesting a variance to create two 50:!: ft. x 90:!: ft. lots with approximately 4,500 sq. ft. of area per lot and to allow an accessory structure to exist on a lot without a principal structure present or under construction; whereas Section 30- 16(B)(I)(g) Lot Area of the City of Oshkosh Zoning Ordinance requires a minimum of 60 ft. wide, 100 ft. in depth and 7,200 sq. ft. of area and Section 30-3(C) In General of the City of Oshkosh Zoning Ordinance requires that a principal structure be present or under construction prior to placement of an accessory structure. Mr. Schatz reiterated his variance request and stated that he was 86 years of age and would be unable to maintain such a large parcel of land. Mr. Schorse inquired if Mr. Schatz's garage would remain on the lot facing 8th Avenue and Mr. Sc.hatz indicated that it would. Mr. Roehlig inquired if there is an existing house on the lot facing 9th Avenue and Mr. Schatz indicated there was. Chairman pro tem Krueger inquired if Mr. Schatz intended to continue to use the garage on the lot facing 8th Avenue and if the lot were divided, would a garage be built on the lot facing 9th Avenue. Mr. Schatz stated that he would be using the garage until he was able to sell the lot facing 8th Avenue. He stated he no longer drove and would have no need for a garage in the future. Mr. Schatz further stated there is no existing driveway on the 9th Avenue side, but noted there is an curb cut approach on the 9th Avenue side. Chairman pro tem Krueger inquired if there was any record of when these lots were combined and Mr. Roskom stated he couldn't find anything to support the change. Mr. Schatz stated he used to get two tax bills, but for some reason (i.e. convenience) the City decided to combine the tax bills into one.
