HomeMy WebLinkAboutItem III PLAN COMMISSION STAFF REPORT JULY 15, 2025 ITEM III: ACCEPT STORM WATER POND/BASIN EASEMENT LOCATED SOUTHWEST OF 2022 OLIVIA ROAD, PARCEL 91276150100 (LAKE BUTTE DES MORTS DEVELOPMENT) Applicant: City of Oshkosh Department of Public Works Owners: Red Earth, LLC. Actions Requested: The Department of Public Works is requesting acceptance of a storm water pond / basin easement agreement to address storm water issues resulting from Phase 2 of the Lake Butte des Morts Development. Applicable Ordinance Provisions: N/A Property Location and Background Information: The subject property is located southwest of Phase 2 of the Lake Butte des Morts multi-family development. Phase 2 which is currently undergoing City review involves construction of an 80-unit apartment, and street extension. The proposed easement is adjacent to an easement located within the Phase 2 development property and will essentially serve and function as a single easement. The easement will allow all municipal storm water uses as part of Red Earth’s public storm water management system. In addition, the easement will also allow storm water emanating from public rights-of-way as well as areas outside of Red Earth’s property to drain through the pond. The easement provides City access to inspect the pond to ensure it is functioning as designed. The easement language applies several requirements and conditions to both Red Earth and the City. Red Earth has been involved with the creation of this easement and is agreeable to its granting. Final, signed easement documents will be recorded at the Winnebago County Register of Deeds after Common Council approval. RECOMMENDATION Staff recommends approval of the acceptance of the proposed storm sewer easement at the property located southwest of 2022 Olivia Road, as requested.
