ITEM 8: Public Hearing: Zone Change from Duplex Residential-6 (DR-6) to Multi-
Family-Residential-20 (MR-20) for Properties Located at 115-185 Cherry Park
Court
Applicant: National Management LLC
Property Owner: AG Properties LLC
Action Requested: The applicant requests a zone change from the existing Duplex Residential-6
(DR-6) to Multi-Family-Residential-20 (MR-20) for four properties located on the south side of
the 100 block of Cherry Park Court, parcels 91416761000, 91416761100, 91416761200, and
91416761300.
Applicable Ordinance: Zoning map amendment - Section 30-381 of the Zoning Ordinance.
Property Location and Background Information: The subject sites are currently four
undeveloped lots (48,904 sf in total area combined) located on the south side of Cherry Park
Court. The properties are currently zoned DR-6. The surrounding area consists of residential
uses to the north, south, west, and east. The 2040 Comprehensive Land Use Plan recommends
Medium & High-Density residential use for the subject area.
Zone Change: The applicant is requesting a zone change to MR-20 District for the four
properties along Cherry Park Court. A one lot Certified Survey Map (CSM) is being proposed to
combine the parcels, with the intent of developing the site with two 8-unit apartment buildings
and associated off-street parking. The proposed buildings and improvements would
complement and expand the existing Lakeview Estates Apartment complex currently located at
25-59 Cherry Park Court.
A neighborhood meeting was held on February 18, 2026. Attendees raised general development
questions of the proposed plan including landscaping, street access, and aesthetic concerns,
with some voicing concerns of allowing a multi-family use on the subject site. Finalized details
related to these items, as well as other required performance standards (e.g. cross-access
agreements and recreation area requirements for multi-family uses) will be part of the standard
site plan review process. No additional public hearings or meetings would be required if the
zone change is approved as the development would then be permitted provided base zoning
ordinance requirements are met.
Overall, the proposed MR-20 zoning designation is consistent with the 2040 Comprehensive
Land Use Plan, which recommends medium & high-density residential use for the area.
Likewise, the character and development pattern of the proposed multifamily use would be
consistent with the surrounding neighborhood.
Findings: In its review and recommendation to the Common Council on an application for a
Zoning Map amendment, staff recommends the Plan Commission make the following findings
based on the criteria established by Chapter 30-381 (D)(2):

(a)Advances the purposes of this Chapter as outlined in Section 30-03 as the proposed zone
change will result in compatible zoning with the surrounding area and the 2040
Comprehensive Land Use Plan.
(b)Maintains the desired overall consistency of land uses, land use intensities, and land use
impacts within the pertinent zoning districts as the proposed MR-20 zoning designation
will be consistent with MR-20 zoning of neighboring properties.
(c)Addresses any of the following factors that are not properly addressed on the current
Official Zoning Map:
(ii)Factors have changed (such as new data, infrastructure, market conditions,
development, annexation, or other zoning changes), making the subject property
more appropriate for a different zoning district as a proposal for two 8-unit
residential development has been submitted that requires the requested rezone.
Recommendation:
Staff recommends approval of the zone change with the findings listed above.
