PURPOSE:INTERIM ZONING ORDINANCE TO PRESERVE EXISTING
COUNTY ZONING WITHIN THE CITY OF OSHKOSH
EXTRATERRITORIAL ZONING JURISDICTION IN THE TOWN
OF ALGOMA

A GENERAL ORDINANCE OF THE CITY OF OSHKOSH PRESERVING EXISTING
COUNTY ZONING WITHIN THE CITY OF OSHKOSH EXTRATERRITORIAL ZONING
JURISDICTION IN THE TOWN OF ALGOMA
The Common Council of the City of Oshkosh do ordain as follows:
SECTION 1. This Ordinance follows Common Council approval of Resolution
05-27 on February 8, 2005, in which the City of Oshkosh declared its intent to exercise
extraterritorial zoning jurisdiction over, and prepare a Comprehensive Zoning Ordinance
for, a portion of the Town of Algoma, Winnebago County, Wisconsin, legally described
as follows:

SECTION 2. This interim zoning ordinance is hereby enacted to preserve the
existing zoning within the affected area in accordance with the Winnebago County
zoning ordinances and official zoning maps as they exist on the date of adoption of this
Ordinance. Enforcement and administration of the zoning ordinance preserved by this
interim ordinance, including, without limitation, approval of all conditional use permits
and granting of all variances and appeals, shall be performed by the appropriate City
board, commission or officer, as designated in the City of Oshkosh Code of Ordinances.
If the Town has been issuing building permits, it may continue to do so, subject to the
City Building Inspector approving such permits as to zoning prior to their issuance. This
interim zoning ordinance shall be effective no longer than two (2) years after its
enactment, unless extended for one additional year upon recommendation of a Joint
Extraterritorial Zoning Committee established under Section 62.23(7a)(c) of the
Wisconsin State Statutes.

SECTION 3. The City of Oshkosh Plan Commission shall promptly formulate
tentative recommendations for the zoning district plan and regulations within the extra-
territorial zoning jurisdiction described in Resolution 05-27 pursuant to Section
62.23(7a) of the Wisconsin State Statutes.
SECTION 4. When the Plan Commission is so engaged, a Joint Extraterritorial
Zoning Committee shall be established and shall operate under the provisions of
Wisconsin Statutes Section 62.23(7a)(c) through (g).
SECTION 5. All ordinances or parts of ordinances contravening the terms of this
Ordinance are hereby to that extent repealed.
SECTION 6. This ordinance shall be in full force and effect from and after its
passage and publication as required by law.
