ITEM 2: Declare Private Storm Sewer Easements for Lots 1-8 and Lots 9-18 of
Washington School Subdivision
Applicant/Owner: City of Oshkosh Department of Public Works/City of Oshkosh
Actions Requested: The City of Oshkosh is requesting the acceptance of two proposed Private
Storm Sewer Easements located within Lots 1-18 and Lots 9-18 of Washington School
Subdivision.
Property Location and Background Information: The subject properties were recently created
via the Washington School Subdivision Plat and are currently vacant. New property owners
plan to take ownership of the newly created properties after purchase from the City. The
original subdivision plat included an 8-foot storm sewer easement; however, it was later
determined the 8-foot sizing was not large enough to encompass the maintenance needs, thus a
20-foot easement is needed.
The properties are located east of Bowen Street and west of Rosalia Street, while being south of
Winnebago Avenue and north of School Avenue. These easements are used for on-site
stormwater management for the Washington School Subdivision. The City will be partly
responsible for part of this easement, until all lots are sold to new property owners.
Analysis: The Washington School Subdivision will have an interconnected drainage system that
drains stormwater to the shared stormwater treatment devices. The proposed easements will
allow for the drainage and maintenance of piping across and through newly developed lots as
well as the future maintenance and infrastructure repair, as needed. The easements are solely
for the benefit of those properties found within the subdivision.
The easements will be 20 feet wide and span the frontage of the subdivision on both Winnebago
Avenue and School Avenue.
The City Attorney’s Office has drafted the easement documents. Upon approval by the
Common Council, the signed easement agreement will be recorded with the Winnebago
County Register of Deeds.
Recommendation: Staff recommends approval to declare the Private Storm Sewer Easements in
the new Washington School Subdivision, found within Lots 1-8 and Lots 9-18.
