PURPOSE:
AMEND CONDITIONAL USE PERMIT; APPROVE REVISED
PLANNED DEVELOPMENT /605-697 DIVISION STREET
INITIATED BY:
BURNS DEVELOPMENT
PLAN COMMISSION RECOMMENDATION: Approved
WHEREAS, the Common Council previously approved a conditional use permit
for a planned residential development for construction of multi-family structures in the
600 Block of Division Street; and
WHEREAS, the petitioner desires to amend the development plan by allowing
parking spaces in the drive aisle at the rear of the structures, per the attached "Exhibit
A".
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the planned residential development at 605-697 Division Street is hereby
amended to allow 16 parking spaces in the drive aisle at the rear of the structures per
the attached "Exhibit A".

Dear Commission/Council:
The original Planned Development site plans for the townhouses along the 600 block of
Division St. identified (2) parking spaces per unit (a driveway space and a garage space).
A private alley exists at the rear of the these buildings and serves half of the project's total
40 units. Since the project's beginning in 1999, visitors have parallel parked in this rear
alley. Tenants have used the alley for temporary/convenience parking to allow a 2nd
vehicle access to or exit from a garage. A few tenants (landlord knows of only (2) at this
time) have allowed their garage to be utilized for storage and thus park a 2nd vehicle
permanently in the alley. .
The fire dept. has stated that access to this private alley is not a concern as tires would be
attacked from the frontage along Division St. where hydrants are located. On garage pick-
up days, tenants have been instructed to not park along the alley until after the city has
completed their garbage pick-up. Six foot high fencing screens the alley from adjacent
residential uses. These actions and conditions should alleviate any possible negative
impacts from allowing this continued alley parking. For the convenience of owner's
tenants, owner desires to amend the site plan of the planned development for 605-697
Division St. to allow parallel parking along the alley within the spaces depicted in the
attached site plan. Thank you for your consideration.
