Easement. Christine Ann Services holds an Easement for right- I Oshkosh, WI 54903-1130
of -way purposes over and across certain City of Oshkosh

Property. This easement was described and granted in two
separate documents. The first document is a Warranty Deed dated Parcel Identification Number
December 12, 1983, and recorded with the Winnebago County
Register of Deeds on December 13, 1983, as Document Number 602735. The second document is
an Agreement and Easement dated December 12 ,1983, and recorded with the Winnebago County
Register of Deeds on December 13 ,1983, as Document Number 602737. A copy of the Warranty
Deed is attached as Exhibit A. A copy of the Agreement and Easement document is attached as
Exhibit B. Each of the foregoing documents addresses multiple easements. The subject of this
Partial Release is only one Easement Property which is identified below and also marked within
the attached Exhibits.
Easement Property. The complete Easement Property identified in both Exhibit A and Exhibit B,
is described as:
That part of Lot 15, Block "G", Th Ward, Leach's Map of 1894, City of Oshkosh, Winnebago
County, Wisconsin, described as follows:
Commencing at the Northwesterly corner of Lot 19 of said Block "G" and being the true point of
beginning; running thence North 57 degrees 26 minutes 09 seconds West 15.00 feet, along the
Northerly line of Lot 15 to its Northwesterly corner; thence South 32 degrees 30 minutes 51
seconds West 120.00 feet, along the Westerly line of said Lot 15; thence North 57 degrees 26
minutes 09 seconds West 2.51 feet, along the northerly line of said Lot 15; thence South 29
degrees 41 minutes 59 seconds West 96.09 feet; thence South 59 degrees 52 minutes 56 seconds
East 7.80 feet; thence North 30 degrees 49 minutes 39 seconds East 21.09 feet; thence 59 degrees
36 minutes 19 seconds East 8.00 feet; thence North 30 degrees 23 minutes 41 seconds East 64.30

Partial Release. Christine Ann Services releases part of its Easement. Specifically, it releases all
right, title, and interest in that part of the Easement Property described below. A map of the part
of the Easement released is attached as Exhibit C.
That part of Lot 15, Block "G", Th Ward, Leach's Map of 1894, City of Oshkosh, Winnebago
County, Wisconsin, described as follows:
Commencing at the Northwesterly corner of Lot 19 of said Block "G" and being the true point of
beginning; running thence North 57 degrees 26 minutes 09 seconds West 15.00 feet, along the
Northerly line of Lot 15 to its Northwesterly corner; thence South 32 degrees 30 minutes 51

4. Improvements. Improvements within that part of the Easement released which were installed and
maintained Christine Ann Services are abandoned. Christine Ann Services makes no further
claims or exercises any further responsibility for these improvements.
5. Easement Not Released. A map of that part of the Easement Property not released is identified in
Exhibit C. The unreleased Easement is non-exclusive. With the change in configuration of the
easement, Christine Ann Services and the City of Oshkosh agree that purpose of the unreleased
Easement will change from vehicular oriented right of way to the following purposes:
a. Used for pedestrian purposes only. Personal mobility equipment, along with smaller
equipment used for things like snow removal and maintenance are allowed.
b. Christine Ann Services and the City for access and use their adjoining property.
c. Fencing, including security fencing, is allowed provided it doesn't block either Christine Ann
Services' or the City's use of the property. If gates or doors with locks are installed, both
parties must have keys, codes, or whatever is necessary to maintain full access.
d. The City will remove snow and ice and install/maintain landscaping. The City is responsible
for routine surface maintenance.
e. The parties will share equally the cost of significant new, and major repairs and replacement
of, surface improvements.
f. All terms in the original Easement remain the same except as identified or modified in this
document.

AGREEMENT AND EASEMENT
THIS AGREEMENT entered into this ! Z" day of
1933, by the CITY OF OSHKOSH, Grantor, and MRI DEVELOPMENT CORPORATION','
as Grantee,
WHEREAS, the Cantor has sold to Grantee certain properties
in the City of Oshkosh; and
WHEREAS, as inducement of such sale, Grantee requires an access
easement over property of Grantor, herein described in Exhibit A,
NOW, THEREFORE, IT IS AGREED BY AND BETWEEN the parties that:
1. Grantor shall provide access to and over the following
described property to Grantee. See attached Exhibit A.
2. This access shall be is the nature of an easement and shall
be For the sole purpose of access to and from the property sold to the
Grantee by Lhe Grantor. 'Grantee in no way shall have the right to dis-
curb the surface of the land herein described.
3. Grantee upon acceptance of this easement will hold harmless
the GcantoL from any claims or damage for any cause wb atsoever due to
the granting of this easement.
4. Grantee agrees'ta maintain the land described in this ease-
ment in the same manner and to the same degree that the property was at
Lhe onsuing of this agreement.
5. This easement is granted for the sole purpose of allowing
accost, both ingreGs and egross, to Grantee, its invitees and tenants,
to the properly hc-reL'Ofore conveyed by the Grantor and the Grantee in
ncceplinq Vhe easement, accepts full responsibility for maintenance of
Ihr properly and ai] liability for anyone who traverses said easement.
