BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper City
officials are hereby authorized and directed to execute any and all documents necessary to
consummate the sale of Parcel G within the Marion Road I Pearl Avenue Redevelopment
Project Area, to Concord 30 LLC, and to enter into a Developer Agreement for
redevelopment of said Parcel G with substantially the same terms as attached hereto, any
changes in the execution copy being deemed approved by their respective signatures, and
said City officials are authorized and directed to take those steps necessary to implement the
City's obligations under the Developer Agreement.
BE IT RESOLVED by the Common Council of the City of Oshkosh that a conditional
use permit for a planned residential development for construction of two 3 story buildings to
be completed in phases, consisting of 102 total units, a community room, and underground
and surface parking, per the attached, is hereby approved with the following conditions:
1 )
Temporary driveway access from Dawes Street or Street B is granted subject to
approval by the Planning Services Division and that the driveways are to be relocated
when proposed Street A is constructed. Temporary driveway accesses are to be
abandoned per the Department of Public Works.
The "future" parking areas identified on the proposed site plan are to be developed for
parking at the time of construction of each building, bringing the total number of
parking spaces provided to 204 for the project.
Final landscape I site plan subject to approval by the Planning Services Division.
The base standard modification for the 6 ft. building setback is subject to any
restrictions associated with the established utility easement.
A base standard modification is approved to allow living unit densities of 1,289+ sq. ft.
per unit.
A site grading and drainage plan be approved to prohibit sheet drainage to the public
street and storm water quality requirements.

BE IT FURTHER RESOLVED that the Common Council of the City of Oshkosh hereby
approves of the Planned District Overlay and final development plan per the attached.

Property: Parcel G, Marion Road Redevelopment Area.
Description: Construction of two 51 unit three story multifamily buildings
connected by a one story building which will function as an office and community
center and the primary entrance to the development. The project will also include
116 underground and 88 surface parking spaces.
Project amenities to be as described in proposal in addition to the provision of
clothes washers and dryers in each unit.
The total value of the project will be $ 7 million at completion.
II.
Timing: Construction will be completed in two phases:
a)
Phase I will include the multifamily building on the west side of the parcel and
surface and underground parking and site improvements associated with that
phase. Construction of Phase I will begin no later than August 31, 2005 and be
completed within 300 days of commencement.
Phase II will include the second multifamily building and the central one story
structure, remaining parking and site improvements. Construction of Phase II will
begin no later than 120 days following the date Phase I is 75% occupied and will
be completed within 300 days of commencement.

LeaselPurchase Arrangements
a)
The land sale price is $100,000 with up to a $50,000 deduction for certain
environmental, geotechnical and site development costs.
The property will be initially leased to the developer. At the time the lease is
signed the developer will provide the city with a letter of credit for $50,000.
The property will be transferred to the ownership of the developer upon receipt of
a Certificate of Completion issued by the DNR under the Land Recycling Act.

SUPPLEMENT TO GENERAL APPLICATION OF CONCORD 30, LLC
NOVEMBER 1, 2004
Concord 30, LLC proposes to construct a 102 unit, two phase (two building), three story wood
frame apartment complex of approximately 116,000 square feet over a partially exposed pre-cast
parking garage of approximately 38,600 square feet. Approximately one-third of each building
will be comprised of one bedroom units, with the remainder consisting of two bedroom units.
The units will be designed to accommodate individual washers and dryers. The project intends
to provide amenities, such as elevators and a tenant fitness center, not readily available in the
downtown/campus area. We also propose to construct a 1,182 square foot community room,
with kitchen facilities and patio, which will adjoin the two buildings and provide a central
location for management offices.
The buildings' exteriors will combine cast stone, brick, and stucco with metal accents on the roof
parapets. The buildings' locations will result in the placement of some balconies on the property
line, six feet (6') from the sidewalk. Foundation plantings will be provided around the buildings,
as well as a landscaped tenant courtyard between buildings south of the community room, and
landscaped green space between buildings and sidewalks at the entry patio north of the
community room. On the south end of the parcel, we propose to construct 70 surface parking
spaces that will be screened from Pearl Avenue, in addition to 116 underground spaces, resulting
in one stall per bedroom. In the event two stalls per unit are required based on actual parking
demand, 18 additional spaces will be constructed (shown as "future" on the plan).
Concord 30, LLC proposes to commence construction of the first phase of 51 units and 34
surface parking stalls not later than August 31, 2005 and estimates completion of the first phase
within 300 days of commencement. We propose to commence construction of the second phase
of 51 units, the community room, and balance of parking within 300 days of complete occupancy
of the first phase and complete construction within 300 days of commencement.
