ITEM 3: Accept Municipal Storm Sewer Easement for Campbell Creek Watershed –
1401 West 5th Avenue (Franklin Elementary School)

Actions Requested: The City of Oshkosh is requesting the acceptance of one proposed
Municipal Storm Sewer Easement located within 1401 West 5th Avenue, parcel 90608530000.
Applicable Ordinance Provisions: N/A
Property Location and Background Information:
Existing storm sewer was recently relocated to accommodate the expansion of Franklin
Elementary School. The City has a section of Campbell Creek Watershed storm sewer that runs
through this property. In an effort to assist the school with their addition, a portion of the storm
sewer was relocated to remove the conflict with the building addition. Historically, this portion
of storm sewer did not have an existing easement as the pipe was installed when school district
and City were one entity. This easement will be created to properly give access and
maintenance to this section of storm sewer.
The property is located north of West 9th Avenue, west of Mason Street, and South of West 5th
Avenue. This easement is used for conveyance of upstream stormwater through pipes within
the Campbell Creek Watershed. The City will be responsible for maintenance of pipes, as part of
this easement, while the property owner will maintain the surface condition.

Analysis:
The Campbell Creek Watershed drains directly through this pipe network within the proposed
easement. This proposed easement will allow for the drainage and maintenance of piping across
and through the development as well as future maintenance and infrastructure repair, as
needed.
The easement will be 20 feet wide and span from the southwestern portion of the site, from an
existing stormwater ditch, toward the northeastern corner of the site.
The City Attorney’s Office has drafted the easement documents. Upon approval by the
Common Council, the signed easement agreement will be recorded with the Winnebago
County Register of Deeds.
Recommendation/Conditions:
Staff recommends approval to accept the Municipal Storm Sewer Easement within the Franklin
Elementary School (1401 West 5th Avenue) development.
