ITEM 11: PUBLIC HEARING: Zone Change from Rural Holding District (RH) to
Heavy Industrial District with a Planned Development Overlay (HI-PD)
for Properties Located east of Compass Way, south of Meadow Park Drive
Applicant/Owner: City of Oshkosh
Action Requested: The City requests a zone change from the existing Rural Holding (RH)
to Heavy Industrial District with a Planned Development Overlay (HI-PD) for two
properties located east of Compass Way and south of Meadow Park Drive, parcels
91334020000 & 91334040000.
Applicable Ordinance Provisions: Zoning map amendment standards are found in
Section 30-381 of the Zoning Ordinance.
Property Location and Background Information: The subject area consists of two vacant
lots in the Southwest Industrial Park generally located east of Compass Way and south of
Meadow Park Drive. Both properties are zoned Rural Holding (RH). The area was
rezoned from Light Agricultural District (A-1) to RH in 2017 with the Zoning Ordinance
rewrite. At that time, it was uncertain what type of development would occur at the site
as the land was owned by a multi-family development company. The City acquired the
land in 2023 with the intent to market the land for industrial development. The City is
currently in talks with a prospective buyer of a portion of the subject site for a
manufacturing use.
The surrounding area consists of
vacant/undeveloped lots to the north
and west, the City transload facility,
railroad and stormwater management
to the south and manufacturing to the
east. The 2040 Comprehensive Land
Use Plan recommends Industrial uses
for the subject area.

Zone Change - The proposed zone change to HI-PD is intended to accommodate a
proposed land sale and manufacturing use development which will include a 120,000
square-foot building with other site improvements. A Planned Development (PD)
Overlay is being placed on the site to be consistent with lands to the west which will be
combined with a portion of the subject site. The PD will be available in case the proposed
development needs relief from the base HI District standards. The zone change to HI will
provide consistent zoning with the rest of the properties located in the Southwest
Industrial Park. A Certified Survey Map (CSM) has been recorded that has created the lot
(Lot 1, See Figure 2) to be sold to the prospective buyer.

Staff is supportive of the proposed zone change to HI-PD as it will serve to accommodate
the proposed manufacturing development of the subject site. The zone change also brings
the site into compliance with the 2040 Comprehensive Land Use Plan recommendation
for Industrial uses.
Findings:
In its review and recommendation to the Common Council on an application for a
Zoning Map amendment, staff recommends the Plan Commission make the following
findings based on the criteria established by Chapter 30-381 (D)(2):
(a) Advances the purposes of this Chapter as outlined in Section 30-03 as the proposed
zone change will result in compatible zoning with the surrounding area.
(b) Maintains the desired overall consistency of land uses, land use intensities, and land
use impacts within the pertinent zoning districts as the proposed HI-PD zoning
designation will be consistent with HI and HI-PD zonings of neighboring
properties.
(c) Addresses any of the following factors that are not properly addressed on the
current Official Zoning Map:
(ii) Factors have changed (such as new data, infrastructure, market conditions,
development, annexation, or other zoning changes), making the subject
property more appropriate for a different zoning district as a proposal for
an industrial development has been submitted that requires the requested
Planned Development Overlay.
Recommendation: Staff recommends approval of the zone change with the findings
listed above.
