HomeMy WebLinkAbout2026-01-22 Release of Easement 1960326Document Number RELEASE OF EASEMENT Document Title The CITY OF OSHKOSH, 215 Church Avenue, Oshkosh, Wisconsin 54901, a Wisconsin municipal corporation (CITY), herein takes the following action regarding its interests in certain real property as identified below REGISTER OF DEEDS 1 1 • 1 1 ' PAGES: 5 Easement. The City holds an easement for right-of-way Name and Return Address purposes over and across certain Property. The City's easement City Attorney's Office interest was obtained through a Warranty Deed that retained this PO Box 1130 easement across property it conveyed, with the Warranty Deed Oshkosh, WI 54903-1130 being dated December 12, 1983 and recorded with the 90701421200 Winnebago County Register of Deeds on December 13, 1983, as Document Number 602735. A copy of the Warranty Deed is Parcel Identification Number attached as Exhibit A. The foregoing document addresses multiple easement properties. The subject of this Release is only the Easement Property identified below, which is also marked within the attached Exhibit A. 2. Easement Property. The Easement Property identified in Exhibit A, is described as: That part of Lot 17, Block "G", Th Ward, Leach's Map of 1894, City of Oshkosh, Winnebago County, Wisconsin, described as follows: IVAOC (PIN) Commencing at the Southeasterly corner of Lot 17 of Block "G"; thence North 34 degrees 20 minutes 52 seconds East 172.47 feet, along the Easterly line of said Lot 17 to the true pint of beginning; running thence North 56 degrees 27 minutes 51 seconds West 24.84 feet; thence 33 degrees 27 minutes 10 seconds East 38.85 feet; thence North 56 degrees 32 minutes 50 seconds West 4.98 feet; thence North 33 degrees 27 minutes 10 seconds East 30.30 feet; thence South 56 degrees 32 minutes 50 seconds East 4.98 feet; thence North 33 degrees 27 minutes 10 seconds East 79.02 feet; thence South 45 degrees 03 minutes 33 seconds East 4.47 feet, to a point on the Northerly line of said Lot 17; thence South 57 degrees 26 minutes 09 seconds East 5.62 feet, along the Northerly line of said Lot 17; thence South'33 degrees 27 Minutes 10 seconds West 88.22 feet, along the Westerly wall of the gymnasium building and its Northerly projection; thence North 56 degrees 32 minutes 50 seconds West 4.98 feet, along said wall; thence South 33 degrees 27 minutes 10 seconds West 10.30 feet, along said wall; thence South 56 degrees 32 minutes 50 seconds East 4.99 feet, along said wall; thence South 33 degrees 27 minutes 10 seconds West 38.85 feet, along said wall; thence South 56 degrees 27 minutes 51 seconds East 14.99 feet, along said wall and is Easterly projection to a point on the Easterly line of said Lot 17; thence South 34 degrees 20 minutes 52 seconds West 10.02 feet, along the Easterly line of said Lot 17 to the true point of beginning. 3. Release. The City of Oshkosh releases all of its right, title, and interest in the easement identified herein. It is unclear from the terms of original easement grant if this was intended to benefit a specific property that the City may have subsequently conveyed. Therefore, this Release only applies to any interest retained by the City of Oshkosh in the easement identified and highlighted in Exhibit A. This Release does not affect the interests that others may hold in the easement that has been granted through separate document(s) or otherwise acquired through subsequent transfers of interests in the easement property described within Exhibit A. A map of the Easement is attached as Exhibit B. 08, 2026 Improvements. To the extent the City of Oshkosh has installed and maintained any improvements within the Easement Property, the City abandons such improvements as -is, and the City makes no warranty or further claims to such improvements.
