REGARDING THE CRITERIA OF REASONABLENESS AND BENEFIT
This report was prepared and submitted to satisfy the requirements that the City is
required to show that the assessments will benefit the properties assessed in the
Driveway Aprons, Sanitary Sewer Main and Laterals (New and Relay), Water Main
and Laterals (New and Relay), and Storm Sewer Mains and Laterals (New and Relay)
Relating to Contract No. 25-09 assessments as per Wisconsin State Supreme Court
Decision (Berkvam vs. the City of Glendale, 79 Wis. 2d 279.255 NW 251 (1979).
Criteria of Reasonableness
It is the opinion of this office that the assessments are, in fact, reasonable. The
assessments have been calculated in accordance with the City of Oshkosh Policy for
Special Assessments for assessing costs for street construction. Utility lateral costs
are assessed to each lot needing lateral work. Driveway costs are assessed to the
abutting property owner based on a square foot cost.
The Properties Against which the Assessments are Proposed are Benefited as
follows:
This improvement consists of the construction of concrete or bituminous
pavement and replacement of the sanitary sewer mains and laterals, storm sewer
laterals, and water distribution mains and laterals. The utility laterals provide a
connection to the mains for each property. The storm sewer system will convey
the runoff away from the area. The sanitary sewer and water distribution
systems will provide a safe and reliable conveyance system for wastewater and
drinking water.
Estimated cost of the project is: $7,993,000.00
Proposed Assessments are: $155,950.00
City Cost of the project is: $7,837,050.00

1 THE CONTRACTOR SHALL FIELD VERIFY SANITARY LATERAL LOCATIONS AND SHALL
DETERMINE WHICH LATERALS ARE LIVE AND NEED TO
BE RECONNECTED. THE ENGINEER WILL ASSIST THE CONTRACTOR IN
DETERMINING WHICH LATERALS ARE TO BE RECONNECTED.
2 IMMEDIATELY AFTER CONSTRUCTION OF ANY INLET, THE CONTRACTOR SHALL
INSTALL INLET PROTECTION IN THE STRUCTURE TO MINIMIZE SEDIMENTATION
OF THE INLET AND STORM SEWER.
3 NEW CURB BOXES WILL BE PROVIDED BY THE CITY FOR EXISTING INLET CASTING
