WHEREAS, in 2007, the Common Council approved Resolution 07-25 and 07-41 to officially map Tucker Trail, extending easterly from Vinland Street approximately 215 feet through the property at 3320 Vinland Street in the Town of Oshkosh, for the purpose of preserving land for future street dedication and construction; and WHEREAS, official mapping is a tool that municipalities use to preserve land for future street dedication and construction, and officially mapped areas cannot be developed and are treated similarly to right-of-way in regard to setback requirements from the officially mapped area; and WHEREAS, the City was recently approached by Valley Christian School regarding this general area as it plans to construct a new school, and based on the proposed development, the officially mapped right-of-way in this location is no longer needed to achieve the City's transportation or access objectives, and removal of this segment from the Official Map will remove the right-of-way encumbrance from 3320 Vinland Street and allow the site to develop consistent with the school's plan; and WHEREAS, the City has held a public hearing on this Ordinance, in compliance with the requirements of Section 62.23(6) of the Wisconsin Statutes concerning amendments to the Official Map of the City of Oshkosh; and WHEREAS, the Plan Commission recommended the adoption of this Ordinance to delete the officially mapped portion of Tucker Trail located from Vinland Street east to its eastern terminus, per the attached exhibit. The Common Council of the City of Oshkosh does ordain as follows: SECTION 1. That Section 30-440 of the Oshkosh Municipal Code pertaining to the Official Map of the City of Oshkosh and its extraterritorial jurisdiction is hereby amended by deleting the officially mapped portion of Tucker Trail, located from Vinland Street east to the eastern terminus, per the attached Exhibit A, thereby making revisions to the Official Map on file with the City of Oshkosh Public Works Department. SECTION 2. Immediately upon these amendments to the Official Map becoming effective, the City Clerk shall file a certified copy of this Ordinance and Exhibit A with the Register of Deeds for Winnebago County showing that the City has amended its Official Map; and the City of Oshkosh Public Works Department shall file a copy of this Ordinance and the attached Exhibit A with the Official Map on file in its office, indicating the Official Map of the City of Oshkosh was amended by action of the Common Council on this date. SECTION 3. This Ordinance shall be in full force and effect from and after its passage and date of publication. SECTION 4. Publication Notice.
