ITEM 6: Vacate a Portion of Eichstadt Road, 135 feet South of Freedom Avenue
Petitioner: City of Oshkosh Department of Community Development

Actions Requested: The Department of Community Development is requesting the partial
vacation of Eichstadt Road, that is 135 feet south of Freedom Avenue.
Applicable Ordinance Provisions: WI State Stats. 66.1003 regulates the vacation and
discontinuance of a public right-of-way.
Property Location and Background Information:
Located 135 feet south of Freedom Avenue, the subject area is a dedicated 60-foot-wide right-of-
way, owned by the City of Oshkosh. Valley Christian School is in the design phase of building a
new school on the property to the east and southeast. The city is proposing to vacate a portion of
Eichstadt Road as it will no longer be needed as road right-of-way with Valley Christian’s project.
Analysis:
The area in this request involves an
“L” shaped area that is 0.6419 acres
in size, approximately 331 feet long
by 195 feet wide. There is a storm
and sanitary main in a portion of the
subject area. State statute allows
municipalities continued rights to its
active facilities in vacated right-of-
way. These rights include access,
maintenance, replacement and
relocation of its facilities.
After approval, part of the vacated
area will attach to the lot to the east
and the other part will attach to the
lot to the west.
A Certified Survey Map (CSM) will
be used to combine Valley Christian
School’s three lots into one lot as
part of their proposed high school development. The CSM will also dedicate a cul-de-sac bulb at
the south end Eichstadt road for a vehicle turnaround.

Item 6 – Partial Eichstadt Road Vacation
The Department of Public Works has reviewed this request and does not have concerns with the
vacation. The right-of-way is no longer needed and the City will have continued rights to the
existing storm sewer and sanitary sewer in the vacated area.
Staff supports the proposed right-of-way vacation request. The vacation will assist Valley
Christian School by increasing their land area for a new school and the vacation will not
adversely affect future City plans in the area.
Recommendation:
Staff recommends approval of the partial right-of-way vacation of Eichstadt Road as requested.
