Christine Ann Services holds an Easement for right- I Oshkosh, WI 54903-1130 of -way purposes over and across certain City of Oshkosh 90724232002 Property. This easement was described and granted in two separate documents. The first document is a Warranty Deed dated Parcel Identification Number December 12, 1983, and recorded with the Winnebago County Register of Deeds on December 13, 1983, as Document Number 602735. The second document is an Agreement and Easement dated December 12 ,1983, and recorded with the Winnebago County Register of Deeds on December 13 ,1983, as Document Number 602737. A copy of the Warranty Deed is attached as Exhibit A. A copy of the Agreement and Easement document is attached as Exhibit B. Each of the foregoing documents addresses multiple easements. The subject of this Partial Release is only one Easement Property which is identified below and also marked within the attached Exhibits. Easement Property. Partial Release. Christine Ann Services releases part of its Easement. Specifically, it releases all right, title, and interest in that part of the Easement Property described below. A map of the part of the Easement released is attached as Exhibit C. Improvements. Improvements within that part of the Easement released which were installed and maintained Christine Ann Services are abandoned. Christine Ann Services makes no further claims or exercises any further responsibility for these improvements. 5. Easement Not Released. A map of that part of the Easement Property not released is identified in Exhibit C. The unreleased Easement is non-exclusive. With the change in configuration of the easement, Christine Ann Services and the City of Oshkosh agree that purpose of the unreleased Easement will change from vehicular oriented right of way to the following purposes: a. Used for pedestrian purposes only. Personal mobility equipment, along with smaller equipment used for things like snow removal and maintenance are allowed. b. Christine Ann Services and the City for access and use their adjoining property. c. Fencing, including security fencing, is allowed provided it doesn't block either Christine Ann Services' or the City's use of the property. If gates or doors with locks are installed, both parties must have keys, codes, or whatever is necessary to maintain full access. d. The City will remove snow and ice and install/maintain landscaping. The City is responsible for routine surface maintenance. e. The parties will share equally the cost of significant new, and major repairs and replacement of, surface improvements. f.
