ITEM 2: Petition for Direct Annexation by Unanimous Approval – Mellenthin Annexation
from the Town of Oshkosh, 2732 Jackson Street, Parcel 018020001
Petitioner/Property Owner: Michael and Anne Mellenthin
Action Requested: Petitioner is requesting direct annexation (by unanimous approval) of
approximately 1.03 acres of land located at 2732 Jackson Street in the Town of Oshkosh.
Applicable Ordinance Provisions: Annexation is located within Section 30-360 of the City of
Oshkosh Zoning Ordinance as well as within Section 66.0217 of the Wisconsin State Statutes.
Property Location and Background Information: The property is located on the east side of Jackson
Street, approximately 470 feet north of West Packer Avenue. The property contains a single-family
house with an attached 2-car garage and a detached 2-car garage.
The petitioner is requesting annexation from
the Town of Oshkosh to the City of Oshkosh
to enable a connection to the City sanitary
sewer. The existing septic system serving the
home is failing and there is no onsite option
for replacement. This annexation will require
the home to also be connected to City water,
which is typically completed at the same time
as the sewer connection.
The property currently has a Town of Oshkosh
General Farming District (A-2) designation.
The surrounding area is made up of vacant
land and a variety of commercial uses, to
include a veterinary clinic, doctors’ clinic,
indoor storage, and a vehicle towing/repair
business. Some of these surrounding properties are in the Town of Oshkosh and some are in the City
of Oshkosh. The property will be annexed with temporary and permanent zoning of Suburban Mixed
Use (SMU), which is consistent with the adjacent City zoning and Comprehensive Plan’s Mixed Use
land use recommendation.

The proposed annexation meets Wisconsin’s statutory requirements for unanimous annexations. The
State of Wisconsin Department of Administration’s Municipal Boundary Review has reviewed the
petition and found the annexation to be in the public interest.
The Comprehensive Plan designates this area for Mixed Use which is consistent with the proposed
zoning designation of Suburban Mixed Use (SMU). The existing legal non-conforming land use,
single-family residential, will continue to be a legal non-conforming land use in the SMU zoning
district. The owners have the right to rebuild a single-family home in the case of a natural disaster.
However, if the home is vacated for 12 months or more, the legal non-conforming land use is lost;
requiring the land use of the property to change to a code complaint use with the SMU zoning
district.
The Department of Public Works has reviewed the request and reported that City water and sanitary
sewer are located, and available, within the Jackson Street right-of-way. The Oshkosh Fire and Police
Departments have reviewed the annexation request and do not have any concerns with providing
services to this property.
Recommendation:
Staff recommends approval of the Mellenthin Annexation with a temporary and permanent zoning of
Suburban Mixed Use (SMU) as requested.
