ITEM 6: Grant Storm Sewer Easement at 2601 West 20th Avenue
Applicants: City of Oshkosh & Lapham Hickey Steel Corp.

Action Requested: The City of Oshkosh is requesting to grant a storm water easement that is
located entirely on City of Oshkosh owned property. Currently, this location provides
stormwater conveyance for both 2585 West 20th Avenue (Lapham Hickey Steel Corp) and the
parcel on which the easement is to be located (2601 West 20th Avenue, parcel 91328560200) to
the City right-of-way. 2601 West 20th Avenue is currently for sale. The easement is considered a
private easement and will transfer with the property to any future owners.
Property Location and Background Information: The subject property consists of an existing
storm sewer, endwall structure, and a ditch that runs adjacent to the west property line. They
were created when the Lapham Hickey Steel Corporation site was developed. At the time of
development, the City parcel was established. No known details regarding why the City
purchased this site are available. An easement was not secured at that time.
Plans are conditionally approved for a concrete slab addition at 2585 West 20th Avenue (Lapham
Hickey Steel Corp) which has been and will continue to be the stormwater conveyance area.

Analysis: The proposed easement will allow 2585 and 2601 West 20th Avenue to utilize the
easement area for all purposes related to stormwater conveyance. This includes accessing the
easement area, and installing, operating, maintaining, and replacing any related infrastructure
when necessary.
The proposed easement will be 20 feet wide, approximately 166.50 feet long, along the storm
sewer starting at the southwest corner heading north along the westerly property line a distance
of 166.50 feet; then heading east along the northerly property line a distance of 20 feet; then
heading south a distance of 166.50 feet adjacent to the westerly property line; then heading west
along the southerly property line a distance of 20 feet to the point of beginning.
The City Attorney’s Office has prepared a draft of the easement documents. The signed
easement agreement will be recorded at the Winnebago County Register of Deeds upon
approval by the Common Council.
