HomeMy WebLinkAbout08-89_3-11-08FEBRUARY26 2008 MARCH11 2008 08-57 08-89 ORDINANCE FIRSTREADING SECONDREADING CARRIED 7-0 LOST LAIDOVER WITHDRAWN PURPOSE AMENDCITY OFOSHKOSH COMPREHENSIVE PLAN INITIATEDBY DEPARTMENTOF COMMUNITYDEVELOPMENT PLANCOMMISSION RECOMMENDATION Approved AN ORDINANCETO AMEND THECOMPREHENSIVE PLANOFTHECITY OFOSHKOSHWISCONSIN TheCommonCouncil oftheCityofOshkosh Wisconsin do ordainasfollows SECTION1 TheCityp roposes an amendment seeattached tothe CitysapprovedComprehensivePlantorevisetheRuralPreservationLandUsesectionto providethelimited abilitytoapprove infill type landdivisionswithinthe designated Rural Preservation areas identifi ed ontheLandUseMap thataddressesexisting smallresidentialareas withinlarger predominatelyagriculturaluseareas SECTION2 ThePlan Commissionrecommendedapprovalofsaidamendment SECTION3 TheCityhashelda public hearingon this Or dinance in compliancewith therequirements ofSection66 10014 d WisconsinStatutes SECTION4 TheCommonCouncil oftheCityofOshkosh Wisconsin hereby approvesoftheattached revised RuralPreservationLandUse section oftheCityof Oshkosh Comprehensive Plan Chapter 4LandUse Element page53 SECTION5 ThisOrdinanceshalltakeeffectuponpassage byamajority voteofthemembers-elect oftheCommonCouncil and publication asrequired bylaw Revised RuralPreservation LandUse Section CityofOshkosh Comprehensive Plan Chapter4 LandUse Element Page53 RuralPreservationLandUse Whilethe citywill haveagriculturaluses withinits boundaries thecitydoes not foreseehaving ademandfor moreagriculturalland withinthecitylimitsAgriculturallandwillinalllikelihoodremaininatownsjurisdictionuntilthe demandfor developmentinitiates an annexationrequest Thecitysgoalis to avoidprematuredevelopment ofagriculturallandsthatconflictwith futurecity landuses orisnot abletobe efficientlyserved with facilitiesandservices While thatagriculturalland may notbeimmediately developed agriculturallandatthattimeservesastemporarylanduseinanticipationofbeingdevelopedinthe future Thefutureland usemapshowsapproximately38 415acresofland designatedas RuralPreservation in the20-year landusemap WiththecurrentZoning Ordinance minimumlotsizes for agriculturaluses areeither10acresor35acresfortheA-1andA-2zoningdistricts respectively Oneacre lotsmay be createdin theA-2 districtfor pre-existing housing Residentialdevelopments developedatthesestandards aregenerallynot consideredtohavetypical urban services such aswater sanitary and stormwater sewerservice sidewalks andclose proximitytoparksduetotheinabilitytoservicethistypeofresidentialdevelopmentincost-efficientmanners Areasdesignatedfor RuralPreservation onthe landusemapsaretoremain in agriculturalandrelated uses untilsuch timeastheselands areprovidedwith urbanservices Establishment oflow-density residentialdevelopmentnotassociatedwithanagriculturalorrelateduseisnotconsistentwiththeRural Preservation land usedesignation Parcelswhere there areexisting residential dwellingsdevelopedasan accessory usetoan agriculturalusemaybe divided aslongasthe landdivisionistheminimumnecessarytoretainthe principal use oftheland Within theareasdesignated as Rural Preservation there arenumerouspockets ofnon-agricultural residentialusescreated prior tothe adoptionoftheCitys Comprehensive Plan andorprior totheCitybeingable toenforce its extraterritorial landdivisionplattingjurisdiction Intheseareas infill typelanddivisionsmaybeapprovedsubjecttoafindingbythePlanCommissionthatthe proposed landdivisionisnot establishinganewland usepatternandthatthe proposed landdivisionwill assurethecontinuation oftheagriculturallanduse patternin thegeneral area
