HomeMy WebLinkAboutItem 5PLAN COMMISSION STAFF REPORT MAY 5, 2026 ITEM 5: Accept Sidewalk Easement for 731 Scott Avenue Applicant: City of Oshkosh Department of Engineering and Utilities Owner: Total Property Solutions, LLC Actions Requested: The City of Oshkosh is requesting the acceptance of one proposed Sidewalk Easement located within 731 Scott Avenue, parcel 90505360000. Applicable Ordinance Provisions: N/A Property Location and Background Information: The City is reconstructing Scott Avenue from Elmwood Avenue to Jackson Street with City Contract 26-02. As part of the reconstruction project, sidewalk improvements will be completed. To install appropriate sidewalk ramps that meet standards for the Americans with Disabilities Act (ADA), additional space is required outside of the public right-of-way. This easement will contain a flat space on top of the sidewalk ramps for wheelchair access. The property is located at the southwest corner of the McKinley Street and Scott Avenue intersection. Proposed Easement Location Page 1 Item 5 – Accept Sidewalk Easement – 731 Scott Avenue Analysis: The sidewalk ramps that will be constructed with the Scott Avenue reconstruction project need to follow ADA compliance for wheelchair and handicap access and use. The easement would allow for appropriate slopes so the handicap ramps may be installed in compliance with such guidelines. The easement will span six feet from the northeastern property corner, in both directions, along the property lines and then close to form a triangular easement. The City Attorney’s Office has drafted the easement document. Upon approval by the Common Council, the signed easement agreement will be recorded with the Winnebago County Register of Deeds. Recommendation/Conditions: Staff recommends approval to accept the Sidewalk Easement within 731 Scott Avenue.
