ITEM IV: RECOMMENDATION PERTAINING TO ACQUISITION OF VACANT
PROPERTY LOCATED AT EAST TERMINUS OF WINDSONG TERRACE
(PARCEL 91347060000)
GENERAL INFORMATION
Applicant: City of Oshkosh Department of Public Works
Property Owners: Jamie and Amie Schmude
Action(s) Requested:
The City of Oshkosh Department of Public Works is requesting approval to acquire a vacant lot
located at the east terminus of Windsong Terrace for street, municipal utility and residential
development. Under Section 62.23 of the Wisconsin Statutes and Chapter 30 of the City’s
Municipal Code, the Plan Commission is responsible to review and advise the Council on the
acquisition of land for public purposes. The Council will, based upon the recommendation from
Plan Commission, make a final determination on whether to acquire the property as requested.

Property Location and Background Information:
The subject area involves a vacant
single property located at the east end
of Windsong Terrace approximately
325 feet east of Clairville Road. The lot
is identified as Lot 2 of Certified
Survey Map (CSM) Number 6986
recorded in 2015. This lot and much of
the surrounding area attached to the
City on March 1, 2023 as part of the
Zone C Expansion Area per the
boundary agreement between the City
and Town of Algoma. The purpose of
this land acquisition is to link
Mockingbird Way to the east to Windsong Terrace.
The residential developments to the east (Westleigh Farms, Pheasant Creek Farm, The Meadows
on Sawyer Creek and Casey’s Meadow South) contain over 500 single-family lots. These
properties are served by two street connections to a collector street, one on South Oakwood Road
and the other on West 9th Avenue. The situation is not ideal as the Transportation Department has
received complaints regarding traffic congestion and the Police and Fire Departments have
voiced concerns with the lack of street connections to access the interior of these developments.

The City has received a request to review the Fifth Addition to Casey’s Meadow South
preliminary plat which will add 90+ single-family lots to the east. To relieve traffic congestion and
address concerns raised by the Oshkosh Fire and Police Departments, another connection to a
collector street is needed. The plat shows an extension of Mockingbird Way to the east lot line of
the subject site. The proposed land acquisition will allow the City to dedicate additional street
right-of-way and link Mocking Bird Way to Windsong Terrace resulting in a connection to
Clairville Road.
The City officially mapped an extension of Mockingbird Way from its current western end to
Windsong Terrace in 2021. Official mapping is a tool used to preserve areas from inadvertent
development until the area is developed as intended.
The subject site as well as the surrounding area has a zone district classification of Single Family
Residential-5 (SR-5), which is consistent with Comprehensive Plan’s Low Density Residential
land use recommendation. The properties adjacent to the subject site are either vacant or being
used for agricultural purposes with exception of a single-family house to the west.

ANALYSIS
The subject lot is irregularly shaped, approximately 224 feet deep by 260 feet wide and 51,300
square feet in area. The CSM shows the south 66 feet of the lot reserved for future right-of-way.
Although the reservation has no legal bearing, the owner at the time the CSM was created was
aware a street may, in the future, extend to the east.

Once the land acquisition is complete,
the City will have a CSM drafted for
right-of-way dedication and divide the
remaining north portion into three
single-family lots.
The right-of-way dedication will allow
extensions of water main, sanitary
sewer, storm sewer and street
construction connecting Mockingbird
Way to Clairville Road. As plans
progress, staff will request Council to
approve a street name change for
Windsong Terrace to Mockingbird
Way.
This review and subsequent approval
by the Common Council is the first
step for the City to acquire this
property. The City is required to follow
the acquisition process as required by
state statute.
RECOMMENDATION/CONDITIONS
Staff recommends approval of the proposed property acquisition at the east terminus of
Windsong Terrace (Parcel 91347060000) as requested.
