A variance is not a waiver from a code requirement. The petitioner must provide an equivalency which meets the intent of the code section petitioned to obtain a variance. Documentation of the rationale for the equivalency is requested below. Failure to provide adequate information may delay your petition. Pictures, sketches, and plans may be submitted to support equivalency. If the proposed equivalency does not adequately safeguard the health, safety, and welfare of building occupants, frequenters, firefighters, etc., the variance request will be denied. NOTE: A SEPARATE PETITION IS REQUIRED FOR EACH BUILDING AND EACH CODE ISSUE PETITIONED (Le., 57.13 window issue cannot be processed on the same petition as 51.16 stair issue). It should be noted that a petition for variance does not take the place of any required plan review submittal. The Division is unable to process petitions for variance that are not properly completed. Before submitting the application, the following items should be checked for completeness in order to avoid delays: . Petitioner's name (typed or printed) . Petitioner's signature . The Petition for Variance Application must be signed by the owner of the building or system unless a Power of Attorney is submitted. . Notary Public signature with affixed seal . Any required position statements by fire chief or municipal official A position statement from the chief of the local fire department is required for fire safety issues. No position statement is required for nontire safety topics such as sanitary. plumbinQ or POWTS systems and enerQV conservation. Position statements for both the fire department and municipality are required for barrier-free petitions. For rules relating to one- and two-family dwellings,. only a position statement from the local enforcing municipality is required. Priority Review: The Department will schedule Petitions for Variance at the earliest available date, or the date requested at time of scheduling, which ever is later. Therefore, Priority Reviews are not generally available. In special circumstances, the Section Chief of the reviewing office may permit review prior to the scheduled date upon request by the submitter. If earlier review is permitted by the Section Chief, the Petition review fees will be doubled. Except for special cases, the Division will review and make a determination on a petition for variance within 3 business days of the scheduled beginning date, provided all calculations, documents, and fees required for the review have been received. Cable ends shall be protected from damage during handling. 9.2 Reels shall be shipped upright, resting on both flanges. 9.3 Reels shall be marked showing the beginning sequential footage, ending sequential footage, and the total measured footage of the cable. As this wiring is premise wiring, it is required to meet the State Electric Code section 16.11, which requires the wiring to be listed unless otherwise approved by the Department (State Dept. of Commerce, Division of Safety & Buildings.) The wiring installed is not listed, however per WPS personnel, it has been indicated that the wiring installed is manufactured to WPS specifications, which they indicated mirrors that of listed conductors. Municipal Recommendation As personnel in this office do not feel they have the expertise to review or make an assessment on the conductors, this office is requiring WPS to secure approval for the use/installation of the unlisted conductors with the Department. this office will defer to the Department for guidance on this Petition. We are relying on the Department's expertise to review and assess the specifications for the unlisted conductors to determine if such are indeed an acceptable material for this installation. In this Petition Review, should it be approved, we request the Department to give guidance on any special installation requirements if different than what is required by the adopted State Electric Code. Additionally, this installation was made without permits or inspections, therefore this office will require inspections of the installation to be made. We request this be made a condition of any approval. IfWPS desires to have State Department representatives make such inspections, this office will not object. While it is not anticipated, if a Petition Approval lists special installation requirements as a condition of approval and such conditions are beyond our scope of expertise, we may request the Department to lend assistance in performing the aforementioned inspections at the Department's convemence. Additionally, as WPS has been notified, they must obtain our local Electrical Contractor's License and secure an Electric Permit for this installation prior to this office making any such inspections. For this reason the installation is covered by the Scope of Comm 16 and should have been installed to meet the requirements of Comm 16 and the 2002 edition of the National Electric Code. A petition on the type of cable used is only appropriate if you can establish an equivalency between the cable used for the installation at Banner Packaging and the type of cable required by the Code. The .National Electric Code requires the use of Type MV cable for this type of installation. Type MV cable is covered by Article 328 in the 2002 NEe. You have submitted copies of pages from the WPS cable purchasing specifications. No background information on the cable actually used on the job or comparison with approved cables was included. Please submit a complete comp'arison which includes cable specifications for the actual type of cable used on the project. This type of information is commonly available through the cable manufacturer. Your report shall compare the construction of the type of cable used to the applicable requirements for the manufacture of listed type MV cable. Type MV Cable is listed to UL 1072, Medium Voltage Power Cable. A competent professional engineer should do the comparison. Presumably the comparison will be favorable and will form the basis for establishing an equivalency between the technical requirements of the National Electric Code and the cable you elected to use. The City of Oshkosh has requested our assistance is. determining the adequacy of the installation. This request came as part of their response in completing the Municipal Building Inspection Recommendation form. This is a separate issue from the cable insulation issue. If you could please give us directions as to an acceptable relocation for these disconnects it would be appreciated. Pictures illustrate regulator vents between the disconnects and gas piping, could you check if this is acceptable. Also, it would be helpful for us if you could list the code or provide a copy of the code for this violation so that we can provide further evidence to the manufacturer that a problem is present and that a correction is required. For motors, see 430.14. 110.19 Light and Power from Railway Conductors. Circuits for lighting and power shall not be connected to any system that contains trolley wires with a ground return. Exception: Such circuit connections shall be permitted in car houses, power houses, or passenger and freight stations operated in connection with electric railways. 