( / / / / / ,/ BOARD OF ZONING APPEALS MINUTES OCT 17, 1984 MEETING PAGE THREE Reg~rding the findings of fact, Mrs. Cartwright stated she voted against the motIon because she felt the contingencies placed on the variance put undue pressure on Mr. Miller who is merely a tenant. Mr. McGee felt there is a hardship because there is no other place to put the sign. However, it is the owner of the property who legally makes the request and the variance is. granted to the property. Mr. McGee felt the Board can only require that visual clutter be removed by having the owner remove it. Appeal of Ken Nicholson, owner of the property located at 449 W. 4th Avenue, proposes to convert existing attic space to living space and requests the following: (1) A 13' front yard setback exists; whereas a 25' front yard setback is required. (2) A 6' side yard setback exists; whereas a 7 1/2' side yard setback is required. Ms. Porter stated the appellant proposes to convert attic space to 1 i ving space and requests variances to existing front and side yard setbacks. She pointed out that no exterior changes are proposed, only interior. III. Mrs. Hintz inquired if the house was constructed prior to 1965? Mr. Ken Nicholson, 1733 Georgia Street, replied yes. Mr. Goldthwaite inquired if the property will be a duplex? Mr. Nicholson replied that more bedroom space is needed upstairs. The house is small and more room is needed for family orientated renters. Mrs. Cartwright stated the house will remain as a single family then. that correct? Is Mr. Miller replied right now, yes. However, in the future it may change. Motion by Elaine Cartwright to move the appeal. Motion seconded by Dan Goldthwaite. Motion approved 5-0. Regarding the findings of fact, Mrs. Cartwright felt a hardship is evident. No improvements cou.ld be made without a variance because the house is in the setback and also pre-dates the Ordinance. Appeal of Ray Johnson, agent for Richard Naslund, owner of the property located at 317 N. Sawyer Street, proposes to erect a temporary mobile identification sign and requests the following: (1) a 0' front yard setback is proposed; whereas a 25' front yard setback is required. The proposed mobile sign will be temporary until a permanent identification sign is erected. Therefore, the appellant also proposes to erect a ground identification sign and requests the following: (2) a 0' front yard setback is proposed; whereas a 25' front yard setback is required. Ms. Porter stated the appellant proposes to erect a temporary mobile identifica- tion sign until a permanent ground sign can be erected. A variance to the front yard setback is being requested for both the mobile sign and the ground sign. She continued that there are presently 3 ground signs and a roof sign in this small "shopping mall". She suggested that it may be better to remove all existing signs and erect one sign to identify all the tenants. This would remove clutter and improve the neighborhood. IV.
