HomeMy WebLinkAboutItem 9PLAN COMMISSION STAFF REPORT MAY 5, 2026 ITEM 9: Public Hearing: Zone Changes from Single Family Residential-5 (SR-5) and Duplex Residential-6 District (DR-6) to Multi-Family Residential-36 (MR-36) for properties located at 2565 Witzel Avenue, 22 Maryden Road, 38 Maryden Road, and 2628 Witzel Avenue Applicant: City of Oshkosh Action Requested: The applicant requests a zone change from the existing Single Family Residential-5 (SR-5) and Duplex Residential-6 (DR-6) to Multi-Family Residential-36 (MR-36) for properties located near the intersection of Witzel Avenue and Maryden Road (2565 Witzel Avenue, 22 Maryden Road, 38 Maryden Road, and 2628 Witzel Avenue). Applicable Ordinance: Zoning map amendment - Section 30-381 of the Zoning Ordinance. Property Location and Background Information: The subject site consists of four parcels, 2565 Witzel Avenue, 22 Maryden Road and 38 Maryden Road each containing existing single family residential buildings, while 2628 Witzel Avenue contains a duplex. The properties are zoned Single Family Residential-5 (SR-5) and Duplex Residential-6 (DR-6). The surrounding area consists of a mix of single-family and multi-family residential uses. A Comprehensive Land Use Plan Amendment from Light-Density Residential to Medium and High-Density Residential for seven parcels (five at the northeast corner of Witzel Avenue and Maryden Road; one parcel at the northwest corner of Witzel Avenue and Maryden Road; and one parcel on the south side of Witzel Avenue) was approved by Common Council on March 10, 2026. A zone change and Conditional Use Permit was approved by Common Council on March, 31, 2026 for the three parcels associated with the apartment redevelopment at the northeast corner of Witzel Avenue and Maryden Road (Moon Properties). Zone Change: The applicant is requesting a zone change to Multi-Family Residential-36 (MR- 36) for the four properties located at 2565 Witzel Avenue, 22 Maryden Road, 38 Maryden Road, and 2628 Witzel Avenue. The proposed zone change is intended to provide consistency with the surrounding multi-family uses in the area as these four properties are the only remaining properties zoned single and two-family. The City’s recommendation to include the four remaining parcels in the zone change is not expected to negatively affect the existing single and two-family homes. If the zone change is approved, single-family residential and duplex would remain by-right permitted uses in the MR-36 zoning designation. Not including these properties at this time would result in “spot zones,” which is generally considered poor planning practice. The proposed zone change would create a greater consistency between the subject parcels and the neighboring multi-family uses in the surrounding area. The requested zone change is appropriate given the multi-family development pattern of the surrounding area over the past several decades. Page 1 ITEM 9: Zone Changes - Witzel Avenue & Maryden Road Findings: In its review and recommendation to the Common Council on an application for a Zoning Map amendment, staff recommends the Plan Commission make the following findings based on the criteria established by Chapter 30-381 (D)(2): (a)Advances the purposes of this Chapter as outlined in Section 30-03 as the proposed zone change will result in compatible zoning with the surrounding area. (b)Maintains the desired overall consistency of land uses, land use intensities, and land use impacts within the pertinent zoning districts as the proposed MR-36 zoning designation will be compatible with the surrounding multi-family uses. Recommendation: Staff recommends approval of the zone changes with the findings listed above.
