HomeMy WebLinkAboutItem 7 PLAN COMMISSION STAFF REPORT DECEMBER 2, 2025 ITEM 7: Petition for Direct Annexation by Unanimous Approval – West Fernau Avenue Annexation from the Town of Oshkosh Located at the West 3100 Block of Jackson Street Petitioner/Property Owner: City of Oshkosh Action Requested: The City is requesting direct annexation by unanimous approval of approximately 2.36 acres of land located at the west 3100 Block of Jackson Street in the Town of Oshkosh. Applicable Ordinance Provisions: Procedures concerning annexations are located within Section 30- 360 of the City of Oshkosh Zoning Ordinance as well as within Section 66.0217 of the Wisconsin State Statutes. Property Location and Background Information: The City-owned properties are situated across from the intersection of West Fernau Avenue and Jackson Street. The annexation involves two undeveloped lots and portions of adjacent lots to the north and south. The City is petitioning for this annexation to allow the City to dedicate a street right-of-way extension for West Fernau Avenue, connecting Vinland Street to Jackson Street. Upon dedication, the City plans to construct a concrete street, scheduled for completion in late 2026. Currently, the properties fall under the Town of Oshkosh zoning classifications: Community Business District (B-2) to the north and Light Industrial District (M-1) to the south. This segment of the Jackson Street Corridor hosts diverse uses, including single-family residences, various commercial, personal storage, and agricultural activities. The properties will be annexed with temporary and permanent zoning designations of Suburban Mixed Use (SMU), aligning with the Comprehensive Plan’s Mixed- Use land use recommendation. Fernau Avenue Annexation The proposed annexation complies with Wisconsin’s statutory requirements for unanimous annexations. The property, adjacent to the City on the west, will not create a town island. The State of Wisconsin Department of Administration’s Municipal Boundary Review is currently examining the annexation. Its findings will be submitted to the City before Council action. The Department of Public Works has evaluated the request and stated city water mains, sanitary sewers, and storm sewers, along with other public utilities (gas, electric, communications), will be constructed once West Fernau Avenue is dedicated. The Oshkosh Fire and Police Departments have also reviewed the annexation request and have no concerns about providing services to this area. Recommendation: Staff recommends approval of the West Fernau Avenue Annexation with temporary and permanent zonings of Suburban Mixed Use (SMU) as requested.