110.21 Marking. The manufacturer's name, trademark, or other descriptive marking by which the organization re- sponsible for the product can be identified shall be placed on all electric equipment. Other markings that indicate volt- age, current, wattage, or other ratings shall be provided as specified elsewhere in this Code. The marking shall be of sufficient durability to withstand the environment involved. 110.22 Identification of Disconnecting Means. Each dis- connecting means shall be legibly marked to indicate its purpose unless located and arranged so the purpose is evi- dent. The marking shall be of sufficient durability to with- stand the environment involved. Where circuit breakers or fuses are applied in compli- ance with the series combination ratings marked on the equipment by the manufacturer, the equipment enclosure(s) shall be legibly marked in the field to indicate the equip- ment has been applied with a series combination rating. (a) Dead-Front Assemblies. Working space shall not be required in the back or sides of assemblies, such as dead-front switchboards or motor control centers, where all connections and all renewable or adjustable parts, such as fuses or switches, are accessible from locations other than the back or sides. Where rear access is required to work on nonelectrical parts on the back of enclosed equipment, a minimum horizontal working space of 762 mm (30 in.) shall be provided. (b) Low Voltage. By special permission, smaller work- ing spaces shall be permitted where all uninsulated parts operate at not greater than 30 volts rms, 42 volts peak, or 60 volts dc. (c) Existing Buildings. In existing buildings where electrical equipment is being replaced, Condition 2 working clearance shall be permitted between dead-front switch- boards, panelboards, or motor control centers located across the aisle from each other where conditions of main- tenance and supervision ensure that written procedures have been adopted to prohibit equipment on both sides of the aisle from being open at the same time and qualified ~ persons who are authorized will service the installation. (2) Width of Working Space. The width of the working space in front of the electric equipment shall be the width of the equipment or 750 mm (30 in.), whichever is greater. 2002 Edition 70-44 ARTICLE 11O-REQUfREMENTS FOR ELECTRICAL INSTALLATIONS In all cases, the work space shall permit at least a 90 degree ~ opening of equipment doors or hinged panels. (3) Height of Working Space. The work space shall be clear and extend from the grade, floor, or platform to the height required by llO.26(E). Within the height require- ments of this section, other equipment that is associated with the electrical installation and is located above or be- low the electrical equipment shall be permitted to extend not more than 150 mm (6 in.) beyond the front of the electrical equipment. (B) Clear Spaces. Working space required by this section shall not be used for storage. When normally enclosed live parts are exposed for inspection or servicing, the working space, if in a passageway or general open space, shall be suitably guarded. (C) Entrance to Working Space. (1) Minimum Reqnired. At least one entrance of suffi- cient area shall be provided to give access to working space about electrical equipment. (2) Large Equipment. For equipment rated 1200 amperes or more and over 1.8 m (6 ft) wide that contains overcur- rent devices, switching devices, or control devices, there shall be one entrance to the required working space not less than 610 mm (24 in.) wide and 2.0 m (61f2 ft) high at each end of the working space. Where the entrance has a person- nel door(s), the door(s) shall open in the direction of egress and be equipped with panic bars, pressure plates, or other devices that are normally latched but open under simple pressure. A single entrance to the required working space shall be permitted where either of the conditions in 1l0.26(C)(2)(a) or (b) is met. (a) Unobstructed Exit. Where the location permits a continuous and unobstructed way of exit travel, a single entrance to the working space shall be permitted. (b) Extra Working Space. Where the depth of the working space is twice that required by 1l0.26(A)(1), a single entmnce shall be permitted. It shall be located so that the distance from the equipment to the nearest edge of the entrance is not less than the minimum clear distance speci- fied in Table] 1O.26(A)(l) for equipment operating at that voltage and in that condition. (D) Illumination. Illumination shall be provided for all working spaces about service equipment, switchboards, panelboards, or motor control centers installed indoors. Ad- ditional lighting outlets shall not be required where the work space is illuminated by an adjacent light source or as permitted by 21O.70(A)(1), Exception No.1, for switched receptacles. In electrical equipment rooms, the illumination shall not be controlled by automatic means only. 2002 Edition (E) Headroom. The mmlmum headroom of working spaces about service equipment, switchboards, panelboards, or motor control centers shall be 2.0 m (6Yz ft). Where the electrical equipment exceeds 2.0 m (6Y2 ft) in height, the minimum headroom shall not be less than the height of the equipment. Exception: In existing dwelling units, service equipment or panelboards that do not exceed 200 amperes shall be pennitted in spaces where the headroom is less than 2.0 m (6ljz ft). (F) Dedicated Equipment Space. All switchboards, pan- elboards, distribution boards, and motor control centers shall be located in dedicated spaces and protected from damage. Exception: Control equipment that by its very nature or because of other rules of the Code must be adjacent to or within sight of its operating machinery shall be pennitted in those locations. (1) Indoor. Indoor installations shall comply with 1l0.26(F)(1)(a) through (d). (a) Dedicated Electrical Space. The space equal to the width and depth of the equipment and extending from the floor to a height of 1.8 m (6 ft) above the equipment or to the structural ceiling, whichever is lower, shall be dedicated to the electrical installation. No piping, ducts, leak protec- tion apparatus, or other equipment foreign to the electrical installation shall be located in this zone. Exception: Suspended ceilings with removable panels shall be permitted within the l.8-m (6-ft) zone. (b) Foreign Systems. The area above the dedicated space required by llO.26(F)(l)(a) shall be permitted to con- tain foreign systems, provided protection is installed to avoid damage to the electrical equipment from condensa- tion, leaks, or breaks in such foreign systems. (c) Sprinkler Protection. Sprinkler protection shall be permitted for the dedicated space where the piping com- plies with this section. (d) Suspended Ceilings. A dropped, suspended, or similar ceiling that does not add strength to the building structure shall not be considered a structural ceiling. (2) Outdoor. Outdoor electrical equipment shall be in- stalled in suitable enclosures and shall be protected from accidental contact by unauthorized personnel, or by vehicu- lar traffic, or by accidental spillage or leakage from piping systems. The working clearance space shall include the zone described in II0.26(A). No architectural appurtenance or other equipment shall be located in this zone. 110.27 Guarding of Live Parts.
